      The   facts   as   averred   in   the   writ   petition   would   go   to<\/p>\n
show that the petitioner had been working as CLR\/substitute<\/p>\n
worker   under   the   Corporation   of   Kochi   for   the   last   more<\/p>\n
than   17   years.     Pursuant   to   Ext.P2   order   issued   by   the<\/p>\n
Government   on   29.3.2001,   the   respondent-Corporation   has<\/p>\n
published   Ext.P4   list   which   contains   the   names   of   CLR<\/p>\n
workers\/substitute   workers   who   are   entitled   to   be   granted<\/p>\n
the   benefit   of   regularisation   according   to   their   turn.\n<\/p>\n
Serial   number   allotted   to   the   petitioner   in   Ext.P4   list   is<\/p>\n
301.    It  is  averred  in  the  writ  petition  that  97  employees<\/p>\n
included   in   Ext.P4   list   have   been   granted   the   benefit   of<\/p>\n
regularisation.   This was done in 2005.   Thereafter nothing<\/p>\n
has   been   done   by   the   respondent-Corporation.     Unless   the<\/p>\n
benefit   of   regularisation   is   granted,   persons   like   the<\/p>\n
petitioner   will   not   be   able   to   avail   service   benefits<\/p>\n
including   terminal   benefits   on   their   retirement   on<\/p>\n
superannuation.   It will also affect their right to receive<\/p>\n
emoluments   as   are   sanctioned   for   the   regular   establishment<\/p>\n
post.\n<\/p>\n
      2.     Counsel   for   the   petitioner   submits   that   Ext.P4<\/p>\n
list,   though   contains   the   names   of   so   many   persons   will<\/p>\n

have  to   be   short   listed   after   deleting   those   who   have   died<\/p>\n
during the currency of that list, those attained the age of<\/p>\n
superannuation   and   those   whose   names   are   entered   more   than<\/p>\n
once,   as   can   be   seen   from   that   list   itself.     It   is   also<\/p>\n
contended   that   when   the   names   of   such   persons   are   removed<\/p>\n
from   Ext.P4   list,   the   chances   of   the   petitioner   for<\/p>\n
regularisation   will   get   accelerated,   and   having   regard   to<\/p>\n
the work to be carried out by the Corporation utilising the<\/p>\n
services   of   persons   like   the   petitioner,   he   will   become<\/p>\n
entitled for the benefit of regularisation, immediately.\n<\/p>\n
      3.  In this writ petition the reliefs prayed for by the<\/p>\n
petitioner are the following:-\n<\/p>\n
            “i)   to   issue   a   writ   of   mandamus   commanding<\/p>\n
      respondents   2   and   3   to   regularise   the   service   of<\/p>\n
      the petitioner forthwith.\n<\/p><\/blockquote>\n
\n<\/blockquote>\n
            ii)   to   issue   any   writ,   order   or   direction<\/p>\n
      commanding   the   respondents   2   and   3   to   ascertain<\/p>\n
      the   number   of   vacancies   of   sanitation   workers<\/p>\n
      available in the Corporation with reference to the<\/p>\n
      number   of   vacancies   which   were   available   at   the<\/p>\n
      time   when   the   Corporation   was   Municipality   and<\/p>\n
      regularise the service of the petitioner.<\/p>\n<\/blockquote>\n
            iii)   to   issue   a   writ   of   mandamus   or   other<\/p>\n
      appropriate   writ,   order   or   direction   commanding<\/p>\n
      respondents 2 and 3 to rectify the anomalies crept<\/p>\n
      in   Ext.P4   list   and   issue   a   revised   list   with<\/p>\n
      relevant  particulars  such  as  date  of  commencement<\/p>\n
      of service etc.<\/p>\n<\/blockquote>\n
            iv)   to   declare   that   the   petitioner   is<\/p>\n
      entitled   to   get   preference   in   the   matter   of<\/p>\n
      regularisation in view of the fact that he has got<\/p>\n
      valid   registration   with   the   Employment   Exchange<\/p>\n
      since 1984 onwards.\n<\/p><\/blockquote>\n

              v) to issue a writ of mandamus commanding the<\/p>\n
      respondents   to   pay   equal   pay   as   that   of   the<\/p>\n
      regularised employees of the same category in view<\/p>\n
      of   the   accepted   principle   of   equal   pay   for   equal<\/p>\n
      work and in the light of the decision rendered by<\/p>\n
      the Hon’ble Supreme Court.\n<\/p><\/blockquote>\n
\n<\/blockquote>\n
              vi)   to   issue   a   writ   of   mandamus   commanding<\/p>\n
      the   respondents   to   pay   full   wages   to   the<\/p>\n
      petitioner   as   that   of   the   CLR   employees   in   other<\/p>\n
      Municipalities\/Corporation   in   the   state   including<\/p>\n
      arrears thereof forthwith.\n<\/p><\/blockquote>\n
\n<\/blockquote>\n
              vii)   to   issue   any   writ,   order   or   direction<\/p>\n
      commanding   the   respondents   to   take   appropriate<\/p>\n
      action on Exts.P6 and P7 within a time limit.<\/p>\n<\/blockquote>\n
              viii)   to   issue   such   other   writ,   order   or<\/p>\n
      direction   as   this   Hon’ble   Court   may   deem   fit   and<\/p>\n
      proper in the circumstances of this case.”<\/p><\/blockquote>\n
      4.        Despite   several              chances        given   to   the<\/p>\n
respondent-Corporation,   no   counter   affidavit   has   been<\/p>\n
filed.   At one point of time this Court was constrained to<\/p>\n
pass interim orders finding that respondents 2 and 3 failed<\/p>\n
to  appear   in   person   or   through   counsel.     Subsequently,   the<\/p>\n
Secretary   of   the   Corporation   appeared   in   person   and   filed<\/p>\n
an   affidavit   expressing   his   regret.             However,   nothing<\/p>\n
useful   has   been   done   by   the   said   respondent   thereafter<\/p>\n
also.     This   indifference   continues.     Today   when   the   case<\/p>\n
has   been   taken   up   for   consideration,   none   appears   for   the<\/p>\n
Corporation.     I   do   not   think   it   necessary   to   adjourn   this<\/p>\n
case   again   and   again   so   as   to   suit   the   convenience   of   the<\/p>\n
respondent-Corporation.     The   uncontroverted   averments   made<\/p>\n

by   the   petitioner   will   have   to   be   accepted   as   true   and<\/p>\n
reliable.  I am convinced that interest of justice requires<\/p>\n
that   the   following   directions   shall   be   given   to   the<\/p>\n
respondent-Corporation:-\n<\/p>\n
      (1)   The   respondent-Corporation   shall   immediately   take<\/p>\n
up   for   consideration   the   need   for   deleting   the   names   of<\/p>\n
those   whose   names   are   repeated   in   Ext.P4   list,   rather<\/p>\n
duplicated.\n<\/p>\n
      (2)   The   respondent-Corporation   shall   also   ascertain<\/p>\n
the   details   of   those   who   died   before   and   after   the<\/p>\n
publication   of   Ext.P4   list   and   the   names   of   those   persons<\/p>\n
removed   from   the   list.   Likewise,   the   names   of   those   who<\/p>\n
have   already   attained   the   age   of   superannuation   also   shall<\/p>\n
be deleted from this list.\n<\/p>\n
      (3)   After   doing   that   exercise,   a   fresh   list   shall   be<\/p>\n
prepared   by   the   Corporation   in   tune   with   the   directions<\/p>\n
issued   by   the   Government   in   Ext.P2   order   within   a   maximum<\/p>\n
period of two months from the date of receipt of a copy of<\/p>\n
the judgment.\n<\/p>\n
      (4)   The   right   of   the   petitioner   to   be   regularised<\/p>\n
shall  be   taken   up   depending   upon   the   seniority   assigned   to<\/p>\n
him   in   that   list.     If   it   is   found   that   the   services   of<\/p>\n
persons   who   are   yet   to   be   granted   the   benefit   of<\/p>\n
regularisation   are   required   by   the   Corporation,   such<\/p>\n

persons   shall   be   given   employment   according   to   their<\/p>\n
seniority as will be reflected from the fresh list and they<\/p>\n
shall   also   be   granted   the   benefit   of   regularisation   in<\/p>\n
terms of Ext.P2 G.O.\n<\/p>\n
      (5)     The   entire   exercise   shall   be   completed   within<\/p>\n
four   months   from   the   date   of   receipt   of   a   copy   of   the<\/p>\n
judgment.\n<\/p>\n
      Writ petition is allowed as above.\n<\/p>\n
