Bail Application No. 28943 of 2009\n                Suhail Vs. State of U.P.\n\n\nHon. Ravindra Singh, J.\n<\/pre>\n<p>     Heard Sri K.K. Dwivedi, learned counsel for the applicant,<br \/>\nlearned A.G.A. for the State of U.P., Sri Ali Hasan, Sri Ishtiyaq Ali,<br \/>\nlearned counsel for the complainant and perused the record.\n<\/p>\n<p>     It is contended by learned counsel for applicant that<br \/>\napplicant is not named in the FIR. The deceased has not been<br \/>\nrecovered. There is no direct eye witness account, no transaction<br \/>\nof ransom has taken place. During investigation the statement of<br \/>\nRafiquddin has been recorded who disclosed the name of the<br \/>\napplicant and other co-accused person. The deceased was seen in<br \/>\nthe company of the applicant and co-accused Raja, but the co-<br \/>\naccused Raja has been released on bail by the another bench of<br \/>\nthis court on 8.9.2009. The applicant is in jail since 14.5.2009<br \/>\nand nothing incriminating has been recovered from the possession<br \/>\nof the applicant or at his pointing out.\n<\/p>\n<p>     In reply of the above condition, it is submitted by learned<br \/>\nA.G.A. and learned counsel for the complainant that the name of<br \/>\nthe applicant has come into the light during investigation. The<br \/>\napplicant and other co-accused had committed the murder of the<br \/>\ndeceased. But it is admitted that co-accused Raja has been<br \/>\nreleased on bail.\n<\/p>\n<p>     Considering the submissions made by learned counsel for the<br \/>\napplicant, learned A.G.A., learned counsel for the complainant and<br \/>\nfrom the perusal of the record it appears that the case of the<br \/>\napplicant is based on the same footing with case of the co-accused<br \/>\nRaja who has been released on bail by the another bench of the<br \/>\ncourt on 8.9.2009 in criminal Misc. Bail Application No. 23695 of<br \/>\n2009, therefore, the applicant is also entitled to get the benefit of<br \/>\n<span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>parity and without expressing any opinion on the merits of the<br \/>\ncase, the applicant is entitle to be released on bail.\n<\/p>\n<p>     Let the applicant Suhail involved in case crime no. 7 of 2009<br \/>\nunder Sections 364-A, 302, 201 I.P.C., P.S. Kotwali, District Agra<br \/>\nbe released on bail on his furnishing a personal bond and two<br \/>\nheavy sureties each in the like amount to the satisfaction of the<br \/>\nCourt concerned with the following conditions:\n<\/p>\n<p>  1. That the applicant shall not temper with the evidence.\n<\/p>\n<p>  2.
