He is aware that the retirement pursis is issued on<br \/>\n08.03.2011.\n<\/p>\n<p>\tIn<br \/>\nview of this, when stay is obtained by the petitioner, and when the<br \/>\nmatter is placed and it is ready for final hearing, he would seek<br \/>\nunnecessary retirement.\n<\/p>\n<p>\tAt<br \/>\nthis stage, he withdraws the note for retirement and he would be<br \/>\nready with the matter on 14.03.2011.&#8221;\n<\/p>\n<p>On<br \/>\n\tearlier occasion, on 11.03.2011, this Court noted that the matter is<br \/>\n\tof the year 2007, the stay is obtained and learned advocate for the<br \/>\n\tpetitioner Mr.Vyas would be ready with the matter as he has<br \/>\n\twithdrawn the note of retirement from the matter. The matter was<br \/>\n\tlisted on 14.03.2011.\n<\/p>\n<p>Today,<br \/>\n\tlearned advocate Mr.Vyas appeared and submitted that he is unable to<br \/>\n\tconduct the matter as the letter was sent to the petitioner Nos.1<br \/>\n\tand 2 indicating therein that he is retiring from the matter. This<br \/>\n\tCourt is of the view that when the matter is listed for final<br \/>\n\thearing and interim relief have been obtained, the petitioner is not<br \/>\n\treally interested with the matter and is not vigilant to keep their<br \/>\n\tadvocate posted with the facts and or further development in the<br \/>\n\tmatter. RPAD sent to the petitioner Nos.1 and 2 has returned with an<br \/>\n\tendorsement that petitioners have left. Petitioners are happened to<br \/>\n\tbe father and a son, as per the submission of the learned advocate<br \/>\n\tMr.Vyas at the Bar.\n<\/p>\n<p>The<br \/>\n\tCourt is of the view that the matter is therefore required to be<br \/>\n\tdisposed of as the petitioners are no more interested in prosecuting<br \/>\n\tthis matter. The Court is of the view that in this situation,<br \/>\n\tinterim-relief cannot be permitted to be continued and the petition<br \/>\n\tis required to be dismissed, for want of prosecution. Orders<br \/>\n\taccordingly.\n<\/p>\n<p>Interim-relief<br \/>\n\tgranted earlier, stands vacated.
