Mr.Isaac Manuel                      \t\n\t\t    Additional Public Prosecutor\n\n:ORDER\n<\/pre>\n<p>(Order of the Court was made by P.MURGESEN, J)<\/p>\n<p>\tChallenging the order of detention, the wife of the detenu has filed the<br \/>\npetition.  The detenu was detained by the second respondent Commissioner of<br \/>\nPolice by his detention order in 10\/BDFGISSV\/2009 dated 31.03.2009, under the<br \/>\nprovisions of the Tamil Nadu Prevention of Dangerous Activities of Boot-Leggers,<br \/>\nDrug Offenders, Forest Offenders, Goondas, Immoral Traffic Offenders, Sand<br \/>\nOffenders, Slum-grabbers and Video Pirates Act, 1982 (Tamil Nadu Act 14 of 1982)<br \/>\nterming him as a &#8220;Goonda&#8221;.\n<\/p>\n<p>\t2. The detenu was involved in three adverse cases, which are as follows:-<br \/>\nSl\tName of the Police station and Crime No.\tSection of law<br \/>\nNo.\n<\/p>\n<p>1\tThatchanallur P.S., \t\t\t\t302, 120(b) read with 34<br \/>\n\tCrime No.1322\/2006\t\t\t\tIndian Penal Code.<\/p>\n<pre>\n\n2\tTirunelveli Town P.S., \t\t\t\t294(b) and 323 Indian\n\tCrime No.962\/2008\t\t\t\tpenal Code.\n\n3\tTirunelveli Town P.S., \t\t\t\t341, 294(b), 506(ii) Indian\n\tCrime No.134\/2009\t\t\t\tPenal Code.\n\n<\/pre>\n<p>Apart from that, the detenu was involved in one ground case in Crime No.171\/2009<br \/>\nunder Section 341, 294(b), 307 and 506(ii) for the incident that took place on<br \/>\n14.03.2009.\n<\/p>\n<p>\t3. The only ground urged by the learned counsel for the petitioner to<br \/>\nvitiate the detention order is that there is delay in considering the<br \/>\nrepresentation.\n<\/p>\n<p>\t4. In the proforma filed by learned Additional Public Prosecutor, it is<br \/>\nstated as follows:\n<\/p>\n<pre>1. Category\t\t\t  : Goonda\n2. District\/City\t\t  : Tirunelveli City\n<\/p>\n<p>5.Representation dated\t  : 12.04.2009\n<\/p>\n<p>6.Representation received on\t  : 15.04.2009\n<\/p>\n<p>7.Remarks called for on \t  : 16.04.2009\n<\/p>\n<p>8.Reminder dated\t\t  :     &#8212;<\/p>\n<pre>\n9.Remarks received on\t\t  : 23.04.2009\n10.File Submitted on\t\t  : 24.04.2009\t\n<\/pre>\n<p>11.Under Secretary dealt with on: 27.04.2009\n<\/p>\n<p>12.Addl. Secretary dealt with on: 27.04.2009\n<\/p>\n<p>13.Minister for Law dealt with on:28.04.2009\n<\/p>\n<p>14.Rejection Letter prepared on: 30.04.2009\n<\/p>\n<p>15.Rejection letter sent to the<br \/>\n\t\tdetenu\t\t  : 04.05.2009\n<\/p>\n<p>18.Rejection letter served to the<br \/>\n  \t\tdetenu\ton       : 05.05.2009<\/p>\n<p>It is seen that the representation was received on 14.04.2009 and the remarks<br \/>\nwere called for on 16.04.2009, but the remarks were received only 23.04.2009.<br \/>\nFurther, the Minister for Law dealt with the representation on 28.04.2009 and<br \/>\nthe rejection letter was prepared on 30.04.2009.  But the rejection letter was<br \/>\nsent to the detenu only on 04.05.2009.  Even though 01.05.2009 is a holiday,<br \/>\nthere is an unexplained delay of two days in sending the rejection letter. It<br \/>\nvitiates the order of detention.  Hence, the order of detention is liable to be<br \/>\nset aside.\n<\/p>\n<p>\t5.Accordingly, this Habeas Corpus Petition is allowed and the order of<br \/>\ndetention in No.10\/BDFGISSV\/2009 dated 31.03.2009, passed by the second<br \/>\nrespondent is quashed.
