Justice M.C.HARI RANI\n\n Dated :23\/12\/2010\n\n O R D E R\n            K.M.JOSEPH &amp; M.C.HARI RANI, JJ.\n                     * * * * * * * * * * * * *\n                      W.P.C.No.37160 of 2010\n                    ----------------------------------------\n           Dated this the 23rd day of December 2010\n\n                             J U D G M E N T\n<\/pre>\n<p>K.M.JOSEPH,J<\/p>\n<p>     The petitioner has approached this Court seeking the<\/p>\n<p>following reliefs:\n<\/p>\n<blockquote><p>           i)    to issue a writ of mandamus or writ order<\/p>\n<p>           or direction compelling respondents 1 to 3 to<\/p>\n<p>           give   adequate         police       protection    for  the<\/p>\n<p>           petitioner and his men to carry on the work of<\/p>\n<p>           Dental Speciality Hospital in the present<\/p>\n<p>           premises.\n<\/p><\/blockquote>\n<blockquote><p>           ii)   To issue adequate police protection for the<\/p>\n<p>           ingress and aggress of the petitioner and his<\/p>\n<p>           men to the Poly            Dental Super Specialty at<\/p>\n<p>           Kottayam and for their life and property.<\/p>\n<\/blockquote>\n<blockquote><p>     2.   Briefly put, the case of the petitioner is as follows:<\/p><\/blockquote>\n<p>     3.   The petitioner is conducting a Dental Super Specialty<\/p>\n<p>center at Kottayam in the 4th respondent&#8217;s building from 1987.<\/p>\n<p>Most modern machineries, generators and other equipments<\/p>\n<p>were installed spending many lakhs of Rupees.                    There is a<\/p>\n<p>proposal to start a hospital by the 4th respondent; but that did not<\/p>\n<p><span class=\"hidden_text\">W.P.C.No.37160 of 2010           2<\/span><\/p>\n<p>succeed. Respondents 4 and 5 attempted to evict the petitioner<\/p>\n<p>by    using    goondas  and    criminals.   The   petitioner  filed<\/p>\n<p>O.S.No.308\/2008. The 4th respondent filed a statement that he<\/p>\n<p>has no intention to forcibly evict the petitioner. Thereafter, it is<\/p>\n<p>stated that, on the instigation of respondents 4 and 5, the 6th<\/p>\n<p>respondent, a known goonda, who was in detention under the<\/p>\n<p>Goonda Act, threatened the petitioner and attempted to take<\/p>\n<p>forcible steps with the help of the 7th respondent. There are<\/p>\n<p>further allegations and the petitioner, apprehending inaction,<\/p>\n<p>has come before us.\n<\/p>\n<p>      4.     We have heard the learned counsel for the petitioner,<\/p>\n<p>the learned counsel for respondents 4, 5 and 7. The learned<\/p>\n<p>counsel for respondents 4, 5 and 7 would submit that there is no<\/p>\n<p>such move to evict the petitioner by force and the 5th respondent<\/p>\n<p>was in fact out of station till 13\/12\/2010. Respondents 4 and 5<\/p>\n<p>have entered into a sale agreement and it is stated that there is<\/p>\n<p>no move to cause any forcible eviction of the petitioner.<\/p>\n<p>      5.     There is no dispute that the petitioner is a tenant.<\/p>\n<p>Therefore, the petitioner can be evicted only as per law.
