PHUKAN, J<\/p>\n<p>\tThis appeal is directed\t against  the  judgment\t and<br \/>\norder  dated  16th  December,  1994  passed  by\t the Central<br \/>\nAdministrative Tribunal, Principal Bench,New Delhi  in\tO.A.<br \/>\nNo.  1036 of 1990.\n<\/p>\n<p>\tFor the purpose, of appreciating the points urged in<br \/>\nthis appeal we may briefly state the facts.\n<\/p>\n<p>\tThe appellant herein  was  appointed  as  Mechanical<br \/>\nOperator  on  19.03.1965  by  the  respondents and from &#8220;the<br \/>\nimpugned judgment  we  rind  that  her\tappointment  was  on<br \/>\nprobation  for a period of two years and further this period<br \/>\nwas neither extended  nor  her\tappointment  was  confirmed.<br \/>\nHowever,  she was declared quasi permanent w.e.f 19.03.19GS.<br \/>\nOn 30.05.78 she submitted a letter  of\tresignation  on\t the<br \/>\nground of  alleged  harassment\tbut  on.   the next day i.e.<br \/>\n31.05.7.8 she submitted another letter for withdrawal of the<br \/>\nresignation.   However,\t  the\trespondents   accepted\t her<br \/>\nresignation and informed her accordingly.\n<\/p>\n<p>\tOn being dissatisfied the  appellant  filed  a\twrit<br \/>\npetition   before   the\t  High\tCourt  of  Delhi  which\t was<br \/>\ntransferred to\tCentral\t Administrative\t  Tribunal.\t The<br \/>\nTribunal  allowed  her petition and directed the respondents<br \/>\nto allow her to rejoin her service  with  all  consequential<br \/>\nbenefits  and accordingly on 16.05.86 she rejoined her post.<br \/>\nOn the basis of Review Departmental Promotion Committee held<br \/>\non June, 1979  her  appointment\t was  made  substantive\t as<br \/>\nMechanical Operator w.e.f.01.07.75 and in the seniority list<br \/>\nshe  was placed senior to Kum.Indra Devi.Thereafter) she was<br \/>\nappointed to officiate as  Technical  Assistant\t (Hollarith)<br \/>\nwhich is  higher  post\tw.e.f.\t  29.04.83 from the date her<br \/>\njunior was made senior\tin  the\t post.\t  From\t03.03.86  to<br \/>\n31.07.86  she was given the benefit of adhoc appointment and<br \/>\nher seniority was also determined above the said Kum.  Indra<br \/>\nDevi w.e.f.  29.4.83.  The appellant allegation\t before\t the<br \/>\nTribunal was  that she was appointed along with Smt.  Versha<br \/>\nMalhotra, Shri P.S, Jain and Smt.  Malti Duggal,  therefore,<br \/>\nshe should  be\tconfirmed as Mechanical Operator w.w.f.\t the<br \/>\ndate her above named batchmate\twere  confirmed\t Instead  of<br \/>\nconfirming her\t from  01.07.75.    She\t grayed\t before\t the<br \/>\nTribunal that the other dated 12.12.88 confirming her in the<br \/>\npost from 01.07.75 be quashed and declaring her entitled  to<br \/>\nbe confirmed  as  Mechanical  Operator w.e.f.  the date from<br \/>\nwhich her immediate  junior  had  been\tconfirmed  with\t all<br \/>\nconsequential benefits.\n<\/p>\n<p>\tThe  respondents  opposed the application before the<br \/>\nTribunal and stated that mechanical Operators were confirmed<br \/>\nin the grade  on  the  recommendation  of  the\tDepartmental<br \/>\nPromotion Committee  held  in  1974  and  1977.\t   After the<br \/>\nresignation and relieving of the appellant,  2\tDepartmental<br \/>\nPromotion  Committees  were held for substantive appointment<br \/>\nto the grade of Mechanical Operator and on the basis of\t the<br \/>\nassessment  of the record of appellant she was not found fit<br \/>\nfor substantive appointment, Another Departmental  Promotion<br \/>\nCommittee  which  was held in December, 1977 the case of the<br \/>\nappellant could not be considered as she was not in  service<br \/>\nand,  therefore,  a  Review Departmental Promotion Committee<br \/>\nwas held in November, 1988 but she  was\t found\tunfit.\t  In<br \/>\nJune,  1979  the appellant was given substantive appointment<br \/>\nas Mechanical Operator and she was placed above Kum.   Indra<br \/>\nDevi   who  was\t appointed  substantively  to  the  post  of<br \/>\nMechanical Operator w.e.f.  01.07,75 on\t the  basis  of\t the<br \/>\nrecommendation of-the next Departmental Promotion Committee.\n<\/p>\n<p>\tThe tribunal took note\tof  the\t fact  that  as\t the<br \/>\nappellant  was\tonly  a\t temporary  employee  as  Mechanical<br \/>\nOperator  and  her   performance   was\t not   satisfactory,<br \/>\ntherefore,  rightly stated that she should not be confirmed.<br \/>\nThe tribunal also noted adverse remarks made in\t the  annual<br \/>\nconfidential   reports\t and  the  disciplinary\t action\t and<br \/>\npunishment imposed  on\t the   appellant.      Taking\tinto<\/p>\n<p>consideration  all  the\t facts\tthe application filed by the<br \/>\nappellant was dismissed,<\/p>\n<p>\tWe have heard learned counsel Shri K.V, Rohtagi\t for<br \/>\nthe appellant and Shri Rajiv Nanda for the respondent,<\/p>\n<p>\tThe  appellant as stated above joined on the post of<br \/>\nMechanical Operator on 19.03.65 and she was  declared  quasi<br \/>\npermanent w.e.f\t 19.04.68.    For\u00ef  promotion to the post of<br \/>\nTechnical Assistant (Holl) as per the recruitment rules, 75%<br \/>\nof the posts to be filled up by promotion on  the  basis  of<br \/>\nseniority  cum\tfitness and 25% on the basis of departmental<br \/>\ntest.\tAs  the\t appellant  was\t appointed  and\t  Mechanical<br \/>\nOperator  she  would  come under the category of 75% for the<br \/>\npurpose of promotion to the next higher post.\n<\/p>\n<p>\tIn  the\t year  1974,  a\t disciplinary proceeding was<br \/>\nstarted under Rule 16 of the CCS(CCA)  Rules,  1965  against<br \/>\nthe  appellant\tfor  disobedience  of orders of her superior<br \/>\nofficers and having  acted  in\ta  manner  unbecoming  of  a<br \/>\ngovernment servant.    She  was\t found guilty and penalty of<br \/>\nwithholding of one increment was imposed.  In the year\t1975<br \/>\nanother\t disciplinary  proceeding  was initiated against the<br \/>\nappellant and in 1976 against she was warned as a result  of<br \/>\nthe disciplinary proceedings.  In December, 1976 as a result<br \/>\nof  disciplinary  punishment of withholding of one increment<br \/>\nvas imposed on the appellant.  In 1978 again a\tdisciplinary<br \/>\nproceeding was initiated against the appellant.\n<\/p>\n<p>\tAdverse\t remarks  for  the  period ending 31 12.196<br \/>\nwere conveyed to her that her work  and\t behaviour  was\t not<br \/>\nfound  satisfactory  In\t 1969 she was warned that she had to<br \/>\nimprove her attendance and work.  In 1976  adverse  remarks,<br \/>\nfor  the  year 1975 that she was extremely indisciplined and<br \/>\ninsubordinate to all her  superiors,  were  communicated  to<br \/>\nher.   Her  work was also very poor due to her carelessness.<br \/>\nThus it appears apart from the adverse remarks recorded in ,<br \/>\nthe years 1965,1968 and\t 1975  in  her\tannual\tconfidential<br \/>\nreports,  punishments  were  also  awarded after drawing the<br \/>\nproceedings in the year 1974, 1^76 and 1977.\n<\/p>\n<p>\tIn  view  of  the  above  remarks  in\ther   annual<br \/>\nconfidential  reports and punishments imposed as a result of<br \/>\nthe proceedings the tribunal refused  to  interfere  in\t the<br \/>\nmatter.\t  We  hold  that  action  of  the tribunal cannot be<br \/>\nfaulted.\n<\/p>\n<p>\tBut tribunal had recorded  after  looking  into\t the<br \/>\nrelevant  file\tof the appellant that her appointment was on<br \/>\nprobation for  a  period  of  2\t years\tand  it\t was  purely<br \/>\ntemporary.   The  tribunal  also  noted\t that she made quasi<br \/>\npermanent after\t 3  years  and\theld  that  merely  she\t was<br \/>\ndeclared  quasi\t permanent  will  not  ipso  facto  make her<br \/>\nappointment to\tsubstantive  post.    We  quote\t below\tthis<br \/>\nfinding of the tribunal:\n<\/p>\n<p>\t&#8220;Though\t there\tis  nothing  on\t record\t  that\t the<br \/>\nprobation  period  at  any  time  extended  yet\t there is no<br \/>\ndocument  available  which  goes  to  show  that   she\t has<br \/>\nsuccessfully completed the period of probation.&#8221;\n<\/p>\n<p>\tAs stated above though the appellant  was  appointed<br \/>\nin  the\t year 1965 and made quasi permanent in the year 1968<br \/>\nbut the respondents neither extended the period of probation<br \/>\nnor terminated\ther  services.\t    Adverse   remarks\twere<br \/>\ncommunicated  to  the appellant regarding her unsatisfactory<br \/>\nwork and behaviour and also in the year 1969 adverse remarks<br \/>\nfor the year ending 31\t12.1968 were communicated  and\tshe<br \/>\nwas asked  to  improve her attendance.\tNothing was recorded<br \/>\nin her annual confidential reports from 1968 to 1976.\t The<br \/>\nfirst departmental proceeding was started in the year 1974,<\/p>\n<p>\tUnder\tnormal\t circumstances,\t  the  case  of\t the<br \/>\nappellant for making permanent should have  been  considered<br \/>\nat  the\t end  of  2  years  of\tprobation or if work was not<br \/>\nsatisfactory   probation   should   have   been\t   extended.<br \/>\nUnfortunately,\tthere  are no rules of Mechanical Operators,<br \/>\nFor no fault of appellant her case was\tnot  considered\t for<br \/>\nthe above period and for the first time it was considered by<br \/>\nthe  Departmental  Promotion  Committee in the year 1974 and<br \/>\nagain after she was reappointed as per the direction of\t the<br \/>\ntribunal.\n<\/p>\n<p>\tWe  are,  therefore, of the opinion that the case of<br \/>\nthe appellant should have been considered immediately  after<br \/>\ncompletion of period of probation and as it was not done the<br \/>\nappellant is  entitled\tto some relief.\t We are of the view<br \/>\nthat in the grade of Mechanical Operator her seniority shall<br \/>\nbe restored to below the persons who were  immediate  senior<br \/>\nto the appellant and direct accordingly.\n<\/p>\n<p>\tRegarding promotion of the  appellant  to  the\tnext<br \/>\nhigher\tpost the impugned order cannot be faulted in view of<br \/>\nthe various adverse remarks recorded against  the  appellant<br \/>\nand  the punishments imposed as a result of the departmental<br \/>\nproceedings.  Therefore,  her  seniority  &#8220;bo  the  post  of<br \/>\nTechnical  Assistant  shall  be\t as  fixed by the respondent<br \/>\nwhich is held to be valid by the tribunal.  We make it\tvery<br \/>\nclear  that  in view of the directions regarding fixation of<br \/>\nseniority of the  appellant  to\t &#8220;the  grade  of  Mechanical<br \/>\nOperator  she  shall  be  entitled  to all the consequential<br \/>\nbenefits in that grade but shall not be\t entitled  in  claim<br \/>\nany  benefit  to  the  next  higher  post  namely  Technical<br \/>\nAssistant,<\/p>\n<p>\tIn  the\t result the appeal is partly allowed and the<br \/>\norder of the tribunal stands modified in terms of the  above<br \/>\norder.\tThe parties bear their own costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Pushpa Aggarwal vs U.P.S.C. &amp; Ors on 20 April, 1999 Author: S.N.
