No.30039 of 2011\n                          Ashok Yadav son of Dukhan Yadav\n                                       Versus\n                                 The State Of Bihar\n                                      -----------\n<\/pre>\n<p>2\/   13.09.2011                    Heard learned counsel for the petitioner and the State.<\/p>\n<p>                                   The petitioner seeks bail in a case instituted for the<\/p>\n<p>                      offence under sections 302, 201\/34 of the Indian Penal Code.<\/p>\n<p>                                   It has been submitted that only on the basis of vague<\/p>\n<p>                      motive the petitioner has been implicated in the present case but<\/p>\n<p>                      there is no proof of the same.\n<\/p>\n<p>                                   Considering the same as also that he has fair<\/p>\n<p>                      antecedents, let the petitioner, above named, be released on bail on<\/p>\n<p>                      furnishing bail bond of Rs.5,000\/- (five thousand) with two sureties<\/p>\n<p>                      of the like amount each or any other surety to be fixed by the court<\/p>\n<p>                      below to the satisfaction of the Chief Judicial Magistrate, Gaya, in<\/p>\n<p>                      connection with Alipur P.S. Case No.6 of 2009, subject to the<\/p>\n<p>                      conditions (i) That one of the bailors will be a close relative of the<\/p>\n<p>                      petitioner, who will give an affidavit giving genealogy as to how he<\/p>\n<p>                      is related with the petitioner. The bailors will undertake to furnish<\/p>\n<p>                      information to the court about any change in the address of the<\/p>\n<p>                      petitioner, (ii) That the affidavit shall clearly state that the petitioner<\/p>\n<p>                      is not an accused in any other case and, if he is, he shall not be<\/p>\n<p>                      released on bail, (iii) That the bailors shall also state on affidavit<\/p>\n<p>                      that they will inform the court concerned if the petitioner is<\/p>\n<p>                      implicated in any other case of similar nature after his release in the<\/p>\n<p>                      present case and thereafter the court below will be at liberty to<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>       initiate the proceeding for cancellation of bail on the ground of<\/p>\n<p>       misuse, (iv) That the petitioner will give an undertaking that he will<\/p>\n<p>       receive the police papers on the given date and be present on date<\/p>\n<p>       fixed for charge and if he fails to do so on two given dates and<\/p>\n<p>       delays the trial in any manner, his bail will be liable to be cancelled<\/p>\n<p>       for reasons of misuse, and (v) That the petitioner will be well<\/p>\n<p>       represented on each date and if he fails to do so on two consecutive<\/p>\n<p>       dates, his bail will be liable to be cancelled.\n<\/p>\n<\/p>\n<pre>JA\/-                                             (Anjana Prakash,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Ashok Yadav vs The State Of Bihar on 13 September, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.
