Crl. Miscellaneous Petition No.309\/2007\n(Purshottam Garg Vs. Smt. Bhagya Laxmi)\n\n\nDate of Order : 10.03.2010\n\n\nHON'BLE MR. JUSTICE M.N. BHANDARI\n\n\nMr.Anirudh Singh, for the petitioner.\n\n\nBy the Court:\t\t<\/pre>\n<p>\t\tAggrieved by the order dated 07.12.2006, this miscellaneous petition has been filed.\n<\/p>\n<p>\t\tLearned counsel for the petitioner submits that initially monthly maintenance of Rs.500\/- was awarded vide order dated 28.05.2009. The aforesaid amount has been enhanced to Rs.600\/- by the Revisional Court vide impugned order dated 07.12.2006. The petitioner is earning only Rs.800\/- per month, thus it is difficult for him to pay Rs.600\/- and that too when enhancement of amount is from the date of initial order. The prayer is accordingly made to set aside both the orders more so when the respondent herself left the place of the petitioner.\n<\/p>\n<p>\t\tI have considered the submissions made by the learned counsel for the petitioner and find that intial Courts below passed the orders after proper appreciation of facts. The Revisional Court enhanced the amount of maintenance from Rs.500\/- to Rs.600\/- after taking note of all the facts relevant concerned to the issue. No error has been shown in the orders for calling my interference. The impugned orders herein are reasoned order and accordingly, the maintenance has been given.\n<\/p>\n<p>\t\tIn view of the above, I am not inclined to interfere in both the impugned orders passed by the Courts below, the criminal miscellaneous petition is dismissed accordingly.\n<\/p>\n<p>(M.N.
