The contention of learned counsel for the applicant is that<br \/>\nSection 306 IPC provides punishment of 10 years and as such<br \/>\nthe period provided under the law is 60 days. As the police had<br \/>\nnot filed a charge sheet within 60 days of its production in the<br \/>\nCourt, the petitioner filed bail application under Section 167(2) of<br \/>\nCr.P.C. which was wrongly rejected by the Trial Court on the<br \/>\nground that Section 306 of IPC provides punishment of 10 years<br \/>\nand as such period provided under the law is 90 days. He submits<br \/>\nthat the learned court below committed illegality in rejecting the<br \/>\napplication. In support of the said contention, he drew my<br \/>\nattention to the decision of Gwalior Bench in the case of Ram<br \/>\nDayal Gupta vs State of M.P., 1999 (2) MPWN [39].\n<\/p>\n<p>3.    The object behind the enactment of Section 167 of the<br \/>\nCode was that the detention of an accused person should not be<br \/>\npermitted, in custody pending investigation for any unreasonably<br \/>\nlonger period. Proviso to Section 167(2) of the Code prescribes<br \/>\nthe outer limit within which the investigation must be completed.<br \/>\nThe proviso to sub-section (2) fixes the outer limit within which the<br \/>\ninvestigation must be completed and in case the same is not<br \/>\ncompleted within the said prescribed period, the accused would<br \/>\nacquire a right to seek to be released on bail and if he is prepared<br \/>\nto and does furnish bail, the Magistrate shall release him on bail<br \/>\n and such release shall be deemed to be grant of bail under<br \/>\nChapter XXXIII of the Code of Criminal Procedure. If the<br \/>\ninvestigation is not completed within the period of ninety days or<br \/>\nsixty   days then the accused has to be released on bail as<br \/>\nprovided under the proviso to Section 167(2). The petitioner was<br \/>\narrested on 4.1.2010 and on 18.3.2010 he completed 71 days of<br \/>\njudicial custody but no charge sheet was submitted within 60 days<br \/>\nas provided under Section 167(2) of Cr.P.C. Proviso (a) to Section<br \/>\n167 (2) reads as under:-\n<\/p>\n<blockquote><p>            167.    Procedure when investigation<br \/>\n            cannot be completed in twenty-four<br \/>\n            hours.- (1) xxx xxx xxx<\/p>\n<p>            (2) xxx xxxx      xxxx<\/p>\n<p>            Provided that-\n<\/p><\/blockquote>\n<blockquote><p>            (a) the Magistrate may authorise the<br \/>\n            detention of the accused person, otherwise<br \/>\n            than in custody of the police, beyond the<br \/>\n            period of fifteen days if he is satisfied that<br \/>\n            adequate grounds exist for doing so, but no<br \/>\n            Magistrate shall authorise the detention of<br \/>\n            the accused person in custody under this<br \/>\n            paragraph for a total period exceeding,-\n<\/p><\/blockquote>\n<blockquote><p>            (i)    ninety days, where the investigation<br \/>\n            relates to an offence punishable with death,<br \/>\n            imprisonment for life or imprisonment for a<br \/>\n            term of not less than ten years;\n<\/p><\/blockquote>\n<blockquote><p>            (ii)   xxx xxx xxx<\/p>\n<\/blockquote>\n<p>4.      Further, section 306 of IPC provides as under:\n<\/p>\n<p>           306. Abetment of suicide-          If      any<br \/>\n           person commits suicide, whoever abets the<br \/>\n           commission of such suicide, shall be<br \/>\n           punished    with   imprisonment     of   either<br \/>\n           description for a term which may extend to<br \/>\n          ten years, and shall also be liable to fine.\n<\/p>\n<p>5.    From the relevant part of the aforesaid sections, it is<br \/>\napparent that pending investigation relating to an offence<br \/>\npunishable with imprisonment for a term &#8220;not less than 10 years&#8221;,<br \/>\nthe Magistrate is empowered to authorize the detention of the<br \/>\naccused in custody for not more than 90 days. For rest of the<br \/>\noffences, the period prescribed is 60 days. Hence in cases where<br \/>\noffence is punishable with imprisonment for 10 years or more, the<br \/>\naccused could be detained up to a period of 90 days. In this<br \/>\ncontext, the expression &#8220;not less than&#8221; would mean imprisonment<br \/>\nshould be 10 years or more and would cover only those offences<br \/>\nfor which punishment could be imprisonment for a clear period of<br \/>\n10 years or more. Under Section 306 punishment provided is<br \/>\nimprisonment of either description for a term which may extend to<br \/>\n10 years and also fine. That means, imprisonment can be for a<br \/>\nclear period of 10 years or less. Hence, it could not be said that<br \/>\nminimum sentence would be 10 years or more. Further, in context<br \/>\nalso if I consider clause (i) of proviso (a) to Section 167(2), it<br \/>\nwould be applicable in case where investigation relates to an<br \/>\noffence punishable (1) with death; (2) imprisonment for life;and (3)<br \/>\nimprisonment for a term of not less than 10 years. It would not<br \/>\ncover the offence for which punishment could be imprisonment for<br \/>\nless than 10 years. Under Section 306 of IPC, imprisonment can<br \/>\nvary from minimum to maximum 10 years and it cannot be said<br \/>\nthat imprisonment prescribed is not less than 10 years.\n<\/p>\n<p>6.    Punishment provided under Section 306 and 386 of IPC<br \/>\nare same. Under Section 386 also punishment provided is<br \/>\nimprisonment of either description for a term which may extend<br \/>\n upto 10 years and also fine. <a href=\"\/doc\/1013958\/\">In       Rajeev Chaudhary vs State<br \/>\n(NCT) of Delhi,<\/a> (2001) 5 SCC 34 the Apex Court held that<br \/>\nimprisonment for a term of &#8220;not less than 10 years&#8221;, covers<br \/>\noffence punishable with imprisonment for a clear period of 10<br \/>\nyears or more. In view of law laid down by the Apex Court in the<br \/>\ncase of <a href=\"\/doc\/1013958\/\">Rajeev Chaudhary vs State (NCT) of Delhi<\/a> (supra), this<br \/>\nCourt is of the view that the learned Trial Court has not committed<br \/>\nany legal error in rejecting the application for grant of bail filed by<br \/>\nthe applicant under Section 167 (2) of Cr.P.C.\n<\/p>\n<p>7.     In view of above, it is apparent that in cases where offence<br \/>\nis punishable with imprisonment for 10 years or more, the<br \/>\naccused could be detained up to a period of 90 days.\n<\/p>\n<p>8.
