{"id":234220,"date":"2008-12-05T00:00:00","date_gmt":"2008-12-04T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/bhupinder-kumar-vs-champa-devi-on-5-december-2008"},"modified":"2018-07-02T01:09:40","modified_gmt":"2018-07-01T19:39:40","slug":"bhupinder-kumar-vs-champa-devi-on-5-december-2008","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/bhupinder-kumar-vs-champa-devi-on-5-december-2008","title":{"rendered":"Bhupinder Kumar vs Champa Devi on 5 December, 2008"},"content":{"rendered":"<div class=\"docsource_main\">Punjab-Haryana High Court<\/div>\n<div class=\"doc_title\">Bhupinder Kumar vs Champa Devi on 5 December, 2008<\/div>\n<pre>CR No. 6761 of 2008                       1\n\n          IN THE HIGH COURT OF PUNJAB AND HARYANA\n                       AT CHANDIGARH\n\n\n                               CR No. 6761 of 2008\n                              Decided on : 05-12-2008\n\nBhupinder Kumar\n\n                                                       ....Petitioner.\n\n\n                                      VERSUS\n\nChampa Devi\n\n                                                       ....Respondent<\/pre>\n<p>CORAM:- HON&#8217;BLE MR JUSTICE MAHESH GROVER<\/p>\n<p>Present:-        Ms. Kiran Bala Jain, Advocate for the petitioner.<\/p>\n<p>MAHESH GROVER, J<\/p>\n<p>                 This revision petition is directed against the orders of the Rent<\/p>\n<p>Controller dated 18.4.2007 and Appellate Authority dated 24.11.2008.<\/p>\n<p>                 An ejectment petition was preferred by the respondent-landlady<\/p>\n<p>against the petitioner on the following grounds:-<\/p>\n<p>i) non-payment of rent from 1st January, 99 to 31st August, 2000.<\/p>\n<p>ii) That there is nuisance being created by the petitioner.<\/p>\n<p>iii)Shop is required for the personal use and occupation of the respondent-<\/p>\n<p>     landlady.\n<\/p>\n<p>                 The Rent Controller framed the following issues:-<\/p>\n<p>1)      Whether the respondent is liable to be ejected on the grounds:-<\/p>\n<p>a)      that the tender made by the respondent is short for want of payment of<\/p>\n<p>house tax?\n<\/p>\n<p>b) That the petitioner, who is a widow requires the shop in dispute for her<\/p>\n<p>bona fide and personal necessity?\n<\/p>\n<p><span class=\"hidden_text\"> CR No. 6761 of 2008                     2<\/span><\/p>\n<p>c) that the respondent is permanent nuisance for the petitioner.<\/p>\n<p>2) Whether the present petition of the petitioner is not maintainable in its<\/p>\n<p>  present form?\n<\/p>\n<p>3) Relief.\n<\/p>\n<p>               Since the rent and house tax etc. had been paid, so issue no.1<\/p>\n<p>did not survive. The ground of nuisance was also not accepted by the<\/p>\n<p>Courts below, as a result of which the only surviving ground was the ground<\/p>\n<p>of bona fide requirement which was accepted and answered in her favour.<\/p>\n<p>               Learned counsel for the petitioner while assailing the findings<\/p>\n<p>of the Courts below has contended that the bona fide need of the<\/p>\n<p>respondent-landlady is not established as she is running a business from her<\/p>\n<p>residential premises and has two sons out of whom, one is employed with<\/p>\n<p>FCI, Delhi and the other one has been residing with his Aunt for the last 16<\/p>\n<p>years.\n<\/p>\n<p>               No other point has been raised before this Court.<\/p>\n<p>               After hearing learned counsel for the petitioner and perusing<\/p>\n<p>the impugned orders, I am of the considered opinion that the contention<\/p>\n<p>raised by the learned counsel for the petitioner is not tenable. Whether the<\/p>\n<p>need of the landlady is genuine or not has to be seen from the point of view<\/p>\n<p>of the landlady. The tenant cannot dictate to the landlady that the need is<\/p>\n<p>existing or not, even if the eviction causes hardship to the petitioner. The<\/p>\n<p>Apex Court in case titled as &#8216;Sarla Ahuja versus United India Insurance<\/p>\n<p>Company Ltd.&#8217; 1998 (2) RCR 534 observed as follows:-<\/p>\n<blockquote><p>                      &#8220;Para 14. The crux of the ground envisaged in clause (e)<\/p>\n<p>         of Section 14(1) of the Act is that the requirement of the landlord for<\/p>\n<p>         occupation of the tenanted premises must be bona fide. When a<br \/>\n<span class=\"hidden_text\"> CR No. 6761 of 2008                   3<\/span><\/p>\n<p>      landlord asserts that he requires his building for his own occupation<\/p>\n<p>      the Rent Controller shall not proceed on the presumption that the<\/p>\n<p>      requirement is not bona fide. When other conditions of the clause are<\/p>\n<p>      satisfied and when the landlord shows a prima facie case it is open to<\/p>\n<p>      the Rent Controller to draw a presumption that the requirement of the<\/p>\n<p>      landlord is bona fide. It is often said by courts that it is not for the<\/p>\n<p>      tenant to dictate terms of the landlord as to how else he can adjust<\/p>\n<p>      himself without getting possession of the tenanted premises. While<\/p>\n<p>      deciding the question of bona fides of the requirement of the landlord<\/p>\n<p>      it is quite unnecessary to make an endeavour as to how else the<\/p>\n<p>      landlord could have adjusted himself.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>            The facts of the case reveal that the respondent requires the said<\/p>\n<p>premises for the use of her two sons particularly for running a small<\/p>\n<p>business of selling &#8216;pans&#8217; and cigarettes. No infirmity has been shown to<\/p>\n<p>have been committed in the impugned orders and consequently, the revision<\/p>\n<p>petition being devoid of any merit is dismissed.<\/p><\/blockquote>\n<p>            At this stage, learned counsel for the petitioner contends that<\/p>\n<p>the petitioner is in occupation of the shop since 1997 and great prejudice<\/p>\n<p>has been caused to him as he has three children who are college going and<\/p>\n<p>are in the process of availing education of higher standards. Further pleads<\/p>\n<p>that the petitioner is present in Court and is ready and willing to furnish an<\/p>\n<p>undertaking that if some time is granted to him, he shall hand over vacant<\/p>\n<p>physical possession of the demised premises to the respondent.<\/p>\n<p>            After hearing learned counsel for the petitioner on this aspect<\/p>\n<p>of the matter, I am of the considered opinion that the prayer of the petitioner<\/p>\n<p>deserves acceptance. Accordingly, the petitioner is granted one year&#8217;s time<br \/>\n<span class=\"hidden_text\"> CR No. 6761 of 2008                    4<\/span><\/p>\n<p>beginning from today onwards, subject to the condition that he will furnish<\/p>\n<p>an undertaking before the Executing Court within one week from today to<\/p>\n<p>the effect that he will hand over the physical, vacant possession of the<\/p>\n<p>demised premises to the respondent on or before 31.12.2009. He shall also<\/p>\n<p>clear the arrears of rent, if any, alongwith an undertaking and shall also<\/p>\n<p>continue to pay rent regularly by the 7th of each month for the period as<\/p>\n<p>specified in the order lasts.
