Neelam Singh\nChauhan\nRespondent Counsel :- C.S.C.,Shailendra Kumar Singh\n\nHon'ble Ran Vijai Singh,J.\n<\/pre>\n<p>Heard learned counsel for the petitioner, learned Standing Counsel and Shri<br \/>\nShailendra Kumar Singh for the respondent no.3.<br \/>\nLearned counsel for the petitioner submits that petitioner has taken loan from<br \/>\nthe respondent bank for agricultural purpose but it could not be deposited as<br \/>\nper terms of the agreement due to poor earning from agricultural produce. It is<br \/>\nalso contended that the petitioner has no other source of income except<br \/>\nincome derived from agriculture.\n<\/p>\n<p>Learned counsel for the parties are agreed for final disposal of the writ<br \/>\npetition at this stage without exchange of affidavit as the petitioner has not<br \/>\ndisputed the amount of recovery and is ready to pay the amount in<br \/>\ninstallments.\n<\/p>\n<p>After hearing counsel for the parties, the writ petition is disposed of with the<br \/>\nfollowing directions:-\n<\/p>\n<p>(i) The recovery proceeding initiated against the petitioner shall remain stayed<br \/>\nsubject to satisfaction of the following conditions:-\n<\/p>\n<p>(a) The petitioner shall approach respondent bank along with certified copy of<br \/>\nthe order within a period of three weeks&#8217; from today and the Bank shall fix<br \/>\neight three monthly equal installments after adjusting the amount which has<br \/>\nalready been deposited by the petitioner towards the amount due within a<br \/>\nfurther period of one month from the date of receipt of certified copy of the<br \/>\norder of this Court and intimate the same to the petitioner within a week<br \/>\nthereafter.\n<\/p>\n<p>(b) After fixation of installments by the bank, the respective installments be<br \/>\ndeposited by the petitioner on the date fixed by the Bank.\n<\/p>\n<p> (c) In case of default in deposit on the date fixed by the Bank the defaulted<br \/>\namount be deposited on the date fixed for depositing next installment.\n<\/p>\n<p>(d) Even after depositing the amount as indicated above if any amount<br \/>\nremains due then that shall be deposited by the petitioner on the date fixed by<br \/>\nthe bank for depositing the last installment.\n<\/p>\n<p>(e) In case of three defaults with respect to the payment as per schedule fixed<br \/>\nby the Bank the recovery would stand revive and the respondents may<br \/>\nproceed in accordance with law to recover the amount due against the<br \/>\npetitioner.\n<\/p>\n<p>(f) In case of satisfactory deposit with the Bank as indicated above no<br \/>\nrecovery charge shall be realised from the petitioner.\n<\/p>\n<p>Subject to the above observation the writ petition is disposed of.\n<\/p>\n<p>Order Date :- 23.6.2010<br \/>\nMustaqeem.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Bhoori Singh vs State Of U.P.
