leThe petitioners instituted the suit bearing<\/p>\n

a hand lthe purchaser of the property of the 1″<\/p>\n
wdefendant who is arrayed as the 2″” defendant in the<\/p>\n
” suit. The copy of the plaint is produced at<\/p>\n
uhnnexure–“C’. The suit property is the land bearing<\/p>\n
Sy. No.1\/10A, B-P1 dry land measuring 7 guntas<\/p>\n

assessed at 0.77 ps. with the boundaries mentioned<\/p>\n
therein. A sketch is also been produced_’.,a_;n.dl~.._it<\/p>\n
reveals that the property held by Dodda<\/p>\n
the propositus was partitioned in 3 then.<\/p>\n
eastwwest direction and the 15*”; reg o.ndent’*was’~., ixren<\/p>\n
the strip on the southernps’side,AH_and pifoposjitusl\ufb02<\/p>\n
was granted the share on  northern-V5si’d,e. The
\ndivision amongst thep_artie’s”waspvdtowardvsi Veast–west<\/p>\n
direction .\n<\/p>\n
It is  thiatithe]l%\u00a7:’V.’r’e’spondent has sold
\nthe proper1::y_   whereas in the
\nSale    the property fallen
\nto his    direction. Under<\/p>\n
these Vc_ircuzh’stances,”v. when there was an obstruction<\/p>\n
“by  :p_2f’\u00b0defen’da1’ItV, the plaintiffs instituted a<\/p>\n
‘\ufb01fo-r”.V4dec’;Laration and permanent in\ufb01unction<\/p>\n
against thelrijdelfendants. The defendants appeared and<\/p>\n
‘filedlthxeirv written statement and after framing the<\/p>\n
issue-3’, the evidence was recorded and during the<\/p>\n
-_lpeur:dency of the suit, an application came to be<\/p>\n
‘mlfiled requesting for appointment of e Surveyor to<\/p>\n
Jmeasure the suit schedule property and fix the<\/p>\n
boundaries and to submit a report. The said<\/p>\n

application was opposed by the defendants alleging
\nthat there was no dispute with regard atopfthe<\/p>\n

property and therefore, they claim that there is no .*<\/p>\n

\nevidence is sufficient to, adjudicate that disputet7
\nIn the circumstances, they sought for rejection of
\nthe application. . l a i<\/p>\n
The trial Court after hear$\ufb01\u00a7\u00a2gQ\u00a7\ufb01 the learned
\ncounsel rejected the request for appointment of the
\nSurveycr and ;\u00a7g\u00a7\u00a7iev\u00a7a3 hy- the ‘same, the Present<\/p>\n
petition has ‘ Leap’  _\n<\/p>\n

_ petitioners. x gjhe vlearned counsel for the 2″”<\/p>\n
uV,respondent is absent. Respondent No.1 though served<\/p>\n

4.” As could be seen from the grievance of the<\/p>\n
dlpetitipners, it is their apprehension that when<\/p>\n
,thare” was a registered Partition Deed between<\/p>\n
~ themselves, the la’ defendant and. their father, 3<\/p>\n
Jstrips were made dividing the property owned by them<\/p>\n
in the eastwwest direction and the propertx\u00e9<\/p>\n

\nthere is no question    selling the
\nproperty in even if it has
\nbeen done,::. b_in.dimtheeWeinterest of the
\nPlainti.\u00a3’f’s’ that under the
\nregistered 4′ referred to supra there<\/p>\n
was a partitipone   east-west direction. So,<\/p>\n
 wheng the piaintiffs claim that they are in<\/p>\n
pAossess_ion,’eo–:E the middle strip running east-west<\/p>\n
 sg\u00a7_..~’?er the? registered Partition Deed,<\/p>\n
he _ they’-.ca.j_n’ establish the same on the basis of the<\/p>\n
 document.-“i.e., registered Deed of Partition and in<\/p>\n
 _ case if there is any obstruction in their possession<\/p>\n
 ,V can seek injunction also. when there is no<\/p>\n
Udispute with regard to the boundaries between the<\/p>\n
parties, the question of demarcation of the<\/p>\n
boundaries does not arise for consideration. It is<\/p>\n

\nthe petitioners was rejected and I do not \ufb01ia\u00e9 any<\/p>\n
