Justice P.N.RAVINDRAN\n\n Dated :19\/10\/2009\n\n O R D E R\n<\/pre>\n<p>                       P.N.RAVINDRAN,J.\n<\/p>\n<p>               &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<br \/>\n               W.P.(C) No. 29416 of 2009 &#8211; V\n<\/p>\n<p>               &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<p>                   Dated 19th October, 2009<\/p>\n<p>                            Judgment<\/p>\n<p>     Heard     Sri.S.Sudheeshkumar,         the    learned counsel<\/p>\n<p>appearing for the petitioners and Sri.T.A.Shaji, the learned<\/p>\n<p>standing counsel appearing for the respondents.<\/p>\n<p>     2.   The petitioners appeared for the third semester<\/p>\n<p>supplementary     B.Tech.    degree     examination     in Polymer<\/p>\n<p>Engineering conducted by the Mahatma Gandhi University in<\/p>\n<p>May, 2009.    The results were published towards the end of<\/p>\n<p>September, 2009. The petitioners again failed in one paper<\/p>\n<p>each.   They have therefore applied for revaluation of their<\/p>\n<p>answer scripts     by submitting Exts.P1 and P3 applications.<\/p>\n<p>Exts.P2 and P4 disclose that they have paid the requisite fee<\/p>\n<p>for revaluation.     The petitioners submit that they have<\/p>\n<p>completed their course of study and have passed all the other<\/p>\n<p>semester examinations. The petitioners submit that they had<\/p>\n<p>done well in the examination and that they are sure to secure a<\/p>\n<p>pass if their answer scripts are revalued. It is also stated that<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.29416\/2009             2<\/span><\/p>\n<p>the supplementary examination is scheduled to be held on<\/p>\n<p>1.12.2009 and if, before the date fixed for registration to<\/p>\n<p>appear for the said examination, their answer scripts are<\/p>\n<p>revalued and the results communicated to them, they need not<\/p>\n<p>appear for the supplementary examination if they secure a<\/p>\n<p>pass in the third semester examination. On these grounds, the<\/p>\n<p>petitioners seek a writ in the nature of mandamus commanding<\/p>\n<p>the respondents to take steps to have their answer scripts<\/p>\n<p>revalued and to publish the results before 20.11.2009.<\/p>\n<p>       3. Sri.T.A.Shaji, the learned Standing Counsel appearing<\/p>\n<p>for the Mahatma Gandhi University submits that petitioners&#8217;<\/p>\n<p>answer scripts cannot be singled out and revalued as it will<\/p>\n<p>lead to loss of confidentiality. He also submits that as per the<\/p>\n<p>Examination Manual,       the University requires 81 clear days<\/p>\n<p>from the date of publication of the results to complete the<\/p>\n<p>revaluation process. He further submits that the petitioners&#8217;<\/p>\n<p>applications for revaluation will be considered and their answer<\/p>\n<p>scripts revalued, if their applications are in order, within the<\/p>\n<p>aforesaid period.\n<\/p>\n<p>       4. The Examination Manual is not a statutory regulation.<\/p>\n<p>It is a Manual prepared by the University for its guidance. The<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.29416\/2009             3<\/span><\/p>\n<p>stipulations in the Examination Manual cannot, in my opinion,<\/p>\n<p>operate to the detriment of students. A Division Bench of this<\/p>\n<p>Court has in <a href=\"\/doc\/1085668\/\">University of Kerala v. Sandhya P. Pai<\/a> (1991<\/p>\n<p>(1) KLT 812) held that the University should hurry with<\/p>\n<p>applications for revaluation without wasting any time and that<\/p>\n<p>unless applications for revaluation are expeditiously disposed<\/p>\n<p>of, it will cause serious prejudice to the students.         I am<\/p>\n<p>therefore of the considered opinion that the University should<\/p>\n<p>not wait for the expiry of 81 clear days from the date of<\/p>\n<p>publication of the results to complete the revaluation process.<\/p>\n<p>       I accordingly dispose of this writ petition with a direction<\/p>\n<p>to the respondents to take steps to have the answer scripts<\/p>\n<p>described in Exts.P1 to P3 applications revalued and to<\/p>\n<p>communicate the results to the petitioners within six weeks<\/p>\n<p>from the date on which the petitioners produce a certified<\/p>\n<p>copy of this judgment before the Controller of Examinations,<\/p>\n<p>Mahatma Gandhi University.\n<\/p>\n<\/p>\n<p>                                                P.N.RAVINDRAN<br \/>\n                                                     Judge<\/p>\n<p>vaa<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Amalkumar.K.K. vs Mahatma Gandhi University &#8230; on 19 October, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 29416 of 2009(V) 1.
