Justice V.GIRI\n\n Dated :01\/07\/2009\n\n O R D E R\n                          V.GIRI, J\n                        -------------------\n               W.P.(C)s.12508 &amp;15799\/2009\n                        --------------------\n             Dated this the 1st day of July, 2009\n\n                        JUDGMENT\n<\/pre>\n<p>      Common issues have arisen for consideration in<\/p>\n<p>these two writ petitions. Therefore, they have been heard<\/p>\n<p>together and are being disposed of by a common<\/p>\n<p>judgment. I will refer to the facts in W.P.(C).12508\/2009<\/p>\n<p>for the sake of convenience.\n<\/p>\n<\/p>\n<p>2.    Petitioners aged 70 and 64 belong to Muslim<\/p>\n<p>Community and are desirous of proceeding on Haj.<\/p>\n<p>Government Of India subsidizes travel and other facilities<\/p>\n<p>for pilgrims who are desirous of proceeding on such<\/p>\n<p>pilgrimage every year. Number of pilgrims doing so are<\/p>\n<p>numerous.     Therefore, a system has been devised by<\/p>\n<p>which taking Muslim population in each State       as the<\/p>\n<p>basis, total number of         seats have been apportioned<\/p>\n<p>among the States.\n<\/p>\n<\/p>\n<p>3.    Accordingly, going by the statement filed by the<\/p>\n<p>learned Assistant Solicitor General, 7003 is the     quota<\/p>\n<p>allotted to the State of Kerala. Total number of applicants<\/p>\n<p>W.P.(C).12508 &amp; 15799\/09<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>within the State is 44706.     Respondents contend that<\/p>\n<p>since the number of persons who apply far outnumber the<\/p>\n<p>total number of seats available as a quota, a system has<\/p>\n<p>been devised by which       drawal of lots on line     was<\/p>\n<p>resorted to, in the present year also. A list is prepared<\/p>\n<p>showing the names of chosen persons.            Petitioners&#8217;<\/p>\n<p>applications were also considered but they proved to be<\/p>\n<p>unfortunate at the time of drawal. They have approached<\/p>\n<p>this Court not only challenging the system by which<\/p>\n<p>persons are chosen by drawal of lots but also against the<\/p>\n<p>Government not providing adequate safeguards to see<\/p>\n<p>that persons, who had already proceeded on Haj earlier,<\/p>\n<p>are still not prevented from repeating their pilgrimage, to<\/p>\n<p>the disadvantage of those persons who have not been<\/p>\n<p>fortunate to be selected even once.\n<\/p>\n<\/p>\n<p>4.   Petitioner in Writ Petition No.15799\/2009 is an 81<\/p>\n<p>year old senior citizen. He has also adopted the same<\/p>\n<p>contention. He further contends that the system should<\/p>\n<p>definitely provide for at least a minimum reservation in<\/p>\n<p>favour of aged persons, aged above 70, so that, they do<\/p>\n<p>not have to stand in a queue along with other persons,<\/p>\n<p>W.P.(C).12508 &amp; 15799\/09<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>who for natural reasons would have a longer time frame,<\/p>\n<p>to proceed on Haj.\n<\/p>\n<\/p>\n<p>5.   I heard Mr.M.V.Bose and Mr.Abdul Hakhim, learned<\/p>\n<p>counsel for the petitioners and the learned ASG. I have<\/p>\n<p>perused the statement filed by the ASG in detail.<\/p>\n<p>6.   The system adopted by the         1st respondent for<\/p>\n<p>choosing persons to proceed on Haj as sponsored by the<\/p>\n<p>Government of India, cannot in the circumstances, be<\/p>\n<p>treated as an arbitrary one.       After all,   number of<\/p>\n<p>applicants far outnumber the seats that are allotted to the<\/p>\n<p>State and in such circumstances, a non arbitrary method<\/p>\n<p>will have to be adopted. The system of drawal of lots on<\/p>\n<p>line cannot be considered as an arbitrary procedure,<\/p>\n<p>which is bound to result in an unfair selection. Therefore,<\/p>\n<p>I am unable to accept the contention that some other<\/p>\n<p>system should be adopted. At any rate, the 1st respondent<\/p>\n<p>a statutory body, has only implemented the policies of the<\/p>\n<p>Government. This Court would be reluctant to interfere<\/p>\n<p>unless there is a statutory infraction or non adherence to<\/p>\n<p>any constitutional provisions. I do not find any reason to<\/p>\n<p>W.P.(C).12508 &amp; 15799\/09<br \/>\n<span class=\"hidden_text\">                              4<\/span><\/p>\n<p>interfere with the system adopted in this regard.<\/p>\n<p>7.   But I find force      in the submission made by the<\/p>\n<p>counsel for the petitioners that      by its very nature,<\/p>\n<p>sponsorship given by the Government should provide for<\/p>\n<p>at least a limited reservation in favour of persons who<\/p>\n<p>have crossed the age of 70. The average life expectancy<\/p>\n<p>in India could be taken as a safe indicator in this regard<\/p>\n<p>and it may be unfair to group persons who are at the age<\/p>\n<p>of 50, 60, 70 and 80 together and subject them to a<\/p>\n<p>drawal of lots, either there must be a separate quota for<\/p>\n<p>persons depending upon their age, segregating them in<\/p>\n<p>different groups as such or there must be a reasonable<\/p>\n<p>reservation in favour of persons who have crossed the<\/p>\n<p>age of 70.       Going by the stand as reflected in the<\/p>\n<p>statement filed by the ASG, I am of the view that the<\/p>\n<p>provision for reservation which was adopted in favour of<\/p>\n<p>persons who have crossed the age of 70, implemented in<\/p>\n<p>the year 2007, ought not to have been scrapped for the<\/p>\n<p>subsequent years.        If there is an inadequacy in the<\/p>\n<p>system,    same should have been addressed.       Wisdom<\/p>\n<p>behind adopting reservation of a specific number of seats<\/p>\n<p>W.P.(C).12508 &amp; 15799\/09<br \/>\n<span class=\"hidden_text\">                              5<\/span><\/p>\n<p>for persons who have crossed the age of 70, is not open to<\/p>\n<p>doubt and therefore, any           teething problems the<\/p>\n<p>Government might have faced in the year 2007, ought<\/p>\n<p>not have persuaded the       Government to straight away<\/p>\n<p>scrap the system.       So also, going by   the number of<\/p>\n<p>applicants and the limited number of seats available, a<\/p>\n<p>larger period should have been adopted in relation to<\/p>\n<p>which persons, who have already proceeded on Haj under<\/p>\n<p>the sponsorship of the Government, should be omitted to<\/p>\n<p>be considered when they apply again. It is now stated<\/p>\n<p>that persons who have proceeded on Haj, during the last<\/p>\n<p>five years, will not be considered for the year 2009. A<\/p>\n<p>longer period should form a safer basis considering the<\/p>\n<p>fact that number of applications are six times the number<\/p>\n<p>of seats available. But I do not think that this revision<\/p>\n<p>should be made applicable for the year 2009, going by<\/p>\n<p>the fact that the chosen persons will have to proceed on<\/p>\n<p>Haj within the next few weeks. Accordingly, writ petitions<\/p>\n<p>are disposed of with the following directions.<\/p>\n<p>       (i).  Respondents shall take note of the<\/p>\n<p>       observations made above, and lay down the<\/p>\n<p>       policy and guidelines relating to choosing the<\/p>\n<p>W.P.(C).12508 &amp; 15799\/09<br \/>\n<span class=\"hidden_text\">                               6<\/span><\/p>\n<p>       persons      permitted to proceed on        Haj<\/p>\n<p>       pilgrimage as sponsored by the Government.<\/p>\n<p>       The    scheme     shall  either   provide    for<\/p>\n<p>       conducting selection on the basis of the age<\/p>\n<p>       or at least, provide for a reservation in favour<\/p>\n<p>       of persons who have crossed the age of 70.<\/p>\n<p>       (ii). Respondents shall also consider       and<\/p>\n<p>       provide a period longer than five years, as a<\/p>\n<p>       period during which an eligible applicant<\/p>\n<p>       should not have already proceeded on Haj<\/p>\n<p>       under the Sponsorship of the Government.
