NO. 579 OF 2009 R\n                  --------------------------------------\n                 Dated this the 9th January, 2009\n\n                            JUDGMENT\n<\/pre>\n<p>      Case of the petitioner, in brief, is as follows:<\/p>\n<p>      Petitioner is a contract carriage operator.         Petitioner&#8217;s<\/p>\n<p>establishment is covered by the Employees&#8217; Provident Fund<\/p>\n<p>Scheme. Ext.P1 Certificate is produced. Complaint revolves<\/p>\n<p>around the refusal on the part of the taxing authority to receive<\/p>\n<p>the tax, citing the liability to pay the amounts due under the<\/p>\n<p>Kerala Motor Transport Workers&#8217; Welfare Fund Scheme.<\/p>\n<p>Petitioner had approached this Court earlier and this Court had<\/p>\n<p>delivered Ext.P2 Judgment. Subsequent to the same, according<\/p>\n<p>to petitioner, petitioner has sold three vehicles and purchased<\/p>\n<p>four vehicles.   Petitioner contends that he is entitled to the<\/p>\n<p>immunity from payment under the Kerala Motor Transport<\/p>\n<p>Workers&#8217; Welfare Fund Scheme on account of the establishment<\/p>\n<p>being covered by the Employees&#8217; Provident Fund Act.<\/p>\n<p><span class=\"hidden_text\">WPC.579\/09 R                      2<\/span><\/p>\n<p>      2. I heard the learned counsel appearing for the petitioner,<\/p>\n<p>learned standing counsel appearing on behalf of the Provident<\/p>\n<p>Fund Commissioner as also the learned counsel appearing on<\/p>\n<p>behalf of the fourth respondent besides the learned Government<\/p>\n<p>Pleader. After having heard the learned counsel appearing for<\/p>\n<p>the parties, the Writ Petition is disposed of as follows:<\/p>\n<p>      If the petitioner produces the Attendance Register, Wage<\/p>\n<p>Register\/Salary Acquittance Register and any other document<\/p>\n<p>which the petitioner wishes to produce in support of his claim<\/p>\n<p>that all his employees are covered under the Employees&#8217;<\/p>\n<p>Provident Fund Act before the third respondent at 11 AM on<\/p>\n<p>12.01.2009, the third respondent will look into the same and<\/p>\n<p>issue a communication to the petitioner, if the petitioner is so<\/p>\n<p>entitled, certifying that the petitioner&#8217;s workers are covered by<\/p>\n<p>the Employees&#8217; Provident Fund Act. If such communication is<\/p>\n<p>produced before respondents 1 and 2, there will be a direction to<\/p>\n<p>respondents 1 and 2 to accept the tax without insisting on<\/p>\n<p><span class=\"hidden_text\">WPC.579\/09 R                  3<\/span><\/p>\n<p>payment of any amount under the Kerala Motor Transport<\/p>\n<p>Workers&#8217; Welfare Fund Act.\n<\/p>\n<p>                                         Sd\/=<br \/>\n                                   K.
