PUBLIC PROSECUTOR for Respondent(s) : 1, \nMR VIJAY H PATEL\nfor Respondent(s) : 2, \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMS.JUSTICE H.N.DEVANI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 16\/03\/2010 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tThe<br \/>\nfacts of the case stated briefly are that a first information report<br \/>\ncame to be registered against the petitioner with the Mehsana<br \/>\nAnti-Corruption Bureau being Case No.5\/92 alleging commission of the<br \/>\noffence punishable under Sections 7, 13(1)(d) read with Section 13(2)<br \/>\nof the Prevention of Corruption Act, 1988 (the Act). Upon conclusion<br \/>\nof investigation, the Investigating Officer submitted B-Summary final<br \/>\nreport under Section 173 of the Code of Criminal Procedure, 1973 (the<br \/>\nCode). The learned Sessions Judge,Mehsana, vide order dated 25th<br \/>\nMay, 1995, turned down the request of the Investigating Officer for<br \/>\naccepting the B Summary report and took cognizance of the offence<br \/>\npunishable under Sections 7, 13(1)(d) read with Section 13(2) of the<br \/>\nAct and directed issuance of process against the petitioner herein.\n<\/p>\n<p>2.\tBy<br \/>\nthis petition under Articles 226 and 227 of the Constitution of<br \/>\nIndia, the petitioner has prayed to quash the order dated 25th<br \/>\nMay, 1995 passed by the learned Sessions Judge, Mehsana, taking<br \/>\ncognizance of the offence referred to hereinabove and directing<br \/>\nissuance of process; as well as the process issued pursuant thereto.\n<\/p>\n<p>3.\tHeard<br \/>\nMr. Nitin Amin, learned advocate for the petitioner, Mr. U. A.<br \/>\nTrivedi, learned Additional Public Prosecutor for respondent No.1 and<br \/>\nMr. Vijay Patel, learned advocate for respondent No.2   original<br \/>\ncomplainant.\n<\/p>\n<p>\t  Mr.\n<\/p>\n<p>\tNitin Amin, learned advocate for the petitioner, has submitted that<br \/>\n\tSection 19 of the Act mandates that no court shall take cognizance<br \/>\n\tof an offence punishable under Sections 7, 10, 11, 13 and 15 of the<br \/>\n\tAct, except with the previous sanction in case of a person who is<br \/>\n\temployed in connection with the affairs of a State and is not<br \/>\n\tremovable from his office save by or with the sanction of the  State<br \/>\n\tGovernment or the Central Government as the case may be, or the<br \/>\n\tauthority competent to remove him from his office. It is submitted<br \/>\n\tthat in the present case the Investigating Officer had submitted B<br \/>\n\tSummary final report and no sanction had been obtained from the<br \/>\n\tState Government to prosecute the petitioner as contemplated under<br \/>\n\tSection 19 of the Act. In the circumstances, in absence of necessary<br \/>\n\tsanction under Section 19 of the Act, it was not permissible for the<br \/>\n\tlearned Sessions Judge, Mahesana to take cognizance of the offence<br \/>\n\talleged. In support of his submissions, the learned advocate placed<br \/>\n\treliance was placed upon the decisions of the Apex Court in case of<br \/>\n\tAshok Mehta &amp; Anr. v. Ram Ashray Singh &amp; Ors., IV<br \/>\n\t(2006) CCR 24 (SC)<br \/>\n\tas well as in case of Ramanand Chaudhary v.<br \/>\n\tState of Bihar &amp; Others, (2002) 1 Supreme Court Cases 153,<br \/>\n\tMahendra Lal Das v. State of Bihar &amp; Ors., (2002) 1 Supreme<br \/>\n\tCourt Cases 149, <a href=\"\/doc\/555726\/\">Mansukhlal Vithaldas Chauhan v. State of Gujarat,<\/a><br \/>\n\t1998(1) G.L.H.248 as<br \/>\n\twell as unreported decision of this Court in <a href=\"\/doc\/877329\/\">Jayantibhai<br \/>\n\tBhulabhai Patel v. State of Gujarat &amp; Anothers<\/a><br \/>\n\trendered in Misc. Criminal Application No. 47 of<br \/>\n\t1993 on<br \/>\n\t8th<br \/>\n\tMarch, 1995.\n<\/p>\n<p>\t  On<br \/>\n\tthe other hand the learned advocates for the respondents have<br \/>\n\tsupported the impugned order made by the learned Sessions Judge.\n<\/p>\n<p>\t From<br \/>\n\tthe facts noted hereinabove, it is apparent that pursuant to the<br \/>\n\tfirst information report in question, the Investigating Officer, on<br \/>\n\tconclusion of investigation, had submitted his final report under<br \/>\n\tSection 173 of the Code and had prayed for B Summary. Prior to<br \/>\n\tsubmitting the final report, sanction<br \/>\n\tto prosecute the petitioner under Section 19 of the Act had not been<br \/>\n\tobtained, and as such the report was not supported by a sanction<br \/>\n\torder under section 19 of the Act. The learned Sessions Judge, vide<br \/>\n\timpugned order dated 25th<br \/>\n\tMay, 1995, had rejected the request for accepting the B Summary<br \/>\n\treport and had proceeded further to take cognizance of the offence<br \/>\n\tpunishable under Section 7, 13(1)(d) read with Section 13(2) of the<br \/>\n\tAct and had directed issuance of process.\n<\/p>\n<p>7.\tSection<br \/>\n19 (1) of the Act, insofar as the same is relevant for the purpose of<br \/>\npresent case, reads thus:\n<\/p>\n<p>\t 19.<br \/>\nPrevious sanction necessary for prosecution.-<br \/>\n(1) No Court shall take cognizance of an offence punishable under<br \/>\nSections 7, 10, 11, 13 and 15 alleged to have been committed by a<br \/>\npublic servant, except with the previous sanction.-\n<\/p>\n<p>(a)\tin<br \/>\nthe case of a person who is employed in connection with the affairs<br \/>\nof the Union and is not removable from his office save by or with the<br \/>\nsanction of the Central Government, of that Government;\n<\/p>\n<p>(b)\tin<br \/>\nthe case of a person who is employed in connection with the affairs<br \/>\nof a State and is not removable from his office save by or with the<br \/>\nsanction of the State Government, of that Government;\n<\/p>\n<p>(c)\tin<br \/>\nthe case of any other person, of the authority competent to remove<br \/>\nhim from his office.\n<\/p>\n<p>8.\tFrom<br \/>\nthe language employed in the section, which is couched in the<br \/>\nnegative, it is apparent that there is an express bar against any<br \/>\nCourt taking cognizance of an offence punishable<br \/>\nunder sections  7, 10, 11, 13 and 15 of the Act alleged to have been<br \/>\ncommitted by a public servant except with the previous sanction of<br \/>\nthe concerned Government or the competent authority. In the facts of<br \/>\nthe present case, it is an admitted position that no sanction as<br \/>\nenvisaged under Section 19 of the Act has been obtained. In the<br \/>\ncircumstances, it was not permissible for the learned Sessions Judge<br \/>\nto take cognizance of the offence under section 7, 13(1)(d) read with<br \/>\nsection 13(2) of the Act against the petitioner without prior<br \/>\nsanction of the concerned authority. Cognizance without prior<br \/>\nsanction being expressly barred under Section 19 of the Act, the<br \/>\nimpugned order dated 25th<br \/>\nMay, 1995 made by the learned Sessions Judge, Mahesana cannot be<br \/>\nsustained.\n<\/p>\n<p>9.\tIn<br \/>\nview of the above discussion, the petition succeeds and is<br \/>\naccordingly allowed. The impugned order dated 25th<br \/>\nMay, 1995 passed by the learned Sessions Judge, Mahesana below Exh.1<br \/>\nin Special (ACB) Case No. 9 of 1995 as well as the process issued<br \/>\npursuant thereto are hereby quashed.
