No.19077 of 2008\n                ---------------------------------\n        Dated, this the 23rd day of October, 2008\n\n                       J U D G M E N T\n<\/pre>\n<p>Balakrishnan Nair, J.\n<\/p>\n<\/p>\n<p>     The petitioner is a spinster, who is staying along with<\/p>\n<p>her old grant mother and mentally retarded brother. The<\/p>\n<p>respondents 2 to 6 are running a granite crusher unit in the<\/p>\n<p>neighbouring property.      The petitioner submits that the<\/p>\n<p>capacity of the unit was increased illegally.     Further, the<\/p>\n<p>crusher unit is causing great nuisance to her.        So the<\/p>\n<p>petitioner filed several complaints before various authorities<\/p>\n<p>like Grama Panchayat, Pollution Control Board, etc.<\/p>\n<p>Infuriated by this, the respondents 2 to 6 are threatening<\/p>\n<p>and harassing her. The 5th respondent came to the house of<\/p>\n<p>the petitioner on 23\/04\/2008 saying that he wanted to have<\/p>\n<p>some discussions with her about the complaints made by<\/p>\n<p>her.   But he threatened the petitioner not to pursue her<\/p>\n<p>WP(C) No.19077\/2008<br \/>\n<span class=\"hidden_text\">                               -2-<\/span><\/p>\n<p>complaints. He told her that he is running three quarries<\/p>\n<p>with the assistance of gundas and he is having bombs also.<\/p>\n<p>He also told that he will finish the petitioner and will go to<\/p>\n<p>jail, it is submitted. The frightened petitioner filed Ext.P1<\/p>\n<p>representation before the Deputy Superintendent of Police<\/p>\n<p>about the incident and also seeking protection to her life,<\/p>\n<p>which was followed by Ext.P2 representation before the<\/p>\n<p>Superintendent of Police. Alleging that the police did not<\/p>\n<p>take any action, this writ petition is filed.<\/p>\n<p>      2.    The learned Government Pleader upon instructions<\/p>\n<p>submitted that since the petitioner is a spinster living alone,<\/p>\n<p>the police took special care to look into the grievances of the<\/p>\n<p>petitioner. The Deputy Superintendent of Police visited the<\/p>\n<p>place and took her statement. The party respondents were<\/p>\n<p>summoned and they were strictly warned not to create any<\/p>\n<p>problem to her. It is submitted that the police is keeping<\/p>\n<p>surveillance over the area and if she points out any<\/p>\n<p>problem, the police will take appropriate remedial action.<\/p>\n<p>WP(C) No.19077\/2008<br \/>\n<span class=\"hidden_text\">                              -3-<\/span><\/p>\n<p>      3.   The respondents 2 to 6 have filed a counter<\/p>\n<p>affidavit denying all the allegations against them.      They<\/p>\n<p>submitted that the petitioner has got an axe to grind against<\/p>\n<p>them for having objected to filling up of a water channel.<\/p>\n<p>The allegations are made to defame and harass them. All<\/p>\n<p>the allegations are unfounded. They further submitted that<\/p>\n<p>they have no intention, whatsoever, to threaten the<\/p>\n<p>petitioner or to cause any harm to the petitioner in any<\/p>\n<p>manner.\n<\/p>\n<p>     4.    We notice that the submissions made by the<\/p>\n<p>learned Government Pleader will redress the grievance of<\/p>\n<p>the writ petitioner. The respondents 2 to 6 also submitted<\/p>\n<p>before this Court that they have no intention, whatsoever,<\/p>\n<p>to harass the petitioner.
