(ORAL)\n<\/pre>\n<p>          The plaintiff is in second appeal aggrieved against the<\/p>\n<p>judgment and decree passed by the Courts below, whereby a suit for<\/p>\n<p>declaration that the plaintiff is owner in possession of the shop in dispute,<\/p>\n<p>was dismissed.\n<\/p>\n<p>          It has been found by the Courts below that the shop in dispute<\/p>\n<p>is in fact purchased by the defendant-Gian Singh from one Ram Singh,<\/p>\n<p>vide sale deed dated 13.9.1967 and that the fact of purchase by Gian<\/p>\n<p>Singh is admitted by PW-8 Sansar Chand, Manager of the appellant-<\/p>\n<p>Society. Both the Courts have considered the entire evidence to return a<\/p>\n<p>concurrent finding of fact that the plaintiff has failed to prove any<\/p>\n<p>document of ownership, whereas, the defendants are proved to be owner<br \/>\n<span class=\"hidden_text\"> R.S.A.No.149 of 2009                                         2<\/span><\/p>\n<p>of the same, on the basis of sale deed dated 13.9.1967.
