RADHAKRISHNAN, J\n  ...........................................\n         WP(C).NO. 29669     OF   2009\n ............................................\n   DATED THIS THE  21st DAY OF OCTOBER, 2009\n\n                   JUDGMENT\n<\/pre>\n<p>   Standing   counsel   takes  notice  for  the<\/p>\n<p>respondent.\n<\/p>\n<p>   2.   With  the  materials   on  record,  the<\/p>\n<p>petitioner demonstrates that he applied for<\/p>\n<p>licence  for  a  Parcel   Service Centre  after<\/p>\n<p>obtaining a building on licence. Ext.P2 is also<\/p>\n<p>stated to have been produced. With the passage<\/p>\n<p>of time, the petitioner claims that he has a<\/p>\n<p>deemed licence since the municipal authority<\/p>\n<p>has not rejected the application for licence.<\/p>\n<p>He now faces Ext.P4, a notice to close down the<\/p>\n<p>premises, on account of objections raised by<\/p>\n<p>the neighbours. Though not the receipt issued<\/p>\n<p>by the Municipality, Ext.P3 is obtained by the<\/p>\n<p>petitioner for payment of profession tax during<\/p>\n<p>the second half year of 2008-2009.   With these<\/p>\n<p><span class=\"hidden_text\">Wpc 29669\/09             2<\/span><\/p>\n<p>materials, it is appropriate that the Secretary<\/p>\n<p>hears the petitioner and issues orders only after<\/p>\n<p>considering       the   materials.    Under    such<\/p>\n<p>circumstances,     it  is  ordered  that   if  the<\/p>\n<p>petitioner    shows  cause  in  answer  to  Ext.P4,<\/p>\n<p>within      a period of  ten  days  from  now, the<\/p>\n<p>Secretary will decide on that issue and issue<\/p>\n<p>final orders within a further period of two<\/p>\n<p>weeks, after giving the petitioner an opportunity<\/p>\n<p>of hearing.
