Noor Sarai, District-\n              Nalanda.\n                                     Versus\n                               STATE OF BIHAR\n                                     -----------\n<\/pre>\n<p>5   12.10.2010               Heard learned counsel appearing on behalf<\/p>\n<p>                     of    the     petitioners    and    the    learned     counsel<\/p>\n<p>                     appearing on behalf of the State.<\/p>\n<p>                             Petitioners are apprehending their arrest<\/p>\n<p>                     in connection with Noor Sarai P.S. Case No.35<\/p>\n<p>                     of     2010    for   the     offence      punishable      under<\/p>\n<p>                     Sections 147, 149, 341, 323, 354\/379, 506 and<\/p>\n<p>                     504 of the Indian Penal Code and 27 of the Arms<\/p>\n<p>                     Act.\n<\/p>\n<p>                             The prayer in so far as petitioner No.6,<\/p>\n<p>                     Bhola     Chouhan    is    concerned,      stood    withdrawn<\/p>\n<p>                     following his arrest and taken note of in the<\/p>\n<p>                     order dated 25.08.2010 passed in the present<\/p>\n<p>                     proceedings.\n<\/p>\n<p>                             Learned      counsel       for    the    petitioners<\/p>\n<p>                     submits that the entire allegation is by reason<\/p>\n<p>                     of    altercation      having    taken     place    for   non-<\/p>\n<p>                     payment of the dues.\n<\/p>\n<p><span class=\"hidden_text\">                         2<\/span><\/p>\n<p>       Be that as it may, having regard to the<\/p>\n<p>nature of allegation as set out in the F.I.R.,<\/p>\n<p>the    prayer          in     so     far      as    petitioner          No.1,<\/p>\n<p>Ayodhya Chouhan and petitioner No.2, Lal Das<\/p>\n<p>Chouhan is concerned, is rejected.<\/p>\n<p>       The said petitioners, if so advised, may<\/p>\n<p>file their application for regular bail before<\/p>\n<p>the Court below and which shall be considered<\/p>\n<p>and disposed of on its own merits without being<\/p>\n<p>prejudiced by the order passed in the present<\/p>\n<p>proceedings.\n<\/p>\n<p>       In    so    far        as    petitioner         No.    3.    Lohari<\/p>\n<p>Chouhan, petitioner No.4, Bhushan Chouhan and<\/p>\n<p>petitioner No.5, Satish Chouhan, is concerned<\/p>\n<p>as    there       is    no     specific            allegation      against<\/p>\n<p>these three petitioners except being member of<\/p>\n<p>the mob,          let       the      said      petitioners         namely,<\/p>\n<p>Lohari      Chouhan,          Bhushan          Chouhan       and    Satish<\/p>\n<p>Chouhan,      in        the        event      of    their     arrest      or<\/p>\n<p>surrender within four weeks from the date of<\/p>\n<p>receipt\/production                 of     a   copy     of    this       order<\/p>\n<p>before      the    Court       below,         be    released       on    bail<\/p>\n<p>upon each of them individually furnishing bail<\/p>\n<p>bonds of Rs.10,000\/- (ten thousand) with two<\/p>\n<p>sureties      of        the        like       amount    each       to    the<\/p>\n<p>satisfaction of the Chief Judicial Magistrate,<br \/>\n<span class=\"hidden_text\">                         3<\/span><\/p>\n<p>          Nalanda at Biharsharif in connection with Noor<\/p>\n<p>          Sarai P.S.
