Justice PIUS C.KURIAKOSE\n\n Dated :28\/01\/2008\n\n O R D E R\n                      PIUS.C.KURIAKOSE J.\n                      ------------------------\n                   W.P.(C)No. 24488 of 2003\n                      ------------------------\n\n           Dated this the 28th      day of January, 2009\n\n\n                            JUDGMENT\n<\/pre>\n<p>      On behalf of Sri.Parthasarathy, learned counsel for the<\/p>\n<p>petitioner, an adjournment is sought for. But, I feel that the<\/p>\n<p>petitioner has not made out a ground for          invocation of the<\/p>\n<p>supervisory jurisdiction of of this court under Article 227 of the<\/p>\n<p>Constitution in this case.      In a suit, which was filed by the<\/p>\n<p>respondent, who is the landlord of the petitioner, the petitioner<\/p>\n<p>filed a counter claim. But, obviously the filing of the counter<\/p>\n<p>claim was after the suit itself was dismissed by the learned<\/p>\n<p>Munsiiff on the basis of a statement by the plaintiff that the suit<\/p>\n<p>has become infructuous. The plaintiff is the dominus litis and<\/p>\n<p>the court below cannot be blamed for having refused to entertain<\/p>\n<p>the counter claim.\n<\/p>\n<p>      I dismiss this writ petition. But, I make it clear that neither<\/p>\n<p>the order of the learned Munsiff, nor this judgment will stand in<\/p>\n<p>the way of the petitioner filing a fresh          suit against the<\/p>\n<p><span class=\"hidden_text\">WPC.No. 24488\/2003            2<\/span><\/p>\n<p>respondent on any genuine and subsisting cause of action.<\/p>\n<p>                                PIUS.C.KURIAKOSE,JUDGE<\/p>\n<p>dpk<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court K.
