The State of Rajasthan\n\n\n    DATE OF ORDER              :     17th September 2009\n\n            HON'BLE MR.JUSTICE DINESH MAHESHWARI\n\n    Mr.Mridul Jain,for the petitioner.\n    Mr.Ashok Prajapat, Public Prosecutor for State.\n                                     ....\n\n    BY THE COURT<\/pre>\n<p>            The petitioner is accused of offence under Section 19\/54<br \/>\n    of the Rajasthan Excise Act. The first bail application as<br \/>\n    moved by the petitioner was dismissed as not pressed on<br \/>\n    07.07.2009.\n<\/p>\n<p>            The petitioner has moved this second bail application<br \/>\n    with the submissions that challan has since been filed and he<br \/>\n    is in custody since 29.05.2009 and co-accused have already<br \/>\n    been granted bail.\n<\/p>\n<p>            It was noticed while considering the first bail application<br \/>\n    that the petitioner had been involved in two cases previously<br \/>\n    relating to the offences under the Rajasthan Excise Act. The<br \/>\n    fact of the petitioner&#8217;s involvement in such cases is not denied.<br \/>\n    On such facts and looking to the over all circumstances, this<br \/>\n    Court is not inclined to grant the petitioner indulgence.\n<\/p>\n<p>            This second bail application as moved on behalf of the<br \/>\n    petitioner Parmesh is, therefore, rejected.
