No.31865 of 2010\n                    MANJEET MADHU, SON OF MADHU SUDAN PANDEY\n                                           Versus\n                                    STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p>2.   23.09.2010               Heard learned counsel for the petitioner and the<\/p>\n<p>                  State.\n<\/p>\n<p>                              The petitioner seeks bail in a case instituted for the<\/p>\n<p>                  offence under Sections 420 and 409 of the Indian Penal Code.<\/p>\n<p>                              Considering that the petitioner is in custody since<\/p>\n<p>                  8.6.2010 and the entire case is based on documentary<\/p>\n<p>                  evidence, let the petitioner above named, be released on bail<\/p>\n<p>                  on furnishing bail bond of Rs. 5,000\/- (Five thousand) with two<\/p>\n<p>                  sureties of the like amount each or any other surety to be fixed<\/p>\n<p>                  by the court concerned to the satisfaction of Chief Judicial<\/p>\n<p>                  Magistrate, Motihari, East Champaran, in Sugauli P.S. Case<\/p>\n<p>                  No. 125 of 2008 subject to the following conditions: (i)That one<\/p>\n<p>                  of the bailors will be a close relative of the petitioner who will<\/p>\n<p>                  give an affidavit giving genealogy as to how he is related with<\/p>\n<p>                  the petitioner. The bailor will undertake to furnish information to<\/p>\n<p>                  the court about any change in address of the petitioner. (ii)That<\/p>\n<p>                  the affidavit shall clearly state that the petitioner is not an<\/p>\n<p>                  accused in any other case and if he is, he shall not be released<\/p>\n<p>                  on bail. (iii)That the bailor shall also state on affidavit that he will<\/p>\n<p>                  inform the court concerned if the petitioner is implicated in any<\/p>\n<p>                  other case of similar nature after his release in the present case<\/p>\n<p>                  and thereafter the court below will be at liberty to initiate the<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>        proceeding for cancellation of bail on the ground of misuse.<\/p>\n<p>        (iv)That the petitioner will give an undertaking that he will<\/p>\n<p>        receive the police papers on the given date and be present on<\/p>\n<p>        date fixed for charge and if he fails to do so on two given dates<\/p>\n<p>        and delays the trial in any manner, his bail will be liable to be<\/p>\n<p>        cancelled for reasons of misuse.
