SHAHPUR,\nDISTRICT BHOJPUR AT PRESENT RESIDING AT JAGARNATH GUPTA JAI\nBAZAR, BIHIYA, THAKURBARI ROAD, BIHIYA, DISTRICT BHOJPUR\n                                                             -----PETITIONERS\n                                   Versus\nTHE STATE OF BIHAR-----------------------------------------------OPP.PARTY\n                                 -----------\n<\/pre>\n<p>3.   23.02.2011           Heard learned counsel for the petitioners and learned<\/p>\n<p>                        A.P.P. for the State.\n<\/p>\n<p>                                The petitioners being the mother and the brothers of<\/p>\n<p>                        the husband are apprehending their arrest in a police case<\/p>\n<p>                        registered under Sections 143, 341, 323, 498A of the<\/p>\n<p>                        Indian Penal Code and Sections 3\/4 of the Dowry<\/p>\n<p>                        Prohibition Act.\n<\/p>\n<p>                                It is submitted by learned counsel for the petitioners<\/p>\n<p>                        that the husband&#8217;s bail application is pending before the<\/p>\n<p>                        learned court below.\n<\/p>\n<p>                                It is submitted by learned counsel for the informant<\/p>\n<p>                        that Rs.4000\/- as maintenance has been awarded for the<\/p>\n<p>                        informant and her minor son but the same is not being<\/p>\n<p>                        paid.\n<\/p>\n<p>                                Learned counsel for the petitioners undertakes that<\/p>\n<p>                        the husband will make the payment of the maintenance<br \/>\n<span class=\"hidden_text\">                         2<\/span><\/p>\n<p>        amount from March, 2009 by depositing the same in the<\/p>\n<p>        account of the informant till the order of maintenance is<\/p>\n<p>        modified or annulled by any superior court.<\/p>\n<p>              The informant will supply the bank account number<\/p>\n<p>        to the husband within a period of ten days.<\/p>\n<p>              In view of the aforesaid stand, let the petitioners,<\/p>\n<p>        namely, Smt. Gulabo Kunwar, Ajay Kumar Mishra and<\/p>\n<p>        Anjay Mishra @ Rajesh Mishra, in the event of their arrest<\/p>\n<p>        or surrender in the court below, be released on bail on<\/p>\n<p>        furnishing bail bond of Rs.10,000\/- (Rupees ten thousand)<\/p>\n<p>        each with two sureties of the like amount each to the<\/p>\n<p>        satisfaction of Chief Judicial Magistrate, Buxar, in<\/p>\n<p>        Brahmpur P.S.case No. 179\/2010, subject to the conditions<\/p>\n<p>        as laid down under Section 438(2) of the Code of Criminal<\/p>\n<p>        Procedure.\n<\/p>\n<\/p>\n<p>                                 (Dinesh Kumar Singh,J.)<\/p>\n<p>Spal\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Smt.
