Whether the judgment should be reported in the Digest?\n\n\nAjay Tewari, J.\n<\/pre>\n<p>             The petitioner&#8217;s husband was working as a Junior Engineer with<\/p>\n<p>the respondents since 2.12.1981 on regular basis. On 24.06.1991, having<\/p>\n<p>been transferred, he left his house to join duties at his fresh place of posting<\/p>\n<p>and did not reach there. He has admittedly been missing since then. The<\/p>\n<p>petitioner also filed a civil suit for declaration that her husband had died<\/p>\n<p>which was decreed by the Civil Court on 19.5.2007. By this petition the<\/p>\n<p>petitioner has sought the family pension on account of the death of her<\/p>\n<p>husband while in service. It is being resisted on two grounds. Firstly, it is<\/p>\n<p>stated that due to absence the services of the husband of the petitioner were<\/p>\n<p>terminated by order dated 03.10.2001. In my opinion that order pales into<br \/>\n<span class=\"hidden_text\"> CWP No. 11538 of 2008                  -2-<\/span><\/p>\n<p>insignificance after decree of the Civil Court declaring that the petitioner<\/p>\n<p>has been missing since 24.06.1991 and hence shall be declared to have been<\/p>\n<p>dead on 23.6.1998. Any order of termination of service without keeping<\/p>\n<p>this factor in mind would necessarily be of no avail. The second ground<\/p>\n<p>taken is that in the suit for declaration the State of Haryana was not<\/p>\n<p>impleaded. Nothing has been shown to support the proposition that the<\/p>\n<p>State of Haryana was either a necessary or proper party especially when the<\/p>\n<p>Gram Panchayat was impleaded.\n<\/p>\n<p>             In the circumstances this writ petition is allowed and the<\/p>\n<p>respondents are directed to compute the family pension and to release the<\/p>\n<p>arrears thereof within a period of three months from the date of receipt of a<\/p>\n<p>certified copy of this order. In case the same is not done then the said<\/p>\n<p>amount would carry interest at the rate of 8% p.a. from the deemed date of<\/p>\n<p>death i.e. 23.6.1998.
