It is also submitted that the investigation is over and<br \/>\n\tcharge sheet is filed. The petitioner has been in jail since last<br \/>\n\tmore than two months. It is therefore requested that the petitioner<br \/>\n\tmay be released on bail.\n<\/p>\n<p>\tTaking<br \/>\n\tinto consideration the fact that the petitioner remained in jail<br \/>\n\tsince last more than two months and looking to the manner in which<br \/>\n\tthe incident took place and the sentence prescribed in such cases<br \/>\n\tcoupled with the facts that investigation is over and charge sheet<br \/>\n\tis filed, this petition is required to be allowed.\n<\/p>\n<p>\tThis<br \/>\n\tpetition is accordingly allowed and the petitioner is ordered to be<br \/>\n\treleased on bail in connection with Crime Register No.I-29 of 2008<br \/>\n\tbefore Santalpur Police Station for the offences alleged against him<br \/>\n\tin this petition on his executing bond of Rs.10,000\/- (Rupees Ten<br \/>\n\tThousand only) with one solvent surety of the like amount to the<br \/>\n\tsatisfaction of the lower Court and subject to the conditions that<br \/>\n\the shall-\n<\/p>\n<p>a)<br \/>\nnot take undue advantage of liberty or abuse liberty;\n<\/p>\n<p>b)<br \/>\nmaintain law and order;\n<\/p>\n<p>c)<br \/>\nnot act in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>d)<br \/>\n\t\tfurnish the present and permanent address of residence to the I.O.<br \/>\n\t\tand also to the Court at the time of execution of the bond and<br \/>\n\t\tshall not change the residence without prior permission of this<br \/>\n\t\tCourt;\n<\/p>\n<p>\t\te)<br \/>\n\t\tnot leave the limit of State of Gujarat without prior permission of<br \/>\n\t\tthe Court; and<\/p>\n<p>\t\tf)<br \/>\n\t\tsurrender passport, if any, within a week to the lower Court.\n<\/p>\n<p>\tIf<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>\tBail<br \/>\n\tbefore the lower Court having jurisdiction to try the case.\n<\/p>\n<p>\tRule<br \/>\n\tis made absolute.
