In the facts and circumstances of the case, this<br \/>\nmatter is taken up for hearing today.\n<\/p>\n<p>2.\tMr<br \/>\nKT Dave, learned Additional Public Prosecutor representing the State<br \/>\nhas preferred the present application against the judgment and order<br \/>\npassed by the learned Additional Sessions Judge, Palanpur in Criminal<br \/>\nMisc. Application No.147 of 2008 in Sessions Case No.3 of 2008 dated<br \/>\n31.05.2008 by which the learned Judge granted the application of bail<br \/>\npreferred by the respondent (original accused No.3).  The learned<br \/>\nAdditional Public Prosecutor submitted that the learned Judge has<br \/>\nerred in granting temporary bail to the respondent after consistently<br \/>\nrejecting the bail application preferred by him mainly on the ground<br \/>\nthat he was charged for the very serious offence and he might not be<br \/>\navailable at the time of trial, if released on bail.  The learned<br \/>\nAdditional Public Prosecutor submitted that the learned  Judge  has<br \/>\nnot  appreciated  in  proper  perspective  the fact that even if the<br \/>\nescort is given to the respondent to visit Mumbai, the police escort<br \/>\nwould not be able to handle the accused person since the local police<br \/>\nwould not be aware of the geographical areas of Mumbai and accused<br \/>\ncan flee from the custody of police.  The learned Additional Public<br \/>\nProsecutor has also placed reliance on the detailed report submitted<br \/>\nby the Police Inspector, LCB, Palanpur dated 21.07.2008, wherein it<br \/>\nhas been clearly stated that mother of the respondent has been taking<br \/>\ntreatment of Dr. Salim Fakirbhai Saudagar.  The statement of Dr.<br \/>\nSalim Fakirbhai Saudagar was also taken by the concerned police<br \/>\nofficer on 12.07.2008.  ECG was also performed on the mother of the<br \/>\nrespondent and it was reported that she was not required to undergo<br \/>\nany operation.\n<\/p>\n<p>3.\tIn<br \/>\nview of the statement given by the Doctor that mother of the<br \/>\nrespondent is not required to undergo any operation, the temporary<br \/>\nbail which was given by the learned Additional Sessions Judge<br \/>\nrequires to be set aside.  The party? in? person who was present<br \/>\nbefore the Court was heard at length and in great detail and he could<br \/>\nnot say anything about the aforesaid report given by the Police<br \/>\nInspector, LCB, Palanpur addressed to Mr KT Dave, learned Additional<br \/>\nPublic Prosecutor of the State.\n<\/p>\n<p>4.\tConsidering<br \/>\nthe submissions canvassed by the learned Additional Public Prosecutor<br \/>\nas well as party? in? person and the report dated 21.07.2008 filed<br \/>\nby the Police Inspector, LCB, Palanpur, no case is made out by the<br \/>\nrespondent and the temporary bail which was granted by the learned<br \/>\nAdditional Sessions Judge, Palanpur in Criminal Misc. Application<br \/>\nNo.147 of 2008 in Sessions Case No. 3 of 2008 dated 31.05.2008 is<br \/>\nhereby quashed and set aside.\n<\/p>\n<p>5.\tFor<br \/>\nthe foregoing reasons, the application preferred by the State is<br \/>\nallowed and the prayer as set out in para-7(B) to cancel the bail<br \/>\ngranted to the respondent vide order dated 31.05.2008 in Criminal<br \/>\nMisc.
