{"id":233488,"date":"2011-09-28T00:00:00","date_gmt":"2011-09-27T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/giriraj-prasad-vs-the-state-of-bihar-on-28-september-2011"},"modified":"2015-06-12T14:26:47","modified_gmt":"2015-06-12T08:56:47","slug":"giriraj-prasad-vs-the-state-of-bihar-on-28-september-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/giriraj-prasad-vs-the-state-of-bihar-on-28-september-2011","title":{"rendered":"Giriraj Prasad vs The State Of Bihar on 28 September, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Patna High Court &#8211; Orders<\/div>\n<div class=\"doc_title\">Giriraj Prasad vs The State Of Bihar on 28 September, 2011<\/div>\n<pre>                     IN THE HIGH COURT OF JUDICATURE AT PATNA\n                          Criminal Miscellaneous No.32057 of 2011\n                          Giriraj Prasad, son of Late Gandhi Prasad\n                                               Versus\n                                      The State Of Bihar\n                                   ----------------------------------\n<\/pre>\n<p>2.   28.09.2011                Heard learned counsel for the petitioner and the<\/p>\n<p>                  State.\n<\/p>\n<p>                               The petitioner seeks bail in a case instituted for<\/p>\n<p>                  the offence under Sections 25(1-b)a, 26 and 35 of the Arms<\/p>\n<p>                  Act.\n<\/p>\n<p>                               It has been submitted that the petitioner is in<\/p>\n<p>                  custody since 9.8.2011 and he is first offender.<\/p>\n<p>                            Considering the aforesaid, let the petitioner above<\/p>\n<p>                  named, be released on bail on furnishing bail bond of Rs.<\/p>\n<p>                  5,000\/- (Five thousand) with two sureties of the like amount<\/p>\n<p>                  each or any other surety to be fixed by the court concerned to<\/p>\n<p>                  the satisfaction of Chief Judicial Magistrate, East Champaran<\/p>\n<p>                  at Motihari, in connection with Pakridayal P.S. Case No. 83 of<\/p>\n<p>                  2011, subject to the following conditions: (i) That one of the<\/p>\n<p>                  bailors will be a close relative of the petitioner who will give an<\/p>\n<p>                  affidavit giving genealogy as to how he is related with the<\/p>\n<p>                  petitioner and the other shall be the brother of the petitioner<\/p>\n<p>                  namely Umesh Prasad. The bailor will also undertake to inform<\/p>\n<p>                  the Court if there is any change in the address of the<\/p>\n<p>                  petitioner. (ii) That the affidavit shall clearly state that the<\/p>\n<p>                  petitioner is not an accused in any other case and if he is he<\/p>\n<p>                  shall not be released on bail. (iii) That the bailor shall also<\/p>\n<p>                  state on affidavit that he will inform the court concerned if the<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>        petitioner is implicated in any other case of similar nature after<\/p>\n<p>        his release in the present case and thereafter the court below<\/p>\n<p>        will be at liberty to initiate the proceeding for cancellation of<\/p>\n<p>        bail on the ground of misuse. (iv) That the petitioner will give<\/p>\n<p>        an undertaking that he will receive the police papers on the<\/p>\n<p>        given date and be present on date fixed for charge and if he<\/p>\n<p>        fails to do so on two given dates and delays the trial in any<\/p>\n<p>        manner, his bail will be liable to be cancelled for reasons of<\/p>\n<p>        misuse.
