Appeal No.167 of 1999<\/p>\n<p>                     &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8211;\n<\/p>\n<p>            Dated this the 14th day of February, 2007<\/p>\n<p>                                Judgment<\/p>\n<p>            This   appeal   is   filed   against   the   order   of<\/p>\n<p>acquittal.        Notice   was   ordered   on   8.3.1999,   but,   no<\/p>\n<p>effective   steps   were   taken   to   serve   notice   on   the   accused.\n<\/p>\n<p>On 18.10.2006, this court granted a week&#8217;s time to cure the<\/p>\n<p>defect  and  for  taking  fresh  steps  as  last  chance.    So  far,<\/p>\n<p>no steps were taken.   Without service of notice and hearing<\/p>\n<p>the   accused,   an   order   of   acquittal   cannot   be   reversed.\n<\/p>\n<p>Therefore, non-taking of effective steps for serving notice<\/p>\n<p>on   the   accused   is   itself   a   ground   for   dismissing   the<\/p>\n<p>appeal.     However,   since   this   is   a   criminal   appeal,   I   have<\/p>\n<p>also   gone   through   the   merits   of   the   case.     Case   of   the<\/p>\n<p>complainant   was   that   accused   has   issued   cheque   for<\/p>\n<p>Rs.1,25,000\/- to him to discharge an existing liability and<\/p>\n<p>the   cheque   was   presented   before   the   bank   for   collection,<\/p>\n<p>but,   it   was   dishonoured   for   insufficiency   of   funds.\n<\/p>\n<p>Therefore,   he   approached   the   Magistrate&#8217;s   court   after<\/p>\n<p>completing   the   statutory   formalities.     Accused   denied   the<\/p>\n<p>transaction.     The   complainant   who   was   examined   as   PW3   was<\/p>\n<p>not   able   to   prove   before   the   court   when   and   how   the<\/p>\n<p>liability   occurred.     According   to   him,   he   paid   the   amount<\/p>\n<p>to   the   accused   by   withdrawing   the   said   amount   from   the<\/p>\n<p>District   Co-operative   Bank   Limited,   Kumaramangalam   Branch.\n<\/p>\n<p>PW1   on   behalf   of   the   District   Co-operative   Bank   Limited<\/p>\n<p>gave   evidence   that   there   is   no   branch   at   Kumaramangalam.\n<\/p>\n<p>DW1   is   one   of   the   directors   of   the   District   Co-operative<\/p>\n<p>Bank   Limited.     Ext.D1   is   the   list   of   branches   of   the<\/p>\n<p>District Co-operative Bank Limited.   Therefore, trial court<\/p>\n<p>found   that   the   version   of   the   complainant   that   he   took<\/p>\n<p>Rs.1,25,000\/-   from   the   Kumaramangalam   branch   of   the<\/p>\n<p>District Co-operative Bank Limited and gave the same to the<\/p>\n<p>accused   is   unbelievable.     According     to   the   accused,   no<\/p>\n<p>amount   was   due   by   him   to   the   complainant.     According   to<\/p>\n<p>him,   Ext.P1   blank   cheque   was   issued   to   the   complainant   on<\/p>\n<p>the   understanding   that   the   complainant   will   take   necessary<\/p>\n<p>steps   for   the   reinstatement   of   the   accused   who   was   under<\/p>\n<p>suspension at that time.   It is admitted by the complainant<\/p>\n<p>also   that   accused   was   under   suspension   during   the   relevant<\/p>\n<p>period.     The   trial   court   found   from   the   evidence   available<\/p>\n<p>that   it   is   possible   and,   in   any   event,   it   is   not   proved<\/p>\n<p>that   Ext.P1   cheque   was   issued   for   a   legally   enforceable<\/p>\n<p>liability  and   the   case   of   the   accused   is   more   probable   and<\/p>\n<p>presumption under section 139 is rebutted.\n<\/p>\n<p>            In   this   connection,   I   also   refer   to   the   decision<\/p>\n<p>of the Apex Court in M.S.Narayanan Menon @ <a href=\"\/doc\/368123\/\">Mani v. State of<\/p>\n<p>Kerala<\/a>  (2006   (3)   KLT   404).     On   going   through   the   evidence<\/p>\n<p>as well as the findings, it cannot be stated that the view<\/p>\n<p><span class=\"hidden_text\">Crl.A.No.167\/99                      3<\/span><\/p>\n<p>of the trial court is not a possible one.  I agree with the<\/p>\n<p>findings  of   the   trial   court.     Therefore,   there   is   no   merit<\/p>\n<p>in the appeal and the appeal is dismissed.\n<\/p>\n<p>                                                 J.B.
