M. SAHAI)<\/p>\n<p>1.\t\tWe<br \/>\nhave heard Mr. Y.V. Shah, learned Counsel for the petitioners.  No<br \/>\none has appeared for the respondent.\n<\/p>\n<p>2.\t\tThe<br \/>\npetitioner was working as a loco cleaner. He was removed from the<br \/>\nservice on 17.06.1986, on the charge of misconduct.  He filed an O.A.<br \/>\nbefore the Central Administrative Tribunal, which was dismissed.  The<br \/>\nsame was challenged by him in Special Civil Application No.7246 of<br \/>\n2001. The petitioner died on 17.04.2000. Thereafter, the Division<br \/>\nBench of this Court dismissed the writ-petition, observing that the<br \/>\nclaim of the petitioners, for benefit of compensatory pension, as<br \/>\nprovided under Rule 416 of the Railway Pension and Retirement<br \/>\nBenefits Rules, be considered, on a representation made by the<br \/>\npetitioners.\n<\/p>\n<p>3.\t\tThe<br \/>\npetitioners made a representation and their claim has been rejected,<br \/>\nby an order, dated 10.12.2002, passed by the Respondents.  It is this<br \/>\norder, which has been challenged in this petition.\n<\/p>\n<p>4.\t\tThe<br \/>\nreason for rejecting the claim of the petitioners, as mentioned in<br \/>\nthe order dated 10.12.2002, was that the petitioner was unauthorized<br \/>\nabsentee. The petitioner, therefore, does not deserve any special<br \/>\nconsideration and representation, demanding compensatory pension,<br \/>\nmade by the petitioners was rejected.\n<\/p>\n<p>5.\t\tThe<br \/>\nlearned Counsel for the petitioners has placed reliance on a Division<br \/>\nBench decision of this Court in Special Civil Application No.11318 of<br \/>\n2002, decided on 21.03.2003, by which the Division Bench found that<br \/>\nthe grant of compensatory allowance is the discretion given to the<br \/>\ncompetent authority and directed the respondents to again decide the<br \/>\nrepresentation.\n<\/p>\n<p>6.\t\tOnce,<br \/>\nthe claim of the petitioners has been rejected by the authority on<br \/>\n10.12.2002, in our opinion, the authority cannot be directed to<br \/>\ndecide the matter again, unless there was some mistake committed by<br \/>\nit. We do not find that the discretion exercised by the competent<br \/>\nauthority in rejecting the representation of the petitioner was in<br \/>\nany manner illegal.\n<\/p>\n<p>7.\t\tWe<br \/>\nfind no merit in this petition. This petition fails and is dismissed,<br \/>\naccordingly. Rule is discharged.\n<\/p>\n<p>(V.\n<\/p>\n<p>M.
