DAVE\n\t\t\n\t\n\n \n\nDate :\n03\/08\/2011 ORAL ORDER<\/pre>\n<p>\tThis<br \/>\napplication is filed under Section 439 of the Code of Criminal<br \/>\nProcedure in connection with first information report registered at<br \/>\nC.R.No.I-165 of 2010 with Morbi City police station for the offences<br \/>\npunishable under Sections 147, 148, 149, 302, 504, and 323  of the<br \/>\nIndian Penal Code and Section 135 of the Bombay Police Act.\n<\/p>\n<p>\tLearned<br \/>\ncounsel for the applicants submits that the applicants are original<br \/>\naccused No.3 and 2 and the allegations are of inflicting bat and<br \/>\nstick blows on the deceased in a scuffle admittedly took place later<br \/>\nin point of time when applicant No.2 was seriously injured by a knife<br \/>\nblow inflicted by one Jayesh as per the cross complaint being C.R.<br \/>\nNo.166 of 2010 filed by the applicant No.2 herein. Investigation is<br \/>\nover and charge sheet is filed. He, therefore, submits that this<br \/>\napplication for bail may kindly be considered.\n<\/p>\n<p>\tThe<br \/>\nlearned Additional Public Prosecutor has opposed grant of bail<br \/>\nlooking to the nature and gravity of offence.\n<\/p>\n<p>\tIn<br \/>\nthe facts and circumstances of the case and considering the role<br \/>\nattributed to the applicants, usage of stick and injuries as<br \/>\nreflected in the post-mortem report,  without discussing the evidence<br \/>\nin detail, prima facie, this Court is of the opinion that this is a<br \/>\nfit case to exercise the discretion to enlarge the applicants on<br \/>\nbail.\n<\/p>\n<p>\tThe<br \/>\nparties do not press for further reasoned order.\n<\/p>\n<p>\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicants are ordered to be released on bail in connection<br \/>\nwith  first information report registered at C.R.No.I-165 of 2010<br \/>\nwith Morbi City police station on their executing a bond of<br \/>\nRs.5,000\/- (Rupees five thousand only) each with one surety of the<br \/>\nlike amount to the satisfaction of the trial court and subject to the<br \/>\nconditions that they shall<\/p>\n<p> i.\tnot take undue<br \/>\nadvantage of their liberty or misuse their liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injuries to the interest of the prosecution;\n<\/p>\n<p>surrender<br \/>\n\ttheir passports, if any, to the lower court within a week;\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>mark<br \/>\n\ttheir presence at the concerned police station on the first Sunday<br \/>\n\tof every month between 10 a.m. And 3 p.m for six months only.\n<\/p>\n<p>furnish<br \/>\n\tthe present  address of their residence to the I.O. and also to the<br \/>\n\tCourt at the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<p>\tThe<br \/>\nAuthorities will release the applicants only if they are not required<br \/>\nin connection with any other offence for the time being. If breach of<br \/>\nany of the above conditions is committed, the Sessions Judge<br \/>\nconcerned will be free to issue warrant or take appropriate action in<br \/>\nthe matter. Bail bond to be executed before the lower court having<br \/>\njurisdiction to try the case. At the trial, the trial court shall not<br \/>\nbe influenced by the observations of preliminary nature, qua the<br \/>\nevidence at this stage, made by this Court while enlarging the<br \/>\napplicants on bail.\n<\/p>\n<p>\tRule<br \/>\nis made absolute to the aforesaid extent.
