Heard the\n\nlearned Coiireisel Snit.O&#039;~!_&lt;Oalp&#039;OOana for appellant and the learned\n\n&quot;OV&#039;~...c0u&#039;ns&#039;eI:,.\\~-t.Mi=,A.Aru&#039;n&quot;&quot;*P0nnappa, for respondent -- insurance\n\n ;ft..is&quot;:admitted and taken up for final disposal by\n\nCon_sVent._ Of&quot;  \n\nO &quot;  3,&quot; The Contextual facts are:\n\nThe appellant lodged claim before the MACT seeking\n\ncompensation from the respondents regarding death of\n\nat\u00bb\n\n\n\nKarthik, a youngster aged 27 years, in a motor vehicle\naccident involving motor cycle bearing registration No. KA-\n\n02 EG--4-4 and bus bearing registration No. KA--O5 B--12.&#039;71. on\n\nMagad\u00e9 -- Bangalore Road, near l-luliyarammaf_;Vte_rnjp,l:\u00e9,y\n\nMachohalli gate. They alleged negligence \n\nthe passenger bus and thus held \n\nculpable and actionable negligence. T&#039;\n\n4. The claim ,--was  ..the:...reSEDondents,\nwhich lead to framing of&#039;relevantVg)oi:nVtsf&#039;lfo&#039;rconsideration by\nthe Tribunal.  claimant No.1\ntendered   documents while\n\nrespondents &#039;but. relied on Policy at Ex.R1.\n\n material proposition in the\n\npleadings of.tne_pa&#039;rt\u00e9e&#039;s and evidence on record, the Tribunal\n\n:hel_cl&#039; iall&#039;\u00b0poi_nts_ in affirmative and in favour of claimants and\n\nAl&quot;&#039;aVll&#039;o&#039;wed-:Vth.e_  granting to them in all Rs.5,34,000\/-- as\n\ncorf:--pen,_satilo&#039;&quot;n as against their cla\u00e9m of Rs.20 lakhs. Being\n\n .V_\ufb02dissatis&#039;f--ied with it they are in this appeal.\n\n6. The learned counsel Smt. Kalpana, for the\n\nappellants would contend that death of Karthik in motor\n\nNV\n\n\n\nvehicle accident on 1203-2006 is result of negligent driving\nby the driver of the bus having been accepted by the\n\nTribunai, the Tribunal had sadclied them with  of\n\ndischarging this award. She wouid submit  \n\nrecord establishes that Karthik, victim of  was.\n\npermanently employed in Toyota \n\nPrivate Limited, incorporated&#039;u_nder&quot;&#039;C&#039;.ompani&#039;esVV.Act, \n\ngross salary of Rs.11,000\/~.  &#039;ba_chelo.r&#039;i.and was\ncontributing entire  &quot;xfor their\nmaintenance. The appeiyla.nts.whVo on him are\nnow renderediv Zijconsetiuence of ioss of\n\ndependency. \n\n &#039;   to the fact that the salary\n\nshown in u&#039;E&#039;xV.%P7 at.&#039; of Rs.10,497\/- but has been\n\n ._unji.;s&#039;3tifiafbiyV%_ redu&quot;ced_...by the Tribunal deducting the amount,\n\nwhich.are&quot;nvotjdeductibie. She would further contend that\n\nTrihpunai haistaairen incotne of the deceased at Rs.6,466\/~, as\n\n&#039;cagainst;x&#039;i?~s.10,497\/- and again subjected it to 50%\n\n&#039;*ilfdedu&#039;ctions, consequent to this erroneous grant of\n\n Rs;.S,34,000\/-- is awarded as against the amount of Rs.12\n\n lakhs, to which they are entitled.\n\nW\n\n\n\n8. The learned counsel Mr. Arun Ponnappa, for\nrespondent -- insurance company would not dispute the\n\nposition of law relating to fixing the loss of de;:iende.n&#039;cy.\n\nReference could be made to the decision of  \n\nin case of SARLA \\\/ERMA &amp; Al\\ioifi~ieP,,,DE,4LFli&#039;,&quot;*rt&lt;;x&#039;l$is0F{oi:iTitit\n\nCORPORATION reported in 2009 (:6) \n\nApex Court has clarified and Vennphatically iieAlld.:th~at&quot;&quot;it&#039; is noti\n\nonly the salary which tvh-exgdecea&#039;se.d_:*w&#039;a-s_ dravving at the time\nof death, but other perks&#039;  progression\nin carrier, Dro_S.D.ect5_ of  be sounded in\nterms of    laid down certain\ncriteria,... if&quot;-the; deceased was less than\n40  to be added to his income\n\nand the resu--|tanti&#039;igu0re&quot;wiiuld be salary for ali purposes, like\n\n-&#039;W,.,dett3,r&#039;}\u00abnin_,ation of&quot;los.s...of dependency, etc., In other words,\n\n hel&#039;d.,:that::if--\u00abthe victim is less than 40 years 50% of his\n\nincome be added to the proved income and then it\n\n7,_should.  subjected to 1\/3&quot;&#039; or 50% deductions depending\n\n&#039;\ufb01\u00b0upoln&quot;~\u00abwhether deceased was married or bachelor. Even in\n\n0  case of bachelor the deduction of 50% is again amenable to\n\n fact situation. If dependants are more then the deductions\n\n\n\nwould be 1\/3&quot;&#039; or even 1\/4&quot;&#039;. The learned Member of the\nTribunal has not applied the said dictum to the instant case.\nBesides, the fact that only net income has been taken is\n\nimproper.\n\n9. In the instant case, the income_...._s&#039;l&#039;low-n;is\n\nRs.10,-497\/--. Professional tax was Rs.150\/-fwti2.a.t&#039;could \n\nthe only deduction. Consequently,&#039;&quot;the&#039;.,_in-come.xoVf&#039;:V&quot;the\n\ndeceased would be taken as, _Rs.1lCi,4?i--7\/- an.t.\u00a7.&#039;A&#039;5&#039;0&quot;3\/dy\n\nshould be added which ultimateiiy gives usVl1R\u00a7;s_1s&#039;;l347\/--. it\n\nBut, keeping in mindbthe jotlherl:_ci&#039;.r&#039;c.umstaVnces as the\ndeceased was employed  t$,riyate~\u00ab..ll&#039;is;rj3.\u00bbl}_though he had\n\nsteady .i&#039;_i&#039;1&quot;I&#039;Cf&#039; ..re&#039;gular;.;income, \ufb01it&quot;&quot;vwo&#039;uld be safe to take his\n\nincome   he was a bachelor and as\n\ndependentsdarevvonlly p&#039;arents the deductions should be 50%.\n\n  bfasi_s the&quot;&quot;iovs.s.:..\u00abof dependency has to be calculated.\n\nV.&quot;-.yTiui&#039;s,~.the&#039;mVui.!t:i&#039;p--l_icand would be Rs.7,500\/-- per month and\n\nandnulalllyv\u00e9ltlhfxitiuld be Rs.90,000\/-. To this multiplicand\n\niv.rnultipli.er&#039;applicable would be 13 depending upon the age of\n\nA &#039;~:ltbe-&#039;lrnother at 46 years as she is young among parents.\n\n ioss of dependency would be Rs.11,70,000\/- as\n\n against Rs.5,04,000\/-- determined by the Tribunal.\n\nC\u00a7&amp;Q7\/\n\n\n\n10. The learned counsel Mr. Arun Ponnappa, for\nrespondent -- insurance company would contend that the\n\naddition of 50% to the income should be in the cas&#039;e:fw.h&#039;e,re\n\nthe deceased was either in Government emplo\\,.{&#039;n&#039;1ent:&quot;or&#039;such \n\ninstitutions where job is guaranteed: He 0&#039;\n\nin the instant case, the victim was inall private: eym&#039;pfi&#039;o_yee\n\nand there is no security toVlt~h_evjpob.A&quot;He fu_rt&#039;he&#039;r._:sutaanitted&#039;~00\n\nthat to the income of thedece.a*sedg_r-the-.incornetaxjshould be\n\ndeducted.\n\n11. I_V&#039;_gi\\_\/en  se.rio*u&#039;s----\u00abconcern to the said\ncontentionr i3&#039;u&#039;t_&#039;it_is&#039;Vseeflhthat&quot;basisVito add 50% or 30% of\nthe income_AiAs&#039;l~ltowVa&#039;rds\u00abcareer progression and better future\n\nearning ofthe yic_ti&#039;rr.is~, &#039;_w-hlohad regular income. It does not\n\nindicate the person&quot; who  employed in permanent cadre like\n\nV:&#039;Goy&#039;ern:ii*ien%t&#039;~service or other undertakings alone in entitled\n\nA&quot;&quot;:o*!sucht&#039;fi3e&#039;nefit\u00a7&quot; This would also include persons who had\n\nsec&#039;L-_rity&quot;ofyt&#039;he job like the victim in this case. Regarding\n\n&#039;&quot;4&quot;---:\u00bb&quot;incom.e&#039;V----tax, it is seen that the basic salary was only\n\nt._\u00e9&quot;-Rs;-Z0560\/~ and total emoluments was Rs.10,497\/~ per\n\n  .tv.rnonth. The accident is in the year 2005. We take judicial\n\nnotice that there was income tax exemption up to\n\n(}\u00a7;v\/\n\n\n\nRs.1,00,000\/--. In the circumstance, no deduction of income\n\ntax at the source was applicable.\n\n12. Under conventional heads the Trib_unVai:_&quot;i.has\n\nawarded a sum of Rs.30,000\/-- towards loss \n\ntransportation of dead body and towards fi-i&#039;ia\u00bb:...:l&#039;b&#039;f4e&#039;;f: In a_ll&#039;,&#039;~ \n\nthe claimants wouid be entitled to agaiinst\n\nRs.5,34,000\/-. The enhanced&#039;cc\u00abnjpens-ation si1va&#039;%iii..;caVrVry\n\nrate of interest at 6% Per annu_rh.i:_T--h_ve co&#039;m.p_ensat}ion along\nwith accrued interest shall  ap&#039;p&#039;o&#039;rti&#039;on:ed_ equally between\nthe parents and kept inpdepojsitiinaariy&#039;v_i\\latio&quot;nalised Bank for\n\na period of.fi\\}.e witih._:VVpe_rrrifis&#039;sio::\u20ac&quot;&#039;to the claimants to\n\ndraw the interest. cAa&#039;ccru&#039;:\u00e9:.d-thereon.&#039;&quot;lnszurance company is\n\ndirected to d\u00e9-po&#039;si_t the within four weeks.
