Accordingly, following issues are  raised :\n<\/p>\n<p>Whether<br \/>\n\tthe  Plaintiff proves that  the collision which  occurred on<br \/>\n\t11.10.2006 was solely and entirely due to the negligence of the<br \/>\n\tfirst Defendant vessel\/her servants\/her officers and her crew<br \/>\n\tmembers and\/or  the negligence and failure of her owners  and<br \/>\n\tpersons interested  in the  first Defendant vessel and\/or due  to<br \/>\n\tthe acts and omission and\/or commission of the servants, officers<br \/>\n\tand crew of the first Defendant vessel and\/or the  negligence and<br \/>\n\tfailure of owners and all persons interested  in the first Defendant<br \/>\n\tvessel as alleged in para 6 of the plaint ?\n<\/p>\n<p>Whether<br \/>\n\tthe plaintiff proves  that as a direct and immediate consequence of<br \/>\n\tthe said collision, the plaintiffs have suffered grave and heavy<br \/>\n\tloss and damages  which as per their preliminary assessment come to<br \/>\n\tthe tune of about Rs.672 lacs as alleged  in para 6 of the plaint ?\n<\/p>\n<p>Whether<br \/>\n\tthe plaintiff proves that apart from the physical loss and damage,<br \/>\n\tthe plaintiffs have also suffered  and will continue to suffer for<br \/>\n\tmore time loss in view of the disruption  of its activities,<br \/>\n\tdisruption of the material supplies, claims from contractors, due to<br \/>\n\tdelay\/disruption in the work, increase in costs, demurrage  which<br \/>\n\tare not  included\/taken into account, at the stage  of the filing of<br \/>\n\tthe suit as alleged in para 6 of the plaint ?\n<\/p>\n<p>Whether<br \/>\n\tthe plaintiff proves that their  alleged claims  for compensation<br \/>\n\tconstitute a maritime lien on the first Defendant vessel and\/or the<br \/>\n\tplaintiff are entitled to enforce  their alleged maritime lien in<br \/>\n\trem as alleged in para 8 of the plaint ?\n<\/p>\n<p>Whether<br \/>\n\tthe plaintiff proves that they are entitled to include an amount  of<br \/>\n\tRs.528 lacs (Rs.300 lacs + Rs.180 lacs + Rs.48 lacs being 10% of<br \/>\n\tRs.480 lacs) in the plaintiff&#8217;s alleged claim of Rs.672 lacs as<br \/>\n\tcontended  by the plaintiff in para 4 of the plaint and as expressly<br \/>\n\tconfirmed  by the third Defendant in para 4  and 5 (erroneously<br \/>\n\tnumbered as para 8 and 4) in the third Defendants written statement<br \/>\n\twhen the third Defendants themselves  have not filed   any suit  or<br \/>\n\tother legal proceedings to recover  their alleged  loss from the<br \/>\n\tfirst Defendant vessel and\/or her owners  and the same amount of<br \/>\n\tRs.528 lacs is not the plaintiff&#8217;s claim at all but the alleged<br \/>\n\tclaim of the third Defendant ?\n<\/p>\n<p>Whether<br \/>\n\tthe Defendants prove that the incident on 11.10.2006 which resulted<br \/>\n\tin the damage to the first Defendant vessel as well as to the<br \/>\n\tplaintiff&#8217;s property and their said contractor&#8217;s property was not on<br \/>\n\taccount of any fault, lapse, failure or negligence on the part of<br \/>\n\tthe first Defendant vessel and\/or her master and\/or her owners<br \/>\n\tand\/or their  agents or servants as alleged in para 3 of the first<br \/>\n\tDefendant&#8217;s written statement\/counter-claim ?\n<\/p>\n<p>Whether<br \/>\n\tthe Defendants prove that the incident on 11.10.2006 which resulted<br \/>\n\tin the contact between the first Defendant vessel and the<br \/>\n\tplaintiff&#8217;s property and their said contractor&#8217;s property was on<br \/>\n\taccount  of error of judgment, inexperience, inefficiency<br \/>\n\tincompetence, failure and negligence on the part of the plaintiff&#8217;s<br \/>\n\tpilot and the fact that the plaintiff&#8217;s pilot was ill-equipped at<br \/>\n\tthe time of the piloting of the vessel as well as due to negligence<br \/>\n\tof the plaintiffs  for causing vessels to navigate too close to the<br \/>\n\tplaintiff&#8217;s construction works  and that the pilot being an employee<br \/>\n\tof the plaintiff, the plaintiff are vicariously liable to  make good<br \/>\n\tthe loss and\/or damage suffered by the first Defendant vessel and<br \/>\n\tfor the first Defendant&#8217;s  counter-claim as alleged in paras 4, 5<br \/>\n\tand 6 of the first Defendant&#8217;s written statement\/counter claim ?\n<\/p>\n<p>Whether<br \/>\n\tthe Defendants prove that the first defendant vessel was too close<br \/>\n\tto the allotted discharge berth by the plaintiff  and that the first<br \/>\n\tDefendant vessel subsequently made contact with the berth and that<br \/>\n\tsubsequent to the contact, she was pushed  further against the berth<br \/>\n\tand construction site  meaning that the tidal currents prevailing<br \/>\n\twere setting the vessel westward  on to the berth and the<br \/>\n\tconstruction  area and that the predicted time of tide by the<br \/>\n\tpilot\/the plaintiff  was erroneous  and that this fact is<br \/>\n\tcorroborated by the information provided  by the plaintiff&#8217;s own<br \/>\n\tpilot who confirmed that the tide had, indeed,  changed by the time<br \/>\n\tthe vessel got to the trimming basin and that this is another<br \/>\n\timportant factor causing the said incident on 11.10.2006 for which<br \/>\n\tthe first Defendant vessel\/her owners are not at all liable and\/or<br \/>\n\tresponsible as alleged in para 7 of the first defendant&#8217;s written<br \/>\n\tstatement\/counter claim ?\n<\/p>\n<p>Whether<br \/>\n\tthe Defendants prove that the incident on 11.10.2006 causing damage<br \/>\n\tto the first Defendant vessel and to the property of the plaintiff<br \/>\n\tand to the contractor&#8217;s property also occurred on account of the<br \/>\n\tfact that the Port of Mundra was not safe at the time of berthing<br \/>\n\tthe vessel as alleged in para 8 of the first Defendant&#8217;s written<br \/>\n\tstatement\/counter claim ?\n<\/p>\n<p>Whether<br \/>\n\tthe plaintiff proves  that they are entitled to any decree or<br \/>\n\treliefs against the first Defendant  vessel and\/or her Owners  as<br \/>\n\tprayed for in the plaint ?\n<\/p>\n<p>Whether<br \/>\n\tthe first defendant vessel\/her owners prove that the plaintiff<br \/>\n\tunlawfully obtained an order  for the arrest of the first Defendant<br \/>\n\tvessel from this Hon&#8217;ble Court as alleged in para 23 of the<br \/>\n\tcounter-claim of Wealth Line Inc. the Owners of the first Defendant<br \/>\n\tvessel ?\n<\/p>\n<p>Whether<br \/>\n\tthe Defendants prove that they are entitled to recover by way of<br \/>\n\ttheir counter-claim  from the plaintiffs a sum of US$ 3,89,764.44 as<br \/>\n\taverred in para 2 of the first Defendant&#8217;s written statement and in<br \/>\n\tthe counter-claim  filed in the suit by Wealth Line Inc. as the<br \/>\n\towners of the first Defendant vessel?\n<\/p>\n<p>What<br
