RAJYALAKSHMI RAO, MEMBER \n\n \n\n \u00a0\n\n \n\nFor the\nPetitioner : Mr. Vishnu Mehra, Advocate\n \n\n \n\n \n\n \n\n 22.10.2007 \n\n ORDER\n<\/pre>\n<p> \u00a0<\/p>\n<p>Heard the learned counsel for the petitioner.\n<\/p>\n<p>In our view,<br \/>\nthe finding of the fact recorded by the District Forum as well as the State<br \/>\nCommission does not call for any interference because they have relied upon the<br \/>\ncertificate issued by the Police Officer, after investigation, to the effect<br \/>\nthat the insured died due to snake<br \/>\nbite. The Village Administrative Officer<br \/>\nhas also given a certificate to the same effect, and, also the doctor who<br \/>\ninquired into the cause of<br \/>\nthe death of the deceased established that the insured died due<br \/>\nto snake bite. This aspect is dealt<br \/>\nwith by the District Forum as under:-\n<\/p>\n<p>Ex.B1<br \/>\nshows that the first Sri B.V. Sesha Reddy insurance<br \/>\nsurveyor and after that Mr. D. Ajay Kumar, Advocate was appointed as surveyor<br \/>\nand after that an independent enquiry by the Mandal<br \/>\nRevenue Officer against the request of the insurer and thereafter Spy Eye<br \/>\nDetectives were appointed. But there is no any logic for appointing subsequent<br \/>\nsurveyors and Ex.B1 report also shows that the report of the Dama Ajay Kumar is favourable to<br \/>\nthe complainant. So as per the above<br \/>\nsaid decision the report which is favourable to the<br \/>\ninsured shall be prevail and the counsel for the opposite parties also relied<br \/>\non Ex.B3 certificate. Ex.B3<br \/>\ncertificate issued by the Sarpanch incharge of Mudivarthipalem Grama Panchayat. It shows that the insured died due to Cardiac<br \/>\narrest. Ex.A2, Ex.A3, Ex.A5, Ex.A6 and<br \/>\nEx.A8 shows that the cause of the death of the insured is cardiac arrest due to<br \/>\nthe snake bite. But Ex.B3 does not show<br \/>\nthe cardiac arrest due to snake bite or not.<br \/>\nWhen Ex.A2 medical officer certificate clearly shows that the insured<br \/>\ndied due to snake bite, nothing is found to disbelieve the contents of the Ex.A2, Ex.A3,<br \/>\nEx.A5, Ex.A6 and Ex.A8. So in view of<br \/>\nit, Ex.B1 to Ex.B3 are no way helpful to establish the<br \/>\ncase of the opposite parties that the insured death is natural one.\n<\/p>\n<p>However, the<br \/>\nlearned counsel for the petitioner has relied upon the Investigation Report, and submitted that<br \/>\nthere is no other evidence on record to establish that the insured died because of the snake bite. In our view, the Investigation Report is<br \/>\nbased upon the appreciation of evidence collected by the Investigator. There is no reason to doubt the Police<br \/>\ninvestigation or the say of the Medical Officer.\n<\/p>\n<p>The learned<br \/>\ncounsel for the petitioner further submitted that without conducting post-mortem,<br \/>\nthe doctor cannot say, by mere look at the dead body, that the person has died because of the snake<br \/>\nbite. In our view, the doctor can, on taking into consideration the<br \/>\nsymptoms\/cause of the snake bite, easily<br \/>\ncertify or arrive at the conclusion that<br \/>\nperson died because of the poison.\n<\/p>\n<p>Even a layman can say the same thing some times.\n<\/p>\n<p>The learned<br \/>\ncounsel for the petitioner further submitted that in terms of the Policy,<br \/>\nconduct of post -mortem is a must. In our<br \/>\nview, in a small village, when a person dies because of snake bite, they would<br \/>\nnot wait for post-mortem or would not remove the dead body to the   Civil<br \/>\n  Hospital which is far off.
