Mahto.\n\n                               ____\n\nBy the Court :   Since in these four appeals, common question of law and<\/pre>\n<p>           facts are involved, they have been heard together and are disposed<br \/>\n           of by this common judgment.\n<\/p>\n<p>                 These appeals have been filed against the four separate<br \/>\n           judgments and awards dated 07.04.2005 passed by the 1st Addl.<br \/>\n           District Judge-cum- Motor Vehicles Accident Claims Tribunal, East<br \/>\n           Singhbhum, Jamshedpur in Compensation Case Nos. 05\/1999,<br \/>\n           07\/1999,     04\/1999       and   06\/1999,      respectively,     awarding<br \/>\n           compensation to the claimants for the death of all the four<br \/>\n           deceased in one motor vehicle accident.\n<\/p>\n<p>                 The Tribunal after coming to a finding that the deceased<br \/>\n           were gratuitous passengers in the vehicle held that the Insurance<br \/>\n           Company is not liable to pay compensation and accordingly,<br \/>\n           liability was saddled with the appellant, the owner of the vehicle.\n<\/p>\n<p>                 All   the   claim    applications   were    filed   by   the   legal<br \/>\n           representatives of the deceased for grant of compensation.<br \/>\n           According to the claimants, the deceased were traveling in a truck<br \/>\n           as labourers, which was loaded with stone-chips. The said truck<br \/>\n           turned turtle, as a result of which, all the deceased labourers were<br \/>\n           thrown away from the vehicle and sustained injuries. One of the<br \/>\n           deceased, Chhatu Singh came beneath the stone-chips and died<br \/>\n           on the spot. The respondent-owner (appellant herein) of the vehicle<br \/>\n           appeared in all the cases and took plea that the vehicle was duly<br \/>\n           insured with the respondent-Insurance Company covering the<br \/>\n<span class=\"hidden_text\">                              -2-<\/span><\/p>\n<p>liability of the labourers and therefore, the Insurance Company is<br \/>\nliable to pay the compensation amount.\n<\/p>\n<p>      The   respondent-New         India   Insurance   Company   taking<br \/>\nornamental pleadings in the written statement admitted that the<br \/>\noffending truck was insured with its company. But the owner of<br \/>\nthe vehicle has violated the policy-condition by allowing the truck<br \/>\ndriver to drive the vehicle without any valid driving licence.\n<\/p>\n<p>            On the basis of the pleadings of the parties, the<br \/>\ntribunal formulated number of issues and recorded its findings. On<br \/>\nthe issue of driving licence, the respondent -Insurance Company<br \/>\nsubmitted a report of a Surveyor which was marked as Exhibit-A<br \/>\nmentioning therein that there was no driving licence issued in<br \/>\nfavour of the driver, who was driving the vehicle at the relevant<br \/>\ntime. The Tribunal held that Exhibit &#8216;A&#8217; cannot be a conclusive<br \/>\nevidence to show that the driver was not holding any driving<br \/>\nlicence. Moreover, neither the D.T.O was examined nor any reliable<br \/>\nevidence was brought on record for the purpose of arriving at the<br \/>\nconclusion that the driver was not holding a valid driving licence.<br \/>\nThe tribunal therefore held that there is no evidence to show that<br \/>\nthe owner of the truck allowed the driver willfully and knowingly to<br \/>\ndrive the vehicle without any valid driving licence. In other words,<br \/>\nthese issues have been decided against the respondent-Insurance<br \/>\nCompany. Admittedly, against the aforesaid findings, no appeal or<br \/>\ncross objection has been filed by the respondent- Insurance<br \/>\nCompany.\n<\/p>\n<p>      On the issue of liability of the Insurance Company under the<br \/>\ninsurance policy, the tribunal took notice of the evidence adduced<br \/>\nby the claimants&#8217; witnesses, who have deposed that the deceased<br \/>\nwere engaged as labourers in the offending truck by the owner of<br \/>\nthe truck. However, the Tribunal proceeded on the assumption<br \/>\nthat even if the deceased were authorized labourers of the owner of<br \/>\nthe truck, there is no evidence to show that the owner had paid<br \/>\npremium for the said authorized labourers. The Tribunal therefore,<br \/>\nheld that in absence of any premium paid for the labourers<br \/>\nengaged by the owner of the vehicle, the Insurance Company<br \/>\ncannot have any liability.\n<\/p>\n<p>      We first invited Mr. Alok Lal, counsel for the Insurance<br \/>\nCompany to make his submission, who very fairly submitted that<br \/>\nthe vehicle was insured with the respondent-Insurance Company.<br \/>\nHowever, the learned counsel assailed the finding recorded by the<br \/>\nTribunal on the issue of the driver holding a valid driving lincene.<br \/>\nLearned counsel submitted that the finding recorded by the<br \/>\n<span class=\"hidden_text\">                             -3-<\/span><\/p>\n<p>tribunal on the issue of driving licence is erroneous and cannot be<br \/>\nsustained in law. We are afraid such findings can be assailed by<br \/>\nthe respondent without filing any appeal or cross appeal under<br \/>\nOrder 41 Rule 22 C.P.C.\n<\/p>\n<p>      Mr. Alok Lal further submitted that even without filing<br \/>\nappeal, the findings can be reversed by applying the provisions of<br \/>\nOrder 41 Rule 43 C.P.C inasmuch as the appellate court even in<br \/>\nabsence of any appeal can re-appreciate the entire evidences and<br \/>\nthe findings recorded by the Court. We are unable to accept the<br \/>\nsubmission of the learned counsel. We can take notice of the fact<br \/>\nthat the claim cases under the Motor Vehicles Act are to be decided<br \/>\nin a summery proceedings and therefore, in absence of any<br \/>\npleading and evidence brought on record by the Insurance<br \/>\nCompany, the findings recorded by the Tribunal cannot be<br \/>\ninterfered with.\n<\/p>\n<p>      As stated above before the Claims Tribunal, the Insurance<br \/>\nCompany has admitted the insurance of the vehicle but only<br \/>\npleaded that there was violation of policy-condition. There is no<br \/>\npleadings   that   under    the   policy,   the   labourers\/employees<br \/>\nemployed by the owner of a vehicle is not covered because of non<br \/>\npayment of additional premium. From the lower court records, we<br \/>\nfind that the Xerox copy of the insurance policy was filed by the<br \/>\nclaimants- respondent. Since the insurance of the vehicle was not<br \/>\ndisputed, the said policy ought to have been exhibited by the<br \/>\ntribunal by waiving formal proof, for the reasons that the facts<br \/>\nadmitted, need not be proved. We have perused the insurance<br \/>\npolicy which is available in the lower court records. From the<br \/>\nschedule of the policy , it is evidently clear that besides covering<br \/>\nthe liability to the public risk, additional premium of Rs.90\/- was<br \/>\npaid for covering the risk of driver, cleaner and four labourers i.e.<br \/>\nfor six persons&#8217; premium, which was recovered @ of Rs.15\/- per<br \/>\nperson, which was the premium payable at the relevant time.\n<\/p>\n<p>      We can, therefore, safely come to the conclusion that the<br \/>\nlabourers engaged by the owner of the vehicle, who are now<br \/>\ndeceased, were covered under the policy. The findings recorded by<br \/>\nthe Tribunal is, therefore, perverse in law and is based on mis-<br \/>\nappreciation of evidence.\n<\/p>\n<p>      We, therefore, hold that the respondent-Insurance Company<br \/>\nis liable to pay compensation so awarded by the Tribunal.\n<\/p>\n<p>      For the reasons aforesaid, all these appeals are allowed and<br \/>\nthe findings recorded by the tribunal with regard to liability is<br \/>\n<span class=\"hidden_text\">                                          -4-<\/span><\/p>\n<p>               reversed and it is held that the compensation amount shall be paid<br \/>\n               by the respondent-Insurance Company.\n<\/p>\n<p>                     However, we clarify that since only four labourers (Coolies)<br \/>\n               were covered under the policy by payment of additional premium,<br \/>\n               the other claim cases, involving same issue which might have been<br \/>\n               filed by the injured, will not, in any way take the benefit of the<br \/>\n               findings recorded by this Court.\n<\/p>\n<p>                                                                (M.Y.
