This petition under Section 482 of the Code of Criminal<br \/>\n  Procedure, 1973 (for short `the Code&#8217;), is for quashment of<br \/>\n  the  order  dated  15-7-2009 passed by the  2nd  Additional<br \/>\n  Sessions  Judge  (F.T.C.),  Janjgir  in  Criminal  Revision<br \/>\n  No.44\/2009, affirming the order dated 19-6-2009 passed by the<br \/>\n  Judicial  Magistrate First Class, Champa in  Criminal  Case<br \/>\n  No.1664\/2008, whereby learned Judicial Magistrate First Class<br \/>\n  has  dismissed  the  application filed  on  behalf  of  the<br \/>\n  petitioners for bail in terms of Section 437 (6) of the Code.\n<\/p>\n<p>2.    Order  is  challenged on the ground  that  without  any<br \/>\n  reasoned  order  both the Courts below have  dismissed  the<br \/>\n  application  for  release  of the petitioners  and  thereby<br \/>\n  committed illegality.\n<\/p>\n<p>3.    Brief  facts giving rise to this petition are that  the<br \/>\n  petitioners are facing trial for the offence punishable under<br \/>\n  Sections 420, 467, 468, 471, 120B read with Section 34 of the<br \/>\n  I.P.C. and Section 4 of the Examination Act.  The petitioners<br \/>\n  are in custody since 25-8-2008.  The case is triable by the<br \/>\n  Magistrate.  The Judicial Magistrate First Class, Champa has<br \/>\n  framed  charge  against the petitioners  of  the  aforesaid<br \/>\n  offences and fixed the case first time for evidence on 15-4-<br \/>\n  2009,  but even after completion of 60 days, trial has  not<br \/>\n  been  concluded  and  the application for  release  of  the<br \/>\n  petitioners  filed under Section 437 (6) of  the  Code  was<br \/>\n  dismissed  by  the Judicial Magistrate First Class  on  the<br \/>\n  ground that the prosecution has cited 64 witnesses, the Court<br \/>\n  is  not  the  regular Court and having its  Link  Court  at<br \/>\n  different  place,  and on the ground of heavy  pendency  of<br \/>\n  cases, the application for release of the petitioners on bail<br \/>\n  filed under Section 437 (6) of the Code was dismissed.  The<br \/>\n  petitioners have preferred a revision against the said order<br \/>\n  and the same was also dismissed by affirming the order of the<br \/>\n  trial Court, vide the order impugned.\n<\/p>\n<p>4.    I  have  heard learned counsel for the parties, perused<br \/>\n  the order impugned, order of the trial Court and copies  of<br \/>\n  order sheets of the trial Court.\n<\/p>\n<p>5.    Learned  Senior  Advocate appearing on  behalf  of  the<br \/>\n  petitioners vehemently argued that the Magistrate is  under<br \/>\n  obligation to decide the case within 60 days from the first<br \/>\n  date fixed for taking evidence and if the case triable by the<br \/>\n  Magistrate is not concluded within a period of sixty  days,<br \/>\n  the accused is entitled for bail in terms of Section 437 (6)<br \/>\n  of the Code, but the Court below has illegally dismissed the<br \/>\n  application  of  the petitioners.  Learned Senior  Advocate<br \/>\n  further submits that provision for bail under Section 437 (6)<br \/>\n  of the Code is mandatory in nature and the right accrued in<br \/>\n  favour  of the accused cannot be denied on trivial  ground.<br \/>\n  Learned Senior Advocate placed reliance in the matter of Smt.<br \/>\n  Godawari Bai &amp; Others v. State of C.G.1 in which this Court<br \/>\n  has  held that rejection of application filed under Section<br \/>\n  437  (6)  of the Code on the ground that the offence  under<br \/>\n  Section   467  of  the  I.P.C.  is  punishable  with   life<br \/>\n  imprisonment is not a ground for rejection.  Learned Senior<br \/>\n  Advocate further placed reliance in the matter of Haricharan<br \/>\n  Ramteke  v. State of Chhattisgarh2 in which this Court  has<br \/>\n  held that the application filed under Section 437 (6) of the<br \/>\n  Code  cannot  be  rejected mechanically  without  recording<br \/>\n  reasons.  Learned Senior Advocate also placed reliance in the<br \/>\n  matter of <a href=\"\/doc\/523051\/\">Damodar Singh Chauhan v. State of M.P.3<\/a> in  which<br \/>\n  the High Court of Madhya Pradesh has held that provision for<br \/>\n  bail under Section 437 (6) of the Code is mandatory in nature<br \/>\n  and  after lapse of 60 days from the first date of evidence<br \/>\n  the accused becomes entitled for bail.\n<\/p>\n<p>6.    On  the other hand, learned counsel appearing on behalf<br \/>\n  of the State\/ respondent opposed the petition and vehemently<br \/>\n  argued that the provisions of bail under Section 437 (6) of<br \/>\n  the  Code are mandatory in nature, but the Court has  ample<br \/>\n  power to dismiss the application by reasoned order.  Learned<br \/>\n  State counsel relied upon the order dated 11-8-2009 passed by<br \/>\n  a  coordinate  Bench  of this Court  in  <a href=\"\/doc\/880551\/\">Criminal  Revision<br \/>\n  No.338\/2009 (Atul Bagga v. State of Chhattisgarh)<\/a> in which it<br \/>\n  has been held that the provisions under Section 437 (6)  of<br \/>\n  the  Code are mandatory in nature and in appropriate cases,<br \/>\n  the application may be rejected by reasoned order.\n<\/p>\n<p>7.    In  the  present case, application for release  of  the<br \/>\n  petitioners was filed before the trial Court after completion<br \/>\n  of  60  days from the first date fixed for taking evidence,<br \/>\n  which  has been rejected vide order dated 19-6-2009 on  the<br \/>\n  ground that the Court is not the regular Court and having its<br \/>\n  Link  Court  at different place, prosecution has  cited  64<br \/>\n  witnesses, examination of all the witnesses within 60  days<br \/>\n  was not possible and considering heavy pendency of civil  &amp;<br \/>\n  criminal cases, disposal of the case within 60 days was not<br \/>\n  possible.  Order of the trial Court was challenged before the<br \/>\n  revisional Court and the revisional Court has also dismissed<br \/>\n  the revision on the ground that the trial Court has assigned<br \/>\n  reasons which are just &amp; proper and the Court below has not<br \/>\n  committed any illegality.\n<\/p>\n<p>8.    Provision  of  Section 437 (6) of  the  Code  reads  as<br \/>\n  follows: &#8211;\n<\/p>\n<blockquote><p>          &#8220;(6) If, in any case triable by a Magistrate,<br \/>\n          the  trial  of a person accused of  any  non-<br \/>\n          bailable  offence is not concluded  within  a<br \/>\n          period  of  sixty days from  the  first  date<br \/>\n          fixed  for taking evidence in the case,  such<br \/>\n          person shall, if he is in custody during  the<br \/>\n          whole of the said period, be released on bail<br \/>\n          to the satisfaction of the Magistrate, unless<br \/>\n          for  reasons  to be recorded in writing,  the<br \/>\n          Magistrate otherwise directs.&#8221;\n<\/p><\/blockquote>\n<p>9.    In the matter of Smt. Godawari (supra), the application<br \/>\n  for  grant  of bail under Section 437 (6) of the  Code  was<br \/>\n  rejected  by the Magistrate on the ground that one  of  the<br \/>\n  offences  punishable under Section 467  of  the  I.P.C.  is<br \/>\n  punishable with life imprisonment.  The reason assigned  by<br \/>\n  the  Magistrate was not found proper on the ground that the<br \/>\n  Magistrate is competent to infringe the sentence to maximum<br \/>\n  three  years and the accused persons were in custody  since<br \/>\n  last  one year.  In the matter of Haricharan (supra),  this<br \/>\n  Court has held that heavy pendency of cases is not a ground<br \/>\n  for denial of bail.  In the matter of Damodar (supra), it has<br \/>\n  been  held  by  the High Court of Madhya Pradesh  that  the<br \/>\n  accused  is  in  custody  for 23  months  for  the  offence<br \/>\n  punishable under Section 409 of the I.P.C. therefore, he is<br \/>\n  entitled for bail.\n<\/p>\n<p>10.   Dealing  with  the same question in  <a href=\"\/doc\/880551\/\">Criminal  Revision<br \/>\n  No.338\/2009 (Atul Bagga v. State of Chhattisgarh)<\/a> vide order<br \/>\n  dated 11-8-2009, a coordinate Bench of this Court has  held<br \/>\n  that  taking  into  consideration the gravity  of  offence,<br \/>\n  likelihood  of  tampering of evidence  and  dissuading  the<br \/>\n  evidence, rejection of the application was proper.\n<\/p>\n<p>11.   Provisions  under  Section 437  (6)  of  the  Code  are<br \/>\n  mandatory in nature and bail should not be denied  only  on<br \/>\n  trivial  ground, but the application for bail under Section<br \/>\n  437 (6) of the Code may be denied by reason to be recorded in<br \/>\n  writing.   The  ground for rejection of  application  is  a<br \/>\n  question  of  fact  and  differs from  case  to  case.   No<br \/>\n  straitjacket  formula would be possible  to  lay  down  the<br \/>\n  principles\/  guidelines  for  rejection  or  allowing   the<br \/>\n  application under Section 437 (6) of the Code, but the Courts<br \/>\n  are required to exercise the jurisdiction judicially and not<br \/>\n  in arbitrary manner.\n<\/p>\n<p>12.   In  the  present  case, the prosecution  has  cited  64<br \/>\n  witnesses and according to the order impugned, the Court is<br \/>\n  not  the  regular Court and it is having its Link Court  at<br \/>\n  difference place.  The trial Court has specifically mentioned<br \/>\n  in  its order that if the case would be taken on day to day<br \/>\n  basis,  even then completion of trial would not be possible<br \/>\n  within  the  stipulated time.  According to the  facts  and<br \/>\n  circumstances of the case, the matter relates to Pora Bai&#8217;s<br \/>\n  case, the mega scandal in education sector.  Reasons assigned<br \/>\n  by the trial Court are not arbitrary.  This is not the case<br \/>\n  in which the trial Court is reluctant to decide the case, but<br \/>\n  on factual matrix of the case, disposal within the stipulated<br \/>\n  time is not possible.  Reason assigned by the trial Court is<br \/>\n  just  and  proper.  The Court below has not  committed  any<br \/>\n  illegality by dismissing the application or revision filed on<br \/>\n  behalf of the petitioners.\n<\/p>\n<p>13.   Consequently, I do not find any ground for interference<br \/>\n  in  exercise  of inherent jurisdiction.  The  petition  is,<br \/>\n  therefore, liable to be dismissed and it is hereby dismissed.<br \/>\n  However, the trial Court is directed to expedite the  trial<br \/>\n  and  fix  the  case for evidence on day to day  basis  with<br \/>\n  interval of some weeks so that the case may be concluded as<br \/>\n  early as possible.\n<\/p>\n<p>                                                        JUDGE<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Chattisgarh High Court Gulab Singh Banjare vs State Of Chhattisgarh on 11 September, 2009 HIGH COURT OF CHATTISGARH AT BILASPUR Criminal Misc.
