             (Passed on 15th  day of May, 2007)<\/p>\n
  1.   By  this petition, the petitioner seeks a relief that
\n        the petitioner be granted pension after his taking services
\n        as daily wager into account for calculating the minimum
\n        qualifying 10 years in service to entitle the petitioner for
\n        grant of pension and gratuity also.\n<\/p>\n
2.   The indisputable facts, in nutshell, are that the
\npetitioner was engaged in the service as daily wager from
\n24.9.1974. The petitioner was regularised w.e.f 24.12.1986.
\nThereafter, vide order dated 27.10.1990 (Annexure P\/1), the
\npetitioner was appointed as work charged driver temporarily
\non time scale of pay of Rs. 1090-1950. The petitioner
\nretired from service w.e.f 25.03.1995 on attaining the age
\nof superannuation. The petitioner was communicated letter
\ndated 29.11.1995 (Annexure P\/3) that the petitioner was not
\nentitled to grant of pension as the petitioner has not
\ncompleted the minimum required 10 years for entitlement of
\npension.\n<\/p>\n
3.   Shri H.B.Agrawal, learned senior counsel appearing with
\nShri Pankaj Agrawal, would submit that the petitioner was
\nengaged as daily wager w.e.f 24.09.1974. Admittedly,
\nthereafter, the services of the petitioner was regularised
\nw.e.f. 24.12.1986. Learned counsel further relied on an
\norder dated 17.12.1984 passed by the Labour Court, wherein
\nthe Labour Court directed to reinstate  the applicant with
\ncontinuity of service on his former post. Thus, the
\npetitioner is entitled to pension on counting his service as
\ndaily wager for the purpose of pension.\n<\/p>\n
4.   Per contra, Shri Koshy, learned counsel appearing for
\nthe respondents would submit that the respondent Board has
\nadopted M.P.\/C.G. Civil Services (Pension) Rules, 1976
\n(hereinafter referred to as “the Rules, 1976”). As per the
\nrule, the period spent by the petitioner as daily wager
\ncannot be counted for his entitlement to pensionery
\nbenefits. The petitioner was regularised as Work Charged
\ncleaner w.e.f 24.12.1986 and the petitioner retired on
\n25.03.1995. Thus the petitioner has not completed the
\nminimum 10 years qualifying service as entitlement to
\npension.\n<\/p>\n
5.   I have heard the learned counsel appearing for the
\nparties, perused the pleadings and documents appended
\nthereto. It is evident that the petitioner was not born in
\nservice till 24.12.1986 when he was regularised. Engagement
\nof the petitioner on daily wages cannot be counted as
\nservice in the department. It is well settled principle of
\nlaw that any appointment dehors the constitutional scheme of
\nthe employment and not in consonance with the provisions of
\nlaw on daily wages, contract or temporary, is not legal and
\nthe employee does not acquire any right to continue in
\nservice and other benefits of the regular service.\n<\/p>\n
6.   With regard to the contention of the learned counsel
\nappearing for the petitioner that the Labour Court, vide
\norder dated 17.12.1984 directed the reinstatement of the
\npetitioner with continuity of service on the former post. It
\nis clear that the Labour Court has directed to reinstate the
\nservices of the petitioner on daily wages on his former post
\nand the said service cannot be counted as regular service.\n<\/p>\n
7.   Sub Rule (2) of Rule 12:- Commencement of qualifying
\nservice, read with Sub Rule (2) of Rule 43:- Amount of
\nPension, of the M.P. Civil Services  (Pension) Rules, 1976,
\nreads as under:\n<\/p>\n
        \"Rule    12    (1)        xxx             xxx\n        xxx                    xxx\n                (2)  Subject  to  the  provisions  of\n<\/pre>\n
                these rules, qualifying service of  a
\n                Government  servant  shall   commence
\n                from the date he takes charge of  the
\n                post  to  which he is first appointed
\n                either   substantively   or   in   an
\n                officiating or temporary capacity.”\n<\/p>\n
          Rule    43    (1)       xxx             xxx\n          xxx                    xxx\n                  (2)  In  the  case of a  Government\n<\/pre>\n
                servant  retiring in accordance  with
\n                the  provisions of these rules  after
\n                completing qualifying service of  not
\n                less  than  10 years, the  amount  of
\n                pension  shall be appropriate  amount
\n                as set out below, namely:-…”\n<\/p>\n
  8.   On perusal of the relevant provisions of Pension Rules,
\n        1976, the qualifying service for grant of pension and other
\n        retiral benefits is 10 years. Admittedly, the petitioner was
\n        regularised on his service w.e.f 24.12.1986 and  the
\n        petitioner retired on 25.3.1995. The petitioner is thus not
\n        entitled to pension under the provisions of Pension Rules,
\n        1976.\n<\/p>\n
9.   The petitioner has approached this Court not
\nimmediately after retirement from service i.e. 25.03.1995.
\nThe petitioner has slept over his right and approached this
\nCourt after a period of about 10 years with unexplained,
\ninordinate delay.\n<\/p>\n
10.  The Supreme Court, in Burn Standard Co. Ltd. & Others
\nVs. Dinabandhu Majumdar & another1 observed as under:\n<\/p>\n
                “The  very conduct of non-raising  of
\n                an  objection  in the matter  by  the
\n                employee,  in  our  view,  should  be
\n                sufficient reason for the High Court,
\n                not to entertain such applications on
\n                grounds of acquiescence, undue  delay
\n                and laches.”\n<\/p><\/blockquote>\n
  11.  The Supreme Court, in Karnataka Power Corporation Ltd.\n<\/p>\n
        through its Chairman & Managing Director & another Vs.
\n        K.Thangappan & another2 observed as under:\n<\/p>\n
               “Delay or laches is one of the factors
\n               which  is to be borne in mind  by  the
\n               High  Court  when they exercise  their
\n               discretionary powers under Article 226
\n               of the Constitution. In an appropriate
\n               case  the  High  Court may  refuse  to
\n               invoke  its  extraordinary  powers  if
\n               there  is  such negligence or omission
\n               on the part of the applicant to assert
\n               his right as taken in conjunction with
\n               the    lapse   of   time   and   other
\n               circumstances, cause prejudice to  the
\n               opposite party. Even where fundamental
\n               right  is involved the matter is still
\n               within the discretion of the Court  as
\n               pointed  out  in  the Durg  Prasad  V.
\n               Chief   Controller  of   Imports   and
\n               exports. Of course, the discretion has
\n               to   be   exercised   judicially   and
\n               reasonably.”\n<\/p><\/blockquote>\n
  12.  The High Court, in exercise of its discretion, does not
\n        ordinarily assist the tardy and the indolent and the
\n        acquiescent and the lethargic as the belated approach may
\n        certainly breach the rights of others.\n<\/p>\n
13.  Looking from all angles, this petition has no merit and
\nis accordingly dismissed.\n<\/p>\n
