Justice V.GIRI\n\n Dated :15\/05\/2009\n\n O R D E R\n                            V.GIRI,J.\n                     -------------------------\n                W.P ( C) No. 13384 of 2009\n                     --------------------------\n               Dated this the 15th May,2009\n\n                       J U D G M E N T\n<\/pre>\n<p>     Petitioner is the Manager of an Aided School.<\/p>\n<p>Pursuant    to  Exhibit-P1     complaint       filed by  the<\/p>\n<p>Headmistress of a nearby Government School, an enquiry<\/p>\n<p>was conducted against the conduct of the 5th respondent,<\/p>\n<p>who is the Headmistress of the petitioner&#8217;s school.<\/p>\n<p>Originally  the  5th   respondent       was     placed under<\/p>\n<p>suspension.    Later, the order of suspension has been<\/p>\n<p>revoked, as evidenced by Exhibit-P12.          This has been<\/p>\n<p>challenged by the petitioner in Exhibit-P13 revision<\/p>\n<p>before the Government. This writ petition has been filed<\/p>\n<p>praying for a direction to consider Exhibit P13 and for<\/p>\n<p>other appropriate reliefs.\n<\/p>\n<p>     2.   A counter affidavit has been filed by the 5th<\/p>\n<p>respondent. Reference is inter alia made to Exhibit R5(e)<\/p>\n<p>order passed by the Deputy Director (Education) under<\/p>\n<p>Rule 67 (8) of Chapter XIV-A, KER ordering that the 5th<\/p>\n<p>W.P ( C) No. 13384 of 2009<br \/>\n<span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>respondent should be deemed to have been on duty from<\/p>\n<p>8.4.2009.\n<\/p>\n<p>      3.      The validity of the order revoking suspension is<\/p>\n<p>pending consideration before the Government. It is only<\/p>\n<p>appropriate that the Government takes a decision in the<\/p>\n<p>matter.\n<\/p>\n<p>      4.      In the result, after hearing counsel on both<\/p>\n<p>sides,    the writ petition is disposed of directing the 1st<\/p>\n<p>respondent to consider and pass orders on Exhibit-P13<\/p>\n<p>within a period of six weeks from the date of receipt of a<\/p>\n<p>copy of this judgment.
