Rule.\n<\/p>\n
\tLearned APP, Mr. R.C. Kodekar, waives service of notice of rule on
\n\tbehalf of State.\n<\/p>\n
By
\n\tthis application under Section 438 of the Code of Criminal
\n\tProcedure, the accused-applicant has prayed for anticipatory bail in
\n\tconnection with CR No. I-17\/10 registered with  Gandhinagar Police
\n\tStation, C.I.D. Crime, Ahmedabad, Rural  for the offences punishable
\n\tunder Sections   406, 420, 467, 468, 471 and 120B of Indian Penal
\n\tCode.\n<\/p>\n
I
\n\thave heard learned Sr. Advocate, Mr. P.M. Thakkar with Mr.N.A. Dave
\n\tfor the accused-applicant and learned APP, Mr. R.C. Kodekar for the
\n\trespondent-State. I have also heard Mr. R.J. Goswami, learned
\n\tadvocate appearing on behalf of the first informant.\n<\/p>\n
Case
\n\tof the prosecution as per the FIR filed by one Khodaji Javanji
\n\tParmar against five accused persons including the present applicant
\n\tis that each of the accused persons, in collusion with each other
\n\thatched a conspiracy to illegally grab the land of the first
\n\tinformant bearing survey no. 925\/1. If we go by the  case of the
\n\tprosecution, a deal of the said land was finalized for sale
\n\tconsideration of Rs. 30.00 lakhs at the rate of Rs. 8501 per sq.mt.
\n\tIt is admitted that the sum of Rs. 20.00 lakhs was paid in cash and
\n\tbalance amount was paid by way of cheque. In this regard, a kachcha
\n\tchitthi was also prepared. It is further alleged in the FIR that
\n\tthereafter, on stamp paper of Rs. 100\/- a memorandum of
\n\tunderstanding was executed and revenue stamp which was pasted on the
\n\tkachcha chitthi  is said to have been removed and pasted on the
\n\tmemorandum of understanding. In this manner, it is alleged that
\n\tcertain other parcels of land of the ownership of the first
\n\tinformant are also said to have been agreed to be sold for total
\n\tsale consideration of Rs.13 crores and 51 lakhs.\n<\/p>\n
Having
\n\tregard to the rival contentions of the respective counsel and having
\n\tconsidered the case of the prosecution and the allegations against
\n\tthe accused-applicant, I am inclined to exercise my discretion in
\n\tfavour of the accused-applicant considering the following aspects:\n<\/p>\n
[a]\tPrima
\n\tfacie it appears that the allegations are against accused no.1
\n\thaving prepared forged documents and it appears that the case
\n\tagainst the present applicant is  that he was in the company of the
\n\toriginal accused.\n<\/p>\n
[b]\tMost
\n\timportantly, Special Civil Suit No. 326 of 2009 was filed on 28th
\n\tJuly, 2009 by the original accused
\n\tno.1 against the first informant  for specific
\n\tperformance based on the said alleged forged document.\n<\/p>\n
[c]\tThe
\n\tcourt is informed that written statement is also filed by the first
\n\tinformant in the said suit alleging what is stated in the FIR. This
\n\twas way back in the year 2009 and after about one year, FIR is
\n\tlodged which is registered in 2010.\n<\/p>\n
[d]\tThe
\n\taccused is a local resident of Ahmedabad and is serving at local
\n\tcompany. He has roots in the society. The case is essentially based
\n\ton documentary evidence.\n<\/p>\n
[e]\tOne
\n\tof the co-accused has been released on anticipatory bail by the
\n\tSessions Court having regard to his role.\n<\/p>\n
In
\n\tthis view of the matter, interest of justice would be served if
\n\taccused is ordered to be released on anticipatory bail subject to
\n\tcertain terms and conditions.\n<\/p>\n
In
\n\tthis view of the matter, accused-applicant is ordered to be enlarged
\n\ton anticipatory bail in the event of his arrest in connection with
\n\tCR No. I-17\/2010 registered with Gandhinagar Police Station, C.I.D.
\n\tCrime, Ahmedabad Rural.  He shall be released on bail on furnishing
\n\ta bond of Rs.15,000\/-(Rupees Fifteen Thousand Only) with one surety
\n\tof like amount on following conditions that he:\n<\/p>\n
(A)\tshall
\ncooperate with the investigation and make himself available for
\ninterrogation whenever required.\n<\/p>\n
(B)\tshall
\nremain present before the IO at the concerned police station on 19th
\nMay, 2011 between 9.00 a.m. to 2.00 p.m. and thereafter mark presence
\non 2nd
\nand 4th
\nSaturday of every English calendar month at the concerned police
\nstation.\n<\/p>\n
(C)\tshall
\nnot hamper the investigation in any manner nor shall directly or
\nindirectly make any inducement, threat or promise to any witness so
\nas to dissuade them from disclosing such facts to the Court or to any
\nPolice Officer;\n<\/p>\n
(D)\tshall
\nat the time of execution of bond, furnish the address to the
\nInvestigating Officer and the Court concerned and shall not change
\nthe residence till the final disposal of the case or till further
\norders;\n<\/p>\n
(E)\twill
\nnot leave India without the permission of the Court and if is holding
\na passport, shall surrender the same before the trial Court within a
\nweek;\n<\/p>\n
(F)\tIt
\nwould be open to the Investigating Officer to file an application for
\nremand, if he considers it just and proper and the concerned
\nMagistrate would decide it on merits.\n<\/p>\n
It
\n\twould be open for the Investigating Agency to apply to the competent
\n\tMagistrate, for police remand of the applicant. The applicant shall
\n\tremain present before the learned Magistrate on the first date of
\n\thearing on such application and on all subsequent occasion, as may
\n\tbe directed by the learned Magistrate. This would be sufficient to
\n\ttreat the accused in the judicial custody for the purpose of
\n\tentertaining application of the prosecution for police remand. This
\n\tis, however, without prejudice to the right of the accused to seek
\n\tstay against an order of remand, if ultimately granted, and the
\n\tpower of the learned Magistrate to consider such a request in
\n\taccordance with law. It is clarified that the applicant, even if is
\n\tremanded to the police custody upon completion of such period of
\n\tpolice remand, shall be set free immediately, subject to other
\n\tconditions of this anticipatory bail order.\n<\/p>\n
With
\n\tthese directions, application is allowed. Rule is made absolute.
\n\tDirect service is permitted<\/p>\n
