Para 3 of<br \/>\nthat order reads as under:\n<\/p>\n<p>&#8220;Prima<br \/>\nfacie, contents of letter dated 22.05.2008 (which is page No. 44,<br \/>\nAnnexure &#8216;F&#8217;) are not on line with the award and order passed by the<br \/>\nlearned Judge of Labour Court on 16.12.2006.&#8221;\n<\/p>\n<p>1.1\tLearned<br \/>\nadvocate Mr. Desai for the petitioners was granted time to take<br \/>\ninstructions as to under what<br \/>\ncircumstances, letter dated 22nd May 2008 was written by<br \/>\npetitioner No. 1.\n<\/p>\n<p>2.0\tToday,<br \/>\nwhen the matter is called out, the learned advocate for the<br \/>\npetitioners tried to explain the contents of letter dated<br \/>\n22nd<br \/>\nMay 2008, which is of no consequence.\n<\/p>\n<p>2.1\tIt<br \/>\nis a settled position of law that if any amount is paid under<br \/>\nmistake, it can always be recovered by the authority.\n<\/p>\n<p>2.2\tAt<br \/>\nthis juncture, the Court deems it proper to put it on record that,<br \/>\nthere can be an inference drawn for &#8216;unauthorized payment&#8217; that the<br \/>\nperson, who has received the same, has obtained the same from the<br \/>\nconcerned authority for &#8216;extraneous considerations&#8217;.  It is also a<br \/>\nfact of which judicial notice can be taken that the authorities<br \/>\n(State Government and other local authorities) work through<br \/>\nhuman agency and human agency is prone to such mistake\/mischief and<br \/>\ntherefore, it is a settled position of law that, if an amount is paid<br \/>\nunder mistake (the word used &#8216;mistake&#8217; is only to put it lightly,<br \/>\notherwise, it could have been stated that the amount which is<br \/>\nobtained by the beneficiary for &#8216;extraneous considerations&#8217;) can<br \/>\nalways be recovered.\n<\/p>\n<p>3.0\tPresent<br \/>\nis the case, wherein, the challenge is to an order by which, the<br \/>\nauthority has sought recovery of the amount paid by mistake.  That is<br \/>\nwhy, the Court finds no substance in the petition.  The same is<br \/>\ndismissed.  Notice is discharged.\n<\/p>\n<p>3.1\tOnly<br \/>\nbecause the workmen are before this Court, the Court takes lenient<br \/>\nview in the matter and does not impose any cost and does not pass any<br \/>\nfurther strictures against the petitioners.\n<\/p>\n<p>[<br \/>\nRavi R.
