Opposite parties\n\n                           --------------\n\nHon'ble Rajiv Sharma, J.\n<\/pre>\n<p>      Heard learned Counsel for the petitioners, Mr. Salil Kumar<br \/>\nSrivastava, learned Counsel for the U. P. State Medical Faculty,<br \/>\nlearned Standing Counsel and Mr Sandeep Dixit, learned Counsel<br \/>\nfor the opposite party No.3.\n<\/p>\n<p>      Brief facts of the case are that the petitioners were selected<br \/>\nin U. P. State Medical Faculty Diploma in X-Ray and Lab Technician<br \/>\nCourses 2009. Thereafter, they were recommended to pursue the<br \/>\ncourse from ERAZ Lucknow Medical College\/opposite party No.3.<br \/>\nWhen the institution did not permit the petitioners to pursue their<br \/>\ncourse, they preferred a representation before the opposite party<br \/>\nNo.2 requesting him to adjust them in any other college in the<br \/>\nState of Uttar Pradesh, but no heed was paid by the authorities<br \/>\nand on account of the inaction of the opposite party No.2, the<br \/>\ninstant writ petition has been filed.\n<\/p>\n<p>      Mr.Sandeep Dixit, learned Counsel for the private Medical<br \/>\nCollege submits that a perusal of Section 2 of Uttar Pradesh<br \/>\nPrivate   professional   Educational    Institutions   (Regulation    of<br \/>\nAdmission and Fixation of Fee) Act, 2006 [hereinafter referred to<br \/>\nas the &#8216;Act&#8217;] would show that the Act shall be applicable to the<br \/>\nprivate aided and unaided professional institutions excluding the<br \/>\nminority institutions. Thus, in view of the provisions of Section 2,<br \/>\nin the minority institution, i.e. opposite party No.3, admissions<br \/>\ncannot be regulated by the State Government.\n<\/p>\n<p>      Learned Counsel for the petitioners submits that they are<br \/>\nfully eligible and the persons who are below in merit to the<br \/>\npetitioners are pursing the course, but the petitioners have been<br \/>\n<span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>ignored only on the ground that the provisions of the Act are not<br \/>\napplicable in the college, which has been recommended for<br \/>\npursuing the aforesaid course and as such, they cannot be<br \/>\ndeprived.\n<\/p>\n<p>      At this stage, he prays that the petitioners may be allowed<br \/>\nto move a fresh representation and the opposite parties may be<br \/>\ndirected to provide admission in any other College in the State of<br \/>\nU.P., to which learned Counsel for the opposite parties have no<br \/>\nobjection.\n<\/p>\n<p>      Accordingly, the petitioners are directed to move a fresh<br \/>\nrepresentation within 15 days from today and if such a<br \/>\nrepresentation is made, the opposite parties are directed to<br \/>\nconsider and decide the representation of the petitioners, within a<br \/>\nmaximum period of two months, from the date of presentation of<br \/>\na certified copy of this order.\n<\/p>\n<p>      The writ petition stands disposed of in above terms.\n<\/p>\n<p>Dt.8.7.2010<br \/>\nLakshman\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Anuj Maurya And Ors. vs State Of U.P.Through Secy. &#8230; on 8 July, 2010 1 Court No. 24 Writ Petition No. 417 (MS) of 2010 Anuj Maurya and others &#8230; Petitioners Versus State of U.P. and others &#8230; Opposite parties &#8212;&#8212;&#8212;&#8212;&#8211; Hon&#8217;ble Rajiv Sharma, J.
