 ORAL JUDGEMENT<\/p>\n
      The petitioner came to be detained by virtue of
\n      an order dated 26th July, 2001 passed by the Commissioner
\n of Police, Ahmedabad City, Ahmedabad in exercise of power
\nunder Section 3 of the PASA Act. The petitioner seeks to
\nchallenge the said order by this petition under Article
\n226 of the of Constitution of India.\n<\/p>\n
2.The   grounds of detention indicate that the
\npetitioner has been branded as a boot-legger.        The
\ndetaining   authority   has considered four registered
\noffences against the detenu under the Bombay Prohibition
\nAct.    The   detaining authority has also considered
\nstatements of two anonymous witnesses and recorded a
\nsatisfaction that powers under Section 9(2) of the Act
\nare required to be exercised in larger public interest.
\nThe detaining authority recorded a satisfaction that the
\npetitioner is required to be immediately prevented from
\npursuing his illegal and anti-social activities and
\nresorting to less drastic remedy under ordinary law is
\nnot possible as immediate prevention is necessary and
\ntherefore, passed the order in exercise of powers under
\nSection 3 of the PASA Act.\n<\/p>\n
3.Learned Advocate Mr.    Raval submitted that last
\nregistered offence is of 14.4.2001, whereas the order is
\npassed on 26.7.2001 i.e. after a period of more than 3
\nmonths and 12 days and the live-link between the activity
\nof the petitioner and the order is snapped.   The second
\nfold of contention of Mr. Raval is that the detaining
\nauthority has exercised the power under Section 9(2) of
\nwith-holding the name of the anonymous witnesses without
\nany basis. He submitted that the satisfaction recorded
\nby the detaining authority about the genuineness and
\ncorrectness of the fear expressed by the witnesses qua
\nthe    detenu  is recorded without undertaking proper
\nexercise. The verification is done in a mechanican
\nmanner as a formality. The exercise of power therefore
\nhas infringed the right of the petitioner guaranteed
\nunder Article 22(5) of the Constitution of India and the
\ncontinued detention of the detenu therefore would be
\nillegal.    He therefore urged that the petition may be
\nallowed and the impugned order may be quashed and set
\naside.\n<\/p>\n
4.Learned AGP Mr.   D.P.   Joshi   has   opposed   this
\npetition.\n<\/p>\n
5.Having regard to the contentions raised, at the
\nout-set it would be noted that there is no material to
\nindicate that the detaining authority has undertaken
\nproper exercise of verification of the fear expressed by
\nthe anonymous witnesses qua      the   detenu  and   its
\ngenuineness.   There is nothing to indicate that any
\n exercise except calling the witnesses was undertaken by
\nthe authority.    As observed by this Court in Bai Amina
\nw\/o Ibrahim Abdul Rahim Alla Vs.      State of Gujarat,
\nreported in 1981 GLR 1186, the authority is expected to
\nconsider the general background, character, antecedents,
\ncriminal tendency or propensity, etc. of the detenu and
\nsuch of those matters as are relevant in the context of
\nthe   informant must be enquired into and carefully
\nexamined by the detaining authority with a view to
\nsatisfying itself that the alleged apprehension is not
\nimaginary or fanciful or that it is not merely an empty
\nexcuse invented by the informant, inter alie, to protect
\nhimself against the falsity of his version being exposed
\nby an effective explanation of the detenu or to hide his
\nown involvement or to conceal his enmity with the detenu.
\nIn this regard, decisions in the case of Kajalben G.
\nSindhi Vs. Commissioner of Police, Ahmedabad, reported in
\n2000 (2) GLR 1296 and Israil @ Israr Pahelvan Nazirahmed
\nShaikh Vs. State of Gujarat – 2001 (1) GLR 306 can be
\nprofitably be employed.\n<\/p>\n
5.1In order to meet with this requirement, the
\ndetaining authority would be required to undertake a
\nfurther exercise in addition to examining the anonymous
\nwitnesses.    There is nothing to indicate that such an
\nexercise is undertaken.     A witness who has      stated
\nsomething before the sponsoring authority is bound to
\nstick to his version before the detaining authority when
\nhe is summoned for verification, but what is stated by
\nhim is correct and genuine or not can be tested only
\nafter his version is cross-checked through other sources
\nby undertaking further exercise. That having not been
\ndone, the subjective satisfaction cannot be said to have
\nbeen recorded on the basis of any material and therefore,
\nthere is improper exercise of power under Section 9(2) of
\nthe PASA Act.\n<\/p>\n
6.So far as the registered offences are concerned,
\nthey relate to 21st of Nov. 2000, 25th March, 2001 and
\n14th April, 2001. The order is passed on 26th July, 2001
\nand as such the live-link between the activity and the
\norder can be considered to have snapped as the order is
\npassed after more than 3 months. The satisfaction of the
\nauthority about continuation of illegal activity by the
\ndetenu therefore cannot be       considered as   genuine
\nparticularly when the statements cannot be relied upon
\nfor the reasons discussed above.\n<\/p>\n
7.For the reasons stated hereinabove, the petition
\ndeserves to be allowed and the same is allowed. Order of
\ndetention dated 26.7.2001 passed by the Commissioner of
\n       Police, Ahmedabad City is quashed and set aside. Detenu
\n      Parul @ Parvatiben widow of Ambalal Maganbhai Mena
\n      (Lodha) be released from detention forthwith, if not
\n      required in any other case.  Rule made absolute.     No
\n      costs. Direct service permitted.\n<\/p>\n
