Kodekar, learned APP waives service of Rule on behalf of the<br \/>\nopponent State.\n<\/p>\n<p>\tThis<br \/>\nis an application for temporary bail on the ground of sickness of<br \/>\nmother of the accused in connection with the offence registered with<br \/>\nUdhna police station, Surat vide CR No. I 306 of 2008.\n<\/p>\n<p>\tIt<br \/>\nis submitted that the mother of the accused aged about 85 years is<br \/>\nsuffering from certain ailments and she has been advised to be<br \/>\nadmitted in hospital for treatment. The accused is hailing from very<br \/>\npoor strata of  society and needs to arrange for  funds to get his<br \/>\nmother treated.\n<\/p>\n<p>\tPapers<br \/>\nas regards ailment of the mother are on record. It also appears that<br \/>\nearlier, accused was enlarged on temporary bail on two occasions on<br \/>\nthe ground of his mother&#8217;s ailment and has surrendered in time.\n<\/p>\n<p>\tHaving<br \/>\nregard to the facts and circumstances of the case, the accused is<br \/>\nordered to be released on temporary bail for a period of two weeks<br \/>\nfrom the date of his release on his executing a bond of Rs.15,000\/-<br \/>\n[Rupees Fifteen Thousand only] before the jail authority. The<br \/>\napplicant was not living where  his mother is residing and therefore,<br \/>\nhe shall mark his presence at Patan Town Police Station on every<br \/>\nalternate day. He shall not leave the city of Patan during the period<br \/>\nof his temporary bail and shall surrender before the jail authority<br \/>\nin time on expiry of period of temporary bail.\n<\/p>\n<p>\tThe<br \/>\napplication is partly allowed.
