SHEEMA ALI KHAN<\/p>\n<p>      S.A. Khan, J.              This is a jail appeal in which this<\/p>\n<p>                      Court    has    appointed      Arun    Kumar     Tripathy       to<\/p>\n<p>                      appear amicus curiae.\n<\/p>\n<p>                                 The sole appellant Mohan Rai who has<\/p>\n<p>                      spent about more than six years in jail custody<\/p>\n<p>                      in a case under Section 366A of the Indian Penal<\/p>\n<p>                      Code has challenged the order dated 11.8.2004<\/p>\n<p>                      passed by District &amp; Sessions Judge, Buxar.<\/p>\n<pre>                                 The       prosecution      case     is     that     the\n\n                      occurrence      took   place    2\u00bd    years    prior     to    the\n\n                      lodging of the First Information Report.                       The\n\n                      First     Information         Report     was        lodged      on\n\n                      19.10.2000      by   Urmila    Devi,    mother      of   the    so\n\n                      called   victim      girl   Dharmshila        Devi.      In    the\n<span class=\"hidden_text\">                          2<\/span>\n\n\n\n\nFirst   Information             Report      it     is    alleged      that\n\n<\/pre>\n<p>Anandi Devi, mother of the present appellant had<\/p>\n<p>come    to    the       house       of    the     informant      in   the<\/p>\n<p>morning      at    about       3   a.m.     and    asked      Dharmshila<\/p>\n<p>Devi    to    accompany            her     for     the     purpose      of<\/p>\n<p>attending         the   call       of    nature.        The    informant<\/p>\n<p>found that her daughter had not returned hom and<\/p>\n<p>began to look for her.                   She went to the house of<\/p>\n<p>Anandi Devi but was told that Anandi Devi does<\/p>\n<p>not know the whereabouts of Dharmshila Devi.                           In<\/p>\n<p>the First Information Report it is also alleged<\/p>\n<p>that the informant went again to the house of<\/p>\n<p>Anandi Devi but on each and every occasion she<\/p>\n<p>was repelled by her.                    The informant claims that<\/p>\n<p>there   was       a     &#8216;Panchayati&#8217;         in    the    village     and<\/p>\n<p>Anandi Devi had promised to produce the girl who<\/p>\n<p>has allegedly been taken away by Mohan Rai, son<\/p>\n<p>of Anandi Devi.              The girl returned after about 8<\/p>\n<p>or 9 months of the occurrence.\n<\/p>\n<p>             Eight(8) witnesses have been examined<\/p>\n<p>on   behalf        of    the       informant       whereas      three(3)<\/p>\n<p>witnesses have been examined on behalf of the<\/p>\n<p>defence.          The Court below has convicted Mohan<\/p>\n<p>Rai on the evidence of the girl and her mother<\/p>\n<p>and had believed the prosecution version.<br \/>\n<span class=\"hidden_text\">                        3<\/span><\/p>\n<p>            Further         the     case    of    the    prosecution<\/p>\n<p>that some boys of the village had caught hold of<\/p>\n<p>Mohan Rai and got him to confess with regard to<\/p>\n<p>the whereabouts of Dharmshila Devi.                       It is said<\/p>\n<p>that the informant&#8217;s husband and Mohan Rai along<\/p>\n<p>with   some     villagers           went    with    Mohan        Rai    to<\/p>\n<p>Sasaram    to    look       for     Dharmshila      Devi.         After<\/p>\n<p>reaching Sasaram, it is alleged that Mohan Rai<\/p>\n<p>managed to escape from them on the pretext of<\/p>\n<p>fetching water.\n<\/p>\n<pre>            P.W.       1     Jai     Prakash       Rai     has    given\n\nevidence    only       on     the    point       that    he   went     to\n\n<\/pre>\n<p>Sasaram with Mohan Rai, P.W. 2 has been declared<\/p>\n<p>hostile.      P.Ws. 3 and 4 have been tendered for<\/p>\n<p>cross examination.                The only relevant evidence<\/p>\n<p>in this case is of P.Ws. 5 and 7.                        P.W. 6, the<\/p>\n<p>husband    of    the       informant       and    his    evidence       is<\/p>\n<p>mainly    based       on    what     he    has    learnt      from     his<\/p>\n<p>wife, the informant.\n<\/p>\n<p>            P.W. 5 Urmila Devi, the informant has<\/p>\n<p>supported       the        case     made    out     in     the    First<\/p>\n<p>Information Report.                 In the cross examination<\/p>\n<p>she has not been able to explain as to why her<\/p>\n<p>daughter went to attend the call of nature with<\/p>\n<p>Anandi Devi when she herself was present in the<br \/>\n<span class=\"hidden_text\">                        4<\/span><\/p>\n<p>house    as     according      to   the    informant    she    was<\/p>\n<p>sleeping in her house along with her daughter<\/p>\n<p>Dharmshila Devi.           Secondly, when the Court asked<\/p>\n<p>her how she came to know that her daughter had<\/p>\n<p>gone to Panipat she said that she had come to<\/p>\n<p>know all these facts from her daughter. In fact<\/p>\n<p>the evidence in her cross examination is so weak<\/p>\n<p>with respect to the manner of occurrence and the<\/p>\n<p>explanation, rather virtually no explanation has<\/p>\n<p>come forth to explain the delay in filing the<\/p>\n<p>case for 2\u00bd years, although she was aware that<\/p>\n<p>her daughter had been kidnapped.<\/p>\n<p>               Similarly, P.W. 7 the victim girl has<\/p>\n<p>tried to make out a case that she was forcibly<\/p>\n<p>taken and that Anandi Devi handed her over to<\/p>\n<p>Mohan Rai at 3 a.m. after she left her house.<\/p>\n<p>This witness is not at all able to explain as to<\/p>\n<p>how she left from Sasaram and went to Panipat on<\/p>\n<p>a     truck.        The    first        inconsistency    in    her<\/p>\n<p>statement comes forth when she states that Mohan<\/p>\n<p>Rai    had     taken    her    on   a    bus   to   Sasaram,   she<\/p>\n<p>admits       that      there    were      several     passengers<\/p>\n<p>travelling on the bus and she has not raised hue<\/p>\n<p>and cry or protested or informed the passenger,<\/p>\n<p>driver or khalasi regarding the fact that she<br \/>\n<span class=\"hidden_text\">                           5<\/span><\/p>\n<p>was    being       forcefully         taken      on    the    bus.        The<\/p>\n<p>initial story of kidnapping becomes doubtful in<\/p>\n<p>view of this fact.                It is not her case that she<\/p>\n<p>was    in     an    unconscious        condition           and    was    thus<\/p>\n<p>unable to protest or make noise while she was<\/p>\n<p>taken to the bus stand at 6 a.m. in the morning<\/p>\n<p>to leave for Sasaram.                  Another inconsistency of<\/p>\n<p>the prosecution version is that P.W. 7 does not<\/p>\n<p>give     an        explanation        as      to      what       transpired<\/p>\n<p>between 3 a.m. (time when she was kidnapped) and<\/p>\n<p>6 a.m. (time when she boarded the bus to leave<\/p>\n<p>for Sasaram).            It is stranger still that none of<\/p>\n<p>the    villagers         have     seen     Mohan      Rai     along      with<\/p>\n<p>Dharamshila Devi anywhere in the village.                                This<\/p>\n<p>story put forth by Dharmshila Devi appears to be<\/p>\n<p>doubtful and improbable.\n<\/p>\n<p>              The second part of the prosecution case<\/p>\n<p>put forth by Dharmshila Devi is that she was<\/p>\n<p>sold to one Krishna the owner of a truck who<\/p>\n<p>took    her        to    Panipat.          It    is    said       that    she<\/p>\n<p>travelled          for        three   days       on    a     truck       with<\/p>\n<p>Krishna.           According to the informant apart from<\/p>\n<p>Krishna there was no Khalasi or any other person<\/p>\n<p>travelling          on    the     truck      with      them       which    in<\/p>\n<p>itself      does        not    seem   to    be     probable.            After<br \/>\n<span class=\"hidden_text\">                        6<\/span><\/p>\n<p>reaching Panipat, P.W. 7 builds a story that she<\/p>\n<p>lived with Krishna for several months.                               After<\/p>\n<p>some time Krishna permitted her to move freely<\/p>\n<p>and she came to know from some of the neighbours<\/p>\n<p>the name of the trains on which she could travel<\/p>\n<p>back home.       The missing link in this part of the<\/p>\n<p>story is that she does not explain as to how she<\/p>\n<p>went    to     the    station      at    Panipat       and    by     which<\/p>\n<p>train she travelled to Delhi.                        She claims that<\/p>\n<p>she    travelled       from      Panipat       to    Delhi    and    from<\/p>\n<p>Delhi to Buxar without ticket, which also does<\/p>\n<p>not seem probable.               The entire narration of the<\/p>\n<p>occurrence appears to be absolutely impossible<\/p>\n<p>to     believe       and    it    is     further       difficult        to<\/p>\n<p>believe that Krishna did not try to find out her<\/p>\n<p>whereabouts after he found her missing his home.<\/p>\n<p>All     these    inconsistencies               and    gaps,     in     the<\/p>\n<p>narration of the prosecution case create several<\/p>\n<p>doubts       regarding           the     authenticity          of      the<\/p>\n<p>prosecution version.               After reaching Buxar and<\/p>\n<p>then to her village home strangely enough she<\/p>\n<p>was not produced to be medically examined.                             In<\/p>\n<p>fact     her     statement         was     not       recorded        under<\/p>\n<p>Section 164 Cr.P.C. by the police.                           Therefore,<\/p>\n<p>the    entire        case   and        story    built    up     by     the<br \/>\n<span class=\"hidden_text\">                        7<\/span><\/p>\n<p>informant and her daughter P.W. 7 seems to be<\/p>\n<p>improbable and unbelievable.                   Further there can<\/p>\n<p>be hardly any explanation for not lodging the<\/p>\n<p>First    Information         Report\/Sanha        in       the    police<\/p>\n<p>station even when the informant knew very well<\/p>\n<p>that her daughter was kidnapped by Mohan Rai,<\/p>\n<p>the appellant.\n<\/p>\n<p>              According          to   her        Fardbeyan            the<\/p>\n<p>informant had gone to the house of Anandi Devi<\/p>\n<p>when    she    found       her    daughter     missing          and   the<\/p>\n<p>informant from the very beginning suspected that<\/p>\n<p>Mohan    Rai     was       responsible         for    the       alleged<\/p>\n<p>kidnapping.       Therefore, the second occasion to<\/p>\n<p>file a report arose when the informant&#8217;s husband<\/p>\n<p>along with villagers proceeded with Mohan Rai to<\/p>\n<p>look for Dharmshila Devi and failed to locate<\/p>\n<p>her.     This leads this Court to the conclusion<\/p>\n<p>that the conduct of the informant in not giving<\/p>\n<p>information      to    the       police   is    not       natural     and<\/p>\n<p>logical.\n<\/p>\n<p>              In the circumstances therefore, it is<\/p>\n<p>very difficult to believe that the appellant was<\/p>\n<p>responsible      for       kidnapping      the       girl    and      the<\/p>\n<p>story    of    her     being       kidnapped         by    Mohan      Rai<\/p>\n<p>appears to be thoughtfully prepared by an expert<br \/>\n<span class=\"hidden_text\">                                            8<\/span><\/p>\n<p>                    mind.\n<\/p>\n<p>                                  The question then would be that there<\/p>\n<p>                    has to be a good reason for the informant to<\/p>\n<p>                    implicate the appellant in a case.                       The reason<\/p>\n<p>                    comes    from        the    suggestions           given        to     the<\/p>\n<p>                    witnesses P.Ws. 5, 6 and 7 suggesting that there<\/p>\n<p>                    is ill will and dispute between them because of<\/p>\n<p>                    some land in the village although no case has<\/p>\n<p>                    been filed by the appellant or the informant for<\/p>\n<p>                    the    said    land.       Nevertheless,          it    does    appear<\/p>\n<p>                    that there is a dispute between two which gave<\/p>\n<p>                    rise    to     the     filing       of     the      present         First<\/p>\n<p>                    Information Report.\n<\/p>\n<p>                                  Having       regard        to      all     the        facts<\/p>\n<p>                    discussed aforesaid, I find that I cannot hold<\/p>\n<p>                    the appellant guilty of an offence under Section<\/p>\n<p>                    366A of the Indian Penal Code.
