It is also not<br \/>\nin dispute that after the custody of the vehicle was handed over to<br \/>\nthe applicant &#8211; Shantiben, she has not misused the liberty<br \/>\ngranted to her. The only objection is that the convict has not paid<br \/>\nthe fine and the trial Court has also ordered to pay certain amount<br \/>\nof compensation to the mother of the victim. This question can be<br \/>\nfinally decided only after the appeal is finally decided.\n<\/p>\n<p>4.\tThe<br \/>\nvehicle, if not handed over to the applicant,  would deteriorate<br \/>\nduring the pendency of appeal for no reason. Therefore, we are of the<br \/>\nview that since there is no allegation of misuse of the vehicle<br \/>\nduring the  trial when the vehicle in question was in the custody of<br \/>\napplicant, this application deserves to be allowed and the same is<br \/>\nallowed. The vehicle is ordered to be handed over to the applicant &#8211;<br \/>\nShantiben during the pendency of the appeal on the same terms and<br \/>\nconditions as were imposed by the Sessions Court while handing over<br \/>\nthe vehicle during the pendency of the trial. Rule is made absolute<br \/>\naccordingly.
