Agnihotri, J.\n\n\n\n\n       Dated:29\/03\/2010\n\n\n\n\n:       Judgment\n\n\n                        ORDER (ORAL)\n<\/pre>\n<p>            (Passed on 29th day of  March, 2010)<\/p>\n<p>  1.   Challenge  in  this petition is to  the  order  dated<br \/>\n       17.02.2003 (Annexure P \/2) whereby imposition of punishment<br \/>\n       of removal from service on the father of the petitioner from<br \/>\n       service has been converted to compulsory retirement w.e.f.<br \/>\n       6.7.1985, pursuant to the order dated 17.7.2002 passed by<br \/>\n       the Madhya Pradesh State Administrative Tribunal, Jabalpur<br \/>\n       (for short `the SAT&#8217;) in O.A. No. 393\/1989, and the order<br \/>\n       dated 02.04.2004 (Annexure P\/11) whereby the application of<br \/>\n       the petitioner for grant of compassionate appointment, who<br \/>\n       was the dependent of Late Ramdhan Kashyap, Constable, who<br \/>\n       died on 3.9.2000, was rejected, without assigning any reason<br \/>\n       by the Assistant Inspector General of Police, Raipur.\n<\/p>\n<p>2.   Learned counsel appearing for the petitioner submits<br \/>\nthat the petitioner challenged the order dated 4.7.1985<br \/>\nwhereby his father being a Constable in Police Department,<br \/>\nwas imposed with a punishment of removal from service after<br \/>\nconducting a departmental enquiry, before the SAT. The<br \/>\nlearned SAT after having heard learned counsel for the<br \/>\nparties, came to the conclusion that no interference was<br \/>\nrequired in the findings of the enquiry officer and the<br \/>\ndisciplinary authority on the basis that the same was<br \/>\nperverse and was based on no evidence. Thus, the findings of<br \/>\nthe enquiry officer as well as disciplinary authority was<br \/>\nupheld. However, having regard to the imposition of<br \/>\npunishment of removal from service, it was directed that the<br \/>\nsame may be considered by the authorities, afresh for<br \/>\nmodification of the order of removal from service. Pursuant<br \/>\nto that, the Superintendent of Police, Bilaspur, having<br \/>\nconsidered all the aspects of the matter, modified the order<br \/>\nof dismissal from service to that of compulsory retirement<br \/>\nw.e.f. 6.7.1985.\n<\/p>\n<p>3.   Shri Pandey further submits that there was allegation<br \/>\nof breaking the glass of the door of the Punjab National<br \/>\nBank, Korba, only, which has caused loss for not more than<br \/>\nRs. 125\/-, and thus, imposition of such a punishment is<br \/>\ndisproportionate.\n<\/p>\n<p>4.   On the contrary, Shri Roy, learned counsel appearing<br \/>\nfor the State\/respondents 2, 4, 5 and 6 submits that the<br \/>\nfather of the petitioner was a member of police force<br \/>\nwherein discipline is required. The father of the<br \/>\npetitioner, while misusing his office, exceeded his<br \/>\njurisdiction and broke the glass of the door of the bank and<br \/>\nsuch a person cannot be allowed to continue in police force,<br \/>\nas police force is meant to maintain law and order and peace<br \/>\nin the society. The father of the petitioner took law in its<br \/>\nown hands.\n<\/p>\n<p>5.   On consideration and perusal of the pleadings and<br \/>\ndocuments, contention of Shri Roy merits acceptance. It is<br \/>\nwell settled that a man in uniform is expected to be more<br \/>\ndisciplined as heavy responsibility is on the shoulder of a<br \/>\nmember of police force to maintain law and order and peace<br \/>\nin the society. If a police personnel starts indulging into<br \/>\nbreaking law and order, the civil society may be put in<br \/>\nperil.\n<\/p>\n<p>6.   The Supreme Court, in <a href=\"\/doc\/952007\/\">State of U.P. &amp; Others v. Ashok<br \/>\nKumar Singh &amp;<\/a> another1, observed that a police constable,<br \/>\nserving in disciplined force, which demands strict adherence<br \/>\nto the rules and procedure more than any other department,<br \/>\nin absenting himself from duty without permission, has<br \/>\ncommitted grave misconduct, which has rightly resulted into<br \/>\nremoval from service.\n<\/p>\n<p>7.   Further, in <a href=\"\/doc\/349010\/\">Commissioner of Police v. Syed Hussain2,<br \/>\nthe Supreme Court<\/a> observed that in view of the nature of<br \/>\nduties that a protector of law is required to perform, it<br \/>\ncannot be said that the disciplinary authority had committed<br \/>\nany error imposing the punishment of removal from service<br \/>\nupon the respondent, particularly when on several occasions<br \/>\nhe has been found guilty of misconduct.\n<\/p>\n<p>8.   Further contention of Shri Pandey that the reasons<br \/>\nstated by the Assistant Inspector General of Police, vide<br \/>\nits order dated 02.4.2004 (Annexure P\/11) that the father of<br \/>\nthe petitioner died before creation of the State of<br \/>\nChhattisgarh, thus, the application of the petitioner for<br \/>\ngrant of compassionate appointment cannot be considered, is<br \/>\nbad in law, unjust and illegal.\n<\/p>\n<p>9.   Shri Roy, learned Panel Lawyer, in response submits<br \/>\nthat it is not the case of death of an employee in harness.<br \/>\nThe father of the petitioner died on 03.09.2000 and he was<br \/>\ncompulsorily retired from service on 06.07.1985. The<br \/>\npetitioner was initially terminated from service and<br \/>\nthereafter, on reconsideration, was retired compulsorily.<br \/>\nThus, the petitioner is not entitled as his father did not<br \/>\ndie in harness.\n<\/p>\n<p>10.  It is well settled that only those cases may be<br \/>\nconsidered for grant of appointment on compassionate basis<br \/>\nwhere an employee dies in harness as the sole purpose of<br \/>\ngranting compassionate appointment is to provide immediate<br \/>\nrelief and succor to the penurious family in distress.<br \/>\nAppointment on compassionate ground is not a method of<br \/>\nrecruitment, but is a facility to provide for immediate<br \/>\nrehabilitation of the family in distress for relieving the<br \/>\ndependent family members of the deceased employee from<br \/>\ndestitution. In other words, the object of compassionate<br \/>\nappointment is to enable penurious family to  tide over the<br \/>\nsudden financial crisis and is not to provide employment.<br \/>\n(See : Haryana State Electricity Board and another v. <a href=\"\/doc\/346840\/\">Hakim<br \/>\nSingh3, State of Manipur v. Md. Rajaodin4, and State of J &amp;<br \/>\nK and others<\/a> v. Sajad Ahmed Mir5 ).\n<\/p>\n<p>11.  In view of the foregoing and for the reasons stated<br \/>\nhereinabove, no relief can be granted to the petitioner at<br \/>\nthis stage. Accordingly, the writ petition is dismissed.\n<\/p>\n<p>  12.
