Savitri Devi &amp; Ors.\n                       DATE OF ORDER : 2\/2\/2010\n\n               HON'BLE DR.JUSTICE VINEET KOTHARI\n\n\nMr.Sajjan Singh, for the appellant.\nMr.C.R.Jakhar, for the respondent.\n\n       This appeal is directed against the order dated 23\/3\/2003 passed by\nthe learned court below while deciding application under Order 39 Rule 1\nand 2 CPC. The court below in respect of land acquired has held that 1\/10th\namount of the compensation shall not be received by the non-applicant,\npresent appellants before this Court and said amount of 1\/10 of the\ncompensation amount of Rs.97,591\/- shall remain deposited in the\nNationalized Bank in fixed deposit.\n       Learned counsel for the appellant defendants submits that said\namount may be permitted to be disbursed to the defendants as there was a\nrelease deed in favour of defendants and subject to their furnishing the\nsolvent security, the learned court below may be requested to decide the\nsuit expeditiously.\n       Though this request was opposed by the learned counsel for the\nrespondent-plaintiff, he submitted that the money in question may be kept in\nfixed deposit of the bank as directed by the learned court below.\n       Having heard the learned counsels, this Court is of the opinion that\ninterest of justice would be met if the impugned order dated 22\/3\/2003\npassed by the court below is modified to the extent that the said 1\/10th\namount of the compensation lying in fixed deposit of the bank may be\ndisbursed to the appellant defendants subject to their furnishing solvent\nsecurity to the satisfaction of learned trial court that in case the suit is\ndecreed and it is held against them that they are not entitled to the land in\nquestion, they will refund the said amount with @ 9% simple interest.\n       Consequently, this appeal is partly allowed and the impugned order\ndated 22\/3\/2003 is modified in aforesaid terms.
