      Common issues have arisen for consideration in<\/p>\n
these two writ petitions. Therefore, they have been heard<\/p>\n
together and are being disposed of by a common<\/p>\n
judgment. I will refer to the facts in W.P.(C).12508\/2009<\/p>\n
for the sake of convenience.\n<\/p>\n<\/p>\n
2.    Petitioners aged 70 and 64 belong to Muslim<\/p>\n
Community and are desirous of proceeding on Haj.<\/p>\n
Government Of India subsidizes travel and other facilities<\/p>\n
for pilgrims who are desirous of proceeding on such<\/p>\n
pilgrimage every year. Number of pilgrims doing so are<\/p>\n
numerous.     Therefore, a system has been devised by<\/p>\n
which taking Muslim population in each State       as the<\/p>\n
basis, total number of         seats have been apportioned<\/p>\n
among the States.\n<\/p>\n<\/p>\n
3.    Accordingly, going by the statement filed by the<\/p>\n
learned Assistant Solicitor General, 7003 is the     quota<\/p>\n
allotted to the State of Kerala. Total number of applicants<\/p>\n

\n                             2<\/span><\/p>\n
within the State is 44706.     Respondents contend that<\/p>\n
since the number of persons who apply far outnumber the<\/p>\n
total number of seats available as a quota, a system has<\/p>\n
been devised by which       drawal of lots on line     was<\/p>\n
resorted to, in the present year also. A list is prepared<\/p>\n
showing the names of chosen persons.            Petitioners’<\/p>\n
applications were also considered but they proved to be<\/p>\n
unfortunate at the time of drawal. They have approached<\/p>\n
this Court not only challenging the system by which<\/p>\n
persons are chosen by drawal of lots but also against the<\/p>\n
Government not providing adequate safeguards to see<\/p>\n
that persons, who had already proceeded on Haj earlier,<\/p>\n
are still not prevented from repeating their pilgrimage, to<\/p>\n
the disadvantage of those persons who have not been<\/p>\n
fortunate to be selected even once.\n<\/p>\n<\/p>\n
4.   Petitioner in Writ Petition No.15799\/2009 is an 81<\/p>\n
year old senior citizen. He has also adopted the same<\/p>\n
contention. He further contends that the system should<\/p>\n
definitely provide for at least a minimum reservation in<\/p>\n
favour of aged persons, aged above 70, so that, they do<\/p>\n
not have to stand in a queue along with other persons,<\/p>\n

who for natural reasons would have a longer time frame,<\/p>\n
to proceed on Haj.\n<\/p>\n<\/p>\n
5.   I heard Mr.M.V.Bose and Mr.Abdul Hakhim, learned<\/p>\n
counsel for the petitioners and the learned ASG. I have<\/p>\n
perused the statement filed by the ASG in detail.<\/p>\n
6.   The system adopted by the         1st respondent for<\/p>\n
choosing persons to proceed on Haj as sponsored by the<\/p>\n
Government of India, cannot in the circumstances, be<\/p>\n
treated as an arbitrary one.       After all,   number of<\/p>\n
applicants far outnumber the seats that are allotted to the<\/p>\n
State and in such circumstances, a non arbitrary method<\/p>\n
will have to be adopted. The system of drawal of lots on<\/p>\n
line cannot be considered as an arbitrary procedure,<\/p>\n
which is bound to result in an unfair selection. Therefore,<\/p>\n
I am unable to accept the contention that some other<\/p>\n
system should be adopted. At any rate, the 1st respondent<\/p>\n
a statutory body, has only implemented the policies of the<\/p>\n
Government. This Court would be reluctant to interfere<\/p>\n
unless there is a statutory infraction or non adherence to<\/p>\n
any constitutional provisions. I do not find any reason to<\/p>\n

interfere with the system adopted in this regard.<\/p>\n
7.   But I find force      in the submission made by the<\/p>\n
counsel for the petitioners that      by its very nature,<\/p>\n
sponsorship given by the Government should provide for<\/p>\n
at least a limited reservation in favour of persons who<\/p>\n
have crossed the age of 70. The average life expectancy<\/p>\n
in India could be taken as a safe indicator in this regard<\/p>\n
and it may be unfair to group persons who are at the age<\/p>\n
of 50, 60, 70 and 80 together and subject them to a<\/p>\n
drawal of lots, either there must be a separate quota for<\/p>\n
persons depending upon their age, segregating them in<\/p>\n
different groups as such or there must be a reasonable<\/p>\n
reservation in favour of persons who have crossed the<\/p>\n
age of 70.       Going by the stand as reflected in the<\/p>\n
statement filed by the ASG, I am of the view that the<\/p>\n
provision for reservation which was adopted in favour of<\/p>\n
persons who have crossed the age of 70, implemented in<\/p>\n
the year 2007, ought not to have been scrapped for the<\/p>\n
subsequent years.        If there is an inadequacy in the<\/p>\n
system,    same should have been addressed.       Wisdom<\/p>\n
behind adopting reservation of a specific number of seats<\/p>\n

for persons who have crossed the age of 70, is not open to<\/p>\n
doubt and therefore, any           teething problems the<\/p>\n
Government might have faced in the year 2007, ought<\/p>\n
not have persuaded the       Government to straight away<\/p>\n
scrap the system.       So also, going by   the number of<\/p>\n
applicants and the limited number of seats available, a<\/p>\n
larger period should have been adopted in relation to<\/p>\n
which persons, who have already proceeded on Haj under<\/p>\n
the sponsorship of the Government, should be omitted to<\/p>\n
be considered when they apply again. It is now stated<\/p>\n
that persons who have proceeded on Haj, during the last<\/p>\n
five years, will not be considered for the year 2009. A<\/p>\n
longer period should form a safer basis considering the<\/p>\n
fact that number of applications are six times the number<\/p>\n
of seats available. But I do not think that this revision<\/p>\n
should be made applicable for the year 2009, going by<\/p>\n
the fact that the chosen persons will have to proceed on<\/p>\n
Haj within the next few weeks. Accordingly, writ petitions<\/p>\n
are disposed of with the following directions.<\/p>\n
       (i).  Respondents shall take note of the<\/p>\n
       observations made above, and lay down the<\/p>\n
       policy and guidelines relating to choosing the<\/p>\n

       persons      permitted to proceed on        Haj<\/p>\n
       pilgrimage as sponsored by the Government.<\/p>\n
       The    scheme     shall  either   provide    for<\/p>\n
       conducting selection on the basis of the age<\/p>\n
       or at least, provide for a reservation in favour<\/p>\n
       of persons who have crossed the age of 70.<\/p>\n
       (ii). Respondents shall also consider       and<\/p>\n
       provide a period longer than five years, as a<\/p>\n
       period during which an eligible applicant<\/p>\n
       should not have already proceeded on Haj<\/p>\n
       under the Sponsorship of the Government. A<\/p>\n
       revised scheme, brought into force in the<\/p>\n
       year    2010     onwards    shall  reflect   the<\/p>\n
       directions issued herein.\n<\/p>\n
     Petitioners shall produce a copy of this judgment<\/p>\n
before the respondents.\n<\/p>\n<\/p>\n
