BLOCK DEVELOPMENT OFFICER, GAUNAHA, WEST\n         CHAMPARAN\n                                       -----------\n<\/pre>\n<p>2.   22.02.2011                 Heard learned counsel for the petitioner<\/p>\n<p>                  and the State.\n<\/p>\n<p>                                The petitioner is stated to be the Mukhiya<\/p>\n<p>                  of Gram Panchayat Raj, Lachnauta, Block- Gaunaha<\/p>\n<p>                  District-West Champaran.       She is aggrieved by the<\/p>\n<p>                  final order dated 6.7.2010, passed by the Secretary,<\/p>\n<p>                  Department of Panchayati Raj unseating her from<\/p>\n<p>                  the post in exercise of powers under Section 18(5) of<\/p>\n<p>                  the Bihar Panchayat Raj Act, 2006 (hereinafter called<\/p>\n<p>                  the &#8216;Act&#8217;).\n<\/p>\n<p>                                It is not in controversy that a show cause<\/p>\n<p>                  notice was issued to her, duly replied whereafter<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>final orders have been passed.\n<\/p>\n<p>             The law stands well settled that the Court<\/p>\n<p>shall not sit as an appellate authority over the<\/p>\n<p>decision of the respondents but shall primarily<\/p>\n<p>examine the decision making process.             The Court<\/p>\n<p>finds no error in the decision making process.<\/p>\n<p>             Learned      counsel    for   the      petitioner<\/p>\n<p>strenuously urged that the petitioner in her reply to<\/p>\n<p>the show cause had taken a specific defence that co-<\/p>\n<p>accused Zafir Ahmad had taken advantage of her<\/p>\n<p>illiteracy and obtained her signature by deceit and<\/p>\n<p>also forged her signature in collusion with the<\/p>\n<p>contractor    and       other   authorities   for     alleged<\/p>\n<p>siphoning of funds of which she was not aware. This<\/p>\n<p>has not been discussed and\/or considered in the<\/p>\n<p>final order. It is next submitted that the Secretary,<\/p>\n<p>Department     of   Panchayati       Raj   has   abdicated<\/p>\n<p>statutory power by relying upon the comments of the<\/p>\n<p>District Magistrate on the cause shown by the<\/p>\n<p>petitioner. The absence of independent application of<\/p>\n<p>mind by the Secretary therefore vitiates the order.<\/p>\n<p>             Once the petitioner acknowledged having<\/p>\n<p>given certain signed documents to Zafir Ahmad, the<\/p>\n<p>charge stands admitted.         Thereafter, the question if<\/p>\n<p>signatures were obtained by deceit or forgery being of<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>           disputed question of facts, the Court finds no error<\/p>\n<p>           in the decision making process warranting any<\/p>\n<p>           interference.   The defence of the petitioner raises<\/p>\n<p>           very serious disputed questions of fact which can<\/p>\n<p>           only be tested in a full fledged civil proceeding. In so<\/p>\n<p>           far as the provisions of Section 18(5) of the Act are<\/p>\n<p>           concerned, it provides for reasonable opportunity to<\/p>\n<p>           defend. That having been given, the Court does not<\/p>\n<p>           find substance in the submission that the Secretary<\/p>\n<p>           has acted at the dictates of the District Magistrate.<\/p>\n<p>           The final order displays due application of mind to<\/p>\n<p>           the allegation, the cause shown, the comments of the<\/p>\n<p>           District Magistrate upon the same to arrive at a final<\/p>\n<p>           conclusion.\n<\/p>\n<p>                       The charge having been admitted by the<\/p>\n<p>           petitioner, her defence on disputed facts, in the<\/p>\n<p>           manner presented, cannot be examined in a writ<\/p>\n<p>           petition.\n<\/p>\n<p>                       The writ application is dismissed.\n<\/p>\n<\/p>\n<pre>P.
