PATTANAIK.\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>O R D E R<br \/>\nBy an earlier judgment &amp; order of this\tCourt  dated<br \/>\nllth  March 1969 in Civil Appeal No .306 of 1966 between the<br \/>\nthe original appellant and the original respondents  in\t the<br \/>\nsame proceedings.  this Court gave the following directions:<br \/>\n\t&#8220;The  order  passed  by\t the High<br \/>\n\tCourt is set  aside,  and  the\tproceeding<br \/>\n\tstands, remanded to the Tahsildar with the<br \/>\n\tdirection  that\t he do determine determine<br \/>\n\twhether\t Dadarao  continued  to\t remain\t a<br \/>\n\tprotected  tenant  till tile date on which<br \/>\n\the  claimed  to\t exercise  his\tright\tto<br \/>\n\tpurchase  the  land  and  whether Nivrutti<br \/>\n\tacquired the rights or a protected  tenant<br \/>\n\tand  if\t so,  whether  he  was entitled to<br \/>\n\texercise the right to purchase\tthe  land,<br \/>\n\tand  if\t both  Dadarao\tand  Nivrutti were<br \/>\n\tentitled to purchase the land or any  part<br \/>\n\tthereof\t the  extent to which each of them<br \/>\n\twas entitled and  to  what  extent.    The<br \/>\n\tTribunal will decide the question with the<br \/>\n\tleast  practical  delay and dispose of the<br \/>\n\tright  and  obligations\t of  the   parties<br \/>\n\taccording to law.  No order as to costs.&#8221;<br \/>\nThese  directions  were\t given\tbecause\t there was a<br \/>\ndispute between the  original  appellant  Nivrutti  and\t the<br \/>\noriginal respondent Dadarao in respect of the right to claim<br \/>\nprotected tenancy under the Hyderabad Tenancy &amp; Agricultural<br \/>\nLands  Act,  1950 and the benefit under Section 38 flowing<br \/>\ntherefrom.\n<\/p>\n<p>The  dispute  related  to 10 acres and 34 gunthas of<br \/>\nland in Survey No.  73.\t Sutardara in village Pathan  Mandwa<br \/>\nTaluka Mominabad,  District  Bihar.  The original respondent<br \/>\nclaimed to be a protected tenant  in  respect  of  the\tsaid<br \/>\nland.\tHe  relied  upon  Revenue entries in his favour as a<br \/>\nprotected tenant since 1950-51.\t He had made an\t application<br \/>\nfor  correction\t of  revenue  entries  of  subsequent  year.<br \/>\nUltimately, the entries were corrected and a certificate  as<br \/>\na  protected  tenant  under  Section  34 of the said Act was<br \/>\ngranted by the Deputy Collector or, 19.12.56.<br \/>\nThe  original  appellant claimed to be in possession<br \/>\nof the said land on 12.3.66 when Section 37A was  introduced<br \/>\nin the\tsaid  Act.    He  has  obtained\t a  certificate as a<br \/>\nprotected tenant under Section 37A in respect of 6 acres and<br \/>\n16 gunthas of land on 7th of September, 1957.  According  to<br \/>\nthe appellant, the rights of the respondent are extinguished<br \/>\nby virtue of the proviso to Section 37A of the said Act.<br \/>\nAfter remand it has been found\tthat  the  appellant<br \/>\nNivrutti  was in possession of the said land on 12.3.56 as a<br \/>\ntenant.\t The respondent Dadarao is a protected tenant  under<br \/>\nSection 34.  We have to examine whether under the proviso to<br \/>\nSection\t 37A  (1)  as  it  then\t stood,\t the  rights  of the<br \/>\nrespondent as a protected  tenant  have\t been  extinguished.<br \/>\nSection 37A, at the relevant time, was as fellows:<br \/>\n\t37-A (1) Notwithstanding anything<br \/>\n\tcontained in this Act, every person who at<br \/>\n\tthe  commencement of the Hyderabad Tenancy<br \/>\n\tand Agricultural  Lands\t (Amendment)  Act,<br \/>\n\t1955  holds  as tenant any land in respect<br \/>\n\tof  which  he  is  not\tdeemed\tto  be\t a<br \/>\n\tprotected  tenant under this Act, shall be<br \/>\n\tdeemed to be a\tprotected  tenant  if  the<br \/>\n\ttotal  area  of\t the  land  owned  by  the<br \/>\n\tland-holder including the land\tunder  the<br \/>\n\tcultivation  of\t his  tenants is more than<br \/>\n\tthree times the area of a  family  holding<br \/>\n\tfor the local area concerned;\n<\/p>\n<p>\tProvided  that\tnothing\t in  this<br \/>\n\tsection\t shall\taffect\tthe  rights of any<br \/>\n\tother person who already holds a protected<br \/>\n\ttenancy certificate  in\t respect  of  such<br \/>\n\tland  or  whose rights as protected tenant<br \/>\n\tare under investigation before a competent<br \/>\n\tauthority, if such other person applies to<br \/>\n\tthe Tribunal for safeguarding  his  rights<br \/>\n\twithin\ta  period  of  six months from the<br \/>\n\tcommencement of the Hyderabad Tenancy  and<br \/>\n\tAgricultural Lands (Amendment) Act.  1955&#8243;<br \/>\nThis  section  was  introduced\tby  reason  of\t the<br \/>\nHyderabad  Tenancy  and\t Agricultural  Land (Amendment) Act.<br \/>\n1955 which came into force on  12.3.56.\t   Under  the  newly<br \/>\nadded  Section\t37A a person holding any land as a tenant on<br \/>\n12.3.56 though not deemed to be a protected tenant prior  to<br \/>\nthe  said  Amendment  Act,  shall on and from 12th of March,<br \/>\n1956 be deemed to be a protected tenant of the\tland.\t The<br \/>\nproviso\t to  Section  37A(1),  however,\t makes it clear that<br \/>\nSection 37A(1) shall not affect the rights of any person who<br \/>\nalready holds a certificate as a protected tenant in respect<br \/>\nof the said land or whose rights as a protected tenant under<br \/>\nthe unamended Act are under investigation before a competent<br \/>\nauthority.  Thus the existing right as\ta  protected  tenant<br \/>\nand  the existing right to be declared a protected tenant is<br \/>\npreserved if such a  person  applies  to  the  Tribunal\t for<br \/>\nsafeguarding his rights within six months of 12.3.56.<br \/>\nThe  High  Court has come to the conclusion that the<br \/>\nright of the respondent whose claim as\ta  protected  tenant<br \/>\nwas under investigation when Section 37A came into force, is<br \/>\nnot extinguished by virtue of the proviso to Section 37A(1).<br \/>\nThe respondents&#8217;  claim\t as  a protected tenant was.  during<br \/>\nthe  relevant  period  from  12.3.56  and  for\tsix   months<br \/>\nthereafter,  being  investigated before the same Tribunal to<br \/>\nwhich an application for safeguarding his rights by  such  a<br \/>\nperson\tis contemplated under the proviso to Section 37A(1).<br \/>\nHis application was.  in effect an application to  safeguard<br \/>\nhis rights.\n<\/p>\n<p>&#8216;Tribunal&#8217; is defined under Section 2(W) of the said<br \/>\nAct  as\t &#8220;Agricultural\tLands  Tribunal&#8221;  constituted  under<br \/>\nsub-section (1) of Section 87 for the area concerned.  Where<br \/>\nno such Tribunal has been constituted under Section 2(W)(ii)<br \/>\nby the Deputy Collector or other  officer  authorised  under<br \/>\nsub-section (4)\t of  Section 87 will be the &#8220;Tribunal&#8221;.\t The<br \/>\nproviso to Section 37A contemplates an\tapplication  to\t the<br \/>\n&#8220;Tribunal&#8221; so  defined.\t In the present case since the claim<br \/>\nof the\trespondent  to\tbe  a  protected  tenant  was  being<br \/>\ninvestigated  by  the  Deputy  Collector,  who\twas also the<br \/>\nTribunal for the purposes of the proviso Section 37A.\t the<br \/>\nHigh  Court  has  held\tthat  a separate application was not<br \/>\nnecessary  and\tthe  pursuit  by  the  reappointing  of\t the<br \/>\nproceedings    claiming\t   protected   tenancy,\t  in   these<br \/>\ncircumstances, can be considered as also an  application  to<br \/>\nthe  Tribunal  for safeguarding his rights under the Proviso<br \/>\nto Section 37A.\t This  is  entirely  because  the  authority<br \/>\nbefore\t whom  the  application\t was  pending  is  the\tsame<br \/>\nauthority as the Tribunal  under  the  proviso.\t   The\tsame<br \/>\nTribunal  has  ultimately  granted  to\tthe  respondent\t the<br \/>\ncertificate of protected tenant on  19.12.56.\t The  rights<br \/>\nwhich  are  granted under this certificate cannot be held as<br \/>\nextinguished in these circumstances.<br \/>\nIt was submitted by the appellant that the  Tribunal<br \/>\nunder  the  proviso  to Section 37A(1) was the Tahsildar and<br \/>\nnot the Deputy Collector.  Therefore,  the  respondent\tdoes<br \/>\nnot  fulfil  the requirements of the proviso to Section 37A.<br \/>\nThe High  Court,  however,  in\tits  impugned  judgment\t has<br \/>\npointed\t out that the authority to whom an application is to<br \/>\nbe made under the proviso to Section 37A was  designated  to<br \/>\nbe the\tTahsildar  only by Notification of 11.10.56.  At the<br \/>\nmaterial time, in the absence of any Notification.   Section<br \/>\n2(W)(ii)  would\t be  applicable, as rightly held by the High<br \/>\nCourt.\tThe Tribunal at the material time,  was\t the  Deputy<br \/>\nCollector.\n<\/p>\n<p>In  the\t the  premises\tthe  High  Court has rightly<br \/>\nupheld the claim of the original respondent.  The appeal is,<br \/>\ntherefore dismissed.
