No. BR2E5643.\n\n                   -----Opposite Party no.3 --- Respondent 2nd Set.\n\n                                   ***\n<\/pre>\n<p>          For the Appellant     : Shri Shailendra Kumar, Adv<\/p>\n<p>                                   ****<\/p>\n<p>04.   20.07.2010              Heard         learned   counsel        for   the<\/p>\n<p>                   appellant,         who      expressed     difficulty     in<\/p>\n<p>                   ascertaining of actual address of respondent<\/p>\n<p>                   nos. 1 to 4 who as per service report, after<\/p>\n<p>                   disposing of their house left the place. During<\/p>\n<p>                   the   course   of        submission,    finding   the   case<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>          before the court below bearing Motor Accidents<\/p>\n<p>          Claims Case No. 11\/2009 pending in the court of<\/p>\n<p>          Additional District Judge VI, Gaya, as appears,<\/p>\n<p>          it was filed under section 166 of the Motor<\/p>\n<p>          Vehicles Act. It was advised to the appellant<\/p>\n<p>          to satisfy the liability as per order of the<\/p>\n<p>          court    below    under      section    140    of   the   Act,<\/p>\n<p>          subject to final adjudication as to which of<\/p>\n<p>          the insurance company is liable to compensate<\/p>\n<p>          the claimants and to what extent the suggestion<\/p>\n<p>          is accepted.\n<\/p>\n<p>                    In     view   of    the     above,   this   appeal<\/p>\n<p>          itself    is     hereby      disposed    of    without     any<\/p>\n<p>          adjudication on merit, leaving the extent of<\/p>\n<p>          liability inter se between the two insurance<\/p>\n<p>          companies involved to be decided by the claim<\/p>\n<p>          tribunal as submitted by learned counsel for<\/p>\n<p>          the appellant by framing specific issue. The<\/p>\n<p>          appellant shall pay the amount under award with<\/p>\n<p>          interest within a month.
